Time limits on the processing of discretionary projects established by state law do not start until a
project application is deemed complete by the City. The City has 30 calendar days from the date of
application submittal to determine whether an application is complete or incomplete. Within 30 days of
submittal of this application you will receive a letter stating whether this application is complete or
incomplete. If it is incomplete, the letter will state what is needed to make this application complete.
When the application is complete, the processing period will start upon the date of the completion letter.

To address post-development pollutants that may be generated from development projects, the City requires that new development and
significant redevelopment priority projects incorporate Permanent Stomi Water Best Management Practices (BMP's) into the project
design per the City's Standard Urban Stormwater Management Plan (SUSMP). To view the SUSMP, refer to the Engineering Standards
(Volume 4, Chapter 2) at www.carlsbadca.qov/standards.
Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision,
discretionary permits and/or construction permits). The results of the questionnaire determine the level of stonn water standards that
must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to
'Standard Stormwater Requirements' or be subject to additional criteria called 'Priority Development Project Requirements'. Many
aspects of project site design are dependent upon the storm water standards applied to a project.
Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has
responsibility for making the final assessment after submission of the development application. If staff determines that the questionnaire
was inconBCtly filled out and is subject to more stringent stomn water standards than initially assessed by you, this will result in the return
of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City.
If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, please
seek assistance from Land Development Engineering staff.
A separate completed and signed questionnaire must be submitted for each new development applk:ation submission. Only one
completed and signed questionnaire is required when multiple development applications for the same project are submitted concurrently.
In addition to this questionnaire, you must also complete, sign and submit a Project Threat Assessment Fonn with construction permits
for the project.

6. Your Title is defective. Some of these defects are:
a. Someone else's failure to have authorized a transfer or
conveyance of your Title.
b. Someone else's failure to create a valid document by electronic
means.
C. A document upon which Your Title is based is invalid because it
was not properly signed, sealed, acknowledged, delivered or
recorded.
d. A document upon which Your Title is based was signed using a
falsified, expired, or otherwise invalid power of attomey.
e. A document upon which Your Title is based was not properly
filed, recorded, or indexed in the Public Records.
f. A defective judicial or administrative proceeding.
7. Any of Covered Risl<s 1 through 6 occuning after the Policy Date.
8. Someone else has a lien on Your Title, including a:
a. lien of real estate taxes or assessments imposed on Your Title
by a govemmental authority that are due or payable, but unpaid;
b. Mortgage;
c. judgment, state or federal tax lien;
d. charge by a homeowner's or condominium association; or
e. lien, occurring before or after the Policy Date, for labor and
material fumished before the Policy Date.
9. Someone else has an encumbrance on Your Title.
10. Someone else daims to have rights affecting Your Title because of
fraud, duress, incompetency or Incapacity.
11. You do not have actual vehicular and pedestrian access to and from
the Land, based upon a legal right.
12. You are forced to correct or remove an existing violation of any
covenant, condition or restriction affecting the Land, even if the
covenant, condition or restriction is excepted in Schedule B.
However, You are not covered for any violation that relates to:
a. any obligation to perform maintenance or repair on the Land; or
b. environmental protection of any kind, Including hazardous or
toxic conditions or sutistances
unless there is a notice recorded in the Public ReconJs, describing any
part of the Land, claiming a violation exists. Our liability for this Covered
Risic is limited to the extent of the violation stated In that notice.
13. Your Title is lost or taken because of a violation of any covenant,
condition or restriction, wrfilch occurred before You acquired Your
Title, even if the covenant, condition or restriction Is excepted In
Schedule B.

enforcement action stated In that notice.
16. Because of an existing violation of a subdivision law or regulation
affecting the Land:
a. You are unable to obtain a building permit;
b. You are required to connect or remove the violation; or
c. someone else has a legal right to, and does, refuse to perform a
contract to purchase the Land, lease it or make a Mortgage loan on it
The amount of Your insurance for this Covered Risk is subject to
Your Deductible Amount and Our Maximum Dollar Limit of Liability
shown in Schedule A.
17. You lose Your Title to any part of the Land because of the right to
take the Land by condemning it, if
a. there is a notice of the exercise of the right recorded in the Public
Records and the notice describes any part ofthe Land; or
b. the taking happened before the Policy Date and Is binding on
You if You bought the Land without Knowing of the taking.
18. You are torced to remove or remedy Your existing structures, or any
part of them - other than boundary walls or fences - because any
portion was buiK without obtaining a building permit from the proper
govemment office. The amount of Your insurance for this Covered
Risk Is subject to Your Deductible Amount and Our Maximum Dollar
Limit of Liability shown In Schedule A
19- You are forced to remove or remedy Your existing structures, or any
part of them, because they violate an existing zoning law or zoning
regulation. If You are required to remedy any portion of Your existing
structures, the amount of Your insurance for this Covered Risk Is
subject to Your Deductible Amount and Our Maximum Dollar Limit of
Liability shown in Schedule A.
20. You cannot use the Land t>ecause use as a single-family residence
violates an existing zoning law or zoning regulation.
21. You are forced to remove Your existing structures because they
encroach onto Your neightx>r's land. If the encroaching structures
are boundary walls or fences, the amount of Your insurance for this
Covered Risk is subject to Your Deductible Amount and Our
Maximum Dollar Limit of Liability shown in Schedule A.
22. Someone else has a legal right to, and does, refuse to perform a
contract to purchase the Land, lease it or make a Mortgage loan on It
because Your neighbor's existing structures encroach onto the Land.
23. You are forced to remove Your existing structures which encroach
onto an easement or over a building set-back line, even If the
Easement or building set-back line Is excepted in Schedule B.
24. Your existing structures are damaged because of the exercise of a
right to maintain or use any Easement affecting the Land, even if the
easement Is excepted In Schedule B.
25. Your existing improvements (or a replacement or modification made
to them after the Policy Date), Induding lawns, shrubbery or trees,
are damaged because of the future exerdse of a right to use the
surface of the Land for the extraction or development of minerals,
water or any other substance, even if those rights are excepted or
reserved from the description of the Land or excepted in Schedule B.
26. Someone else tries to enforce a discriminatory covenant, condition or
restriction that they claim affeds Your Title which is based upon race,
color, religion, sex, handicap, ^milial status, or national origin.
27. A taxing authority assesses supplemental real estate taxes not
previously assessed against the Land for any period before the
Policy Date because of construction or a change of ownership or use
that occurred t>efore the Policy Date.
28. Your neighbor builds any strudures after the Policy Date - other than
boundary walls or fences - which encroach onto the Land.
29. Your Title is unmari^etable, which aHows someone else to refuse to
perform a centred to purchase the Land, lease it or make a
Mortgage loan on it
30. Someone else owns an interest in Your Title because a court order
invalidates a prior transfer of the title under federal bankruptcy, state
insolvency, or similar creditors' rights laws.
31. The residence with the address shown in Schedule A is not located
on the Land at the Policy Date.

OUR DUTY TO DEFEND AGAINST LEGAL ACTIONS
We will defend Your Title in any legal action only as to that part of the
adion which is based on a Covered Risk and which Is not excepted or
exduded fi'om coverage in this Policy. We will pay the costs, attomeys'
fees, and expenses We incur in that defense.
We can end Our duty to defend Your Title under Sedion 4 of the
Conditions.
THIS POLICY IS NOT COMPLETE WITHOUT SCHEDULES A AND B
We will not pay for any part of the legal adIon which Is not based on a
Covered Risk or which is excepted or exduded from coverage in this
Policy.
EXCLUSIONS
In addition to the Exceptions iri Schedule B, You are not insured against
loss, costs, attomeys' fees, and expenses resulting from:
1. Govemmental police power, and the existence or violation of those
portions of any law or govemment regulation conceming:
a. building;
b. zoning;
c. land use;
d. improvements on the Land;
e. land division; and
f. environmental protection.
This Exdusion does not limit the coverage described In Covered Risk
8.a., 14, 15, 16, 18, 19, 20, 23 or 27.
2. The failure of Your existing strudures, or any part of them, to be
construded in accordance with applicable building codes. This
Exdusion does not limit the coverage described In Covered Risk 14
oris.
3. The right to take the Land by coridemning it This Exdusion does not
limit the coverage described in Covered Risk 17.

Failure to pay value for Your Title.
Lack of a right
a. to any land outside the area spedfically described and referred
to in paragraph 3 of Schedule A; and
b. in streets, alleys, or watenways that touch the Land.
The ttansfer of the Title to You is invalid as a preferential transfer
or as a fraudulent transfer or conveyance under federal
bankruptcy, state insolvency, or similar creditors' rights laws.
This Exclusion does not limit the coverage descritjed in Covered Risk
11 or21.

Natural Person for estate planning.
c. Known - things about which You have actual knowledge. The

d. Land - the land or condominium unit described in paragraph 3 of
Schedule A and any improvements on the Land which are real
property.
e. Mortgage - a mortgage, deed of tnjst, trust deed or other
security instrument
f. Natural Person - a human being, not a commerdal or legal
organization or entity. Natural Person indudes a trustee of a
Trust even If the trustee Is not a human being.
g. Policv Date - the date and time shown in Schedule A. If the
Insured named in Schedule A first acquires the Interest shown In
Schedule A by an Instrument recorded in the Public Records
later than the date and time shown in Schedule A, the Policy
Date Is the date and time the instrument is recorded.
h. Public Records - records that give construdlve notice of matters
affeding Your Title, according to the state statutes where the
Land is located.
I. Title - the ownership of Your Interest In the Land, as shown in
Schedule A.
j. Trust - a living trust established by a Natural Person for estate
planning.
k. We/Our/Us - Stewart Title Guaranty Company.
1. You/Your - the insured named in Schedule A and also those
Identified In Sedion 2.b. of these Conditions.
2. CONTINUATION OF COVERAGE
a. This Policy insures You forever, even after You no longer have
Your Title. You cannot assign this Policy to anyone else.
This Policy also insures:
(1) anyone who inherits Your Title because of Your death;
(2) Your spouse who receives Your Title because of dissolution
of Your maniage;
(3) the trustee or successor trustee of a Tmst or any Estate
Planning Entity to whom You transfer Your Title after the
Policy Date;
(4) the beneficiaries of Your Tnjst upon Your death; or
(5) anyone who receives Your Title by a transfer effective on
Your death as authorized by law.
c. We may assert against the insureds Identified in Section 2.b. any
rights and defenses that W^ have against any previous Insured
under this Policy.
HOW TO MAKE A CLAIM
a. Prompt Notice Of Your Claim
(1) As soon as You Know of anything that might be covered by
this Policy, You must notify Us promptly in writing.
(2) Send Your notice to Stewart Title Guaranty Company,
P.O. Box 2029, Houston, Texas 77252-2029, Attention:
Claims Department. Please indude the Policy number
shown In Schedule A, and the county and state where the
Land is located. Please endose a copy of Your policy, if
available.
(3) If You do not give Us prompt notice, Your coverage vflll be
reduced or ended, but only to the extent Your failure affects
Our ability to resolve the claim or defend You.
b. Proof Of Your Loss
(1) We may require You to give Us a written statement signed
by You describing Your loss which Indudes:
(a) the basis of Your claim;
(b) the Covered Risks which resulted in Your loss;
(c) the dollar amount of Your Loss; and

(d) the method You used to compute the amount of Your loss.
(2) We may require You to make available to Us records,
checks, letters, contrads. Insurance polldes and other
papers which relate to Your daim. We may make copies of
these papers.
(3) We may require You to answer questions about Your daim
under oath.
(4) If you fall or refuse to give Us a statement of loss, answer
Our questions under oath, or make available to Us the
papers We request. Your coverage will be reduced or
ended, but only to the extent Your failure or refusal affects
Our ability to resolve the daim or defend You.
4. OUR CHOICES WHEN WE LEARN OF A CLAIM
a. After We receive Your notice, or othenMse learn, of a daim that
is covered by this Policy, Our choices Indude one or more of the
following:
(1) Pay the daim;
(2) Negotiate a settlement;
(3) Bring or defend a legal adIon related to the daim;
(4) Pay You the amount required by this Policy;
(5) End the coverage of this Policy for the daim by paying You
Your adual loss resulting from the Covered Risk, and those
costs, attorneys' fees and expenses incurred up to that time
which We are obligated to pay;
(6) End the coverage described in Covered Risk 16, 18, 19 or
21 by paying You the amount of Your insurance then in
force for the particular Covered Risk, and those costs,
attomeys' fees and expenses incurred up to that time which
We are obligated to pay;
(7) End all coverage of this Policy by paying You the Policy
Amount then In force, and those costs, attorneys' fees and
expenses incun-ed up to that time which We are obligated to
pay;
(8) Take other appropriate action.
b. V\*ien We choose the options In Sedlons 4.a. (5), (6) or (7), all
Our obligations fer the daim end, induding Our obligation to
defend, or continue to defend, any legal adion.
c. Even If We do not think that the Policy covers the daim. We may
choose one or more of the options above. By doing so, Wfe do
not give up any rights.
5. HANDUNG A CLAIM OR LEGAL ACTION
a. You must cooperate with Us in handling any daim or legal adion
and give Us all relevant infermation.
b. If You fall or refuse to cooperate with Us, Your coverage will be
reduced or ended, but only to the extent Your failure or refusal
affeds Our ability to resolve the daim or defend You.
c. We are required to repay You only for those settlement costs,
attomeys' fees and expenses that We approve In advance.
d. We have the right to choose the attomey virfien Wte bring or
defend a legal adion on Your t>ehalf. We can appeal any
dedsion to the highest level. We do not have to pay Your daim
until the legal adion is finally dedded.
e. Whether or not We agree there is coverage. We can bring or
defend a legal adion, or fake other appropriate adion under this
Policy. By doing so. We do not give up any rights.
6. LIMITATION OF OUR UABIUTY
a. After subtracting Your Dedudible Amount if It applies, We will
pay no more than the least of:
(1) Your adual loss;
(2) Our Maximum Dollar Limit of Liability then In force for the
particular Covered Risk, for daims covered only under
Covered Risk 16, 18, 19 or 21; or
(3) the Policy Amount then in force.
and any costs, attomeys' fees and expenses that We are
obligated to pay under this Policy.
b. If We pursue Our rights under Sections 4.a.(3) and S.e. of these
Conditions and are unsuccessful in establishing the Tide, as Insured:
(1) the Policy Amount then In force will be Increased by 10% of
the Policy Amount shown In Schedule A, and
(2) You shall have the right to have the actual loss determined
on either the date the daim was made by You or the date it
is settled and paid.
c. (1) If We remove the cause of the daim vinth reasonable
diligence after receiving notice of It, all Our obligations for
the daim end, induding any obligation for loss You had
while We were removing the cause ofthe daim.
(2) Reganlless of 6.c.(1) above, if You cannot use the Land
because of a daim covered by this Policy:
(a) You may rent a reasonably equivalent substitute
residence and We will repay You for the adual rent You
pay, until the eariier of:
(I) the cause of the daim is removed; or
(ii) Wis pay You the amount required by this Policy. If
Your daim is covered only under Covered Risk 16,
18, 19 or 21, that payment is the amount of Your
insurance ttien in force for the particular Covered
Risk.
(b) We will pay reasonable costs You pay to relocate any
jsersonal property You have the right to remove from the
Land, induding transportatfon of that personal property
for up to twenty-five (25) miles from the Land, and repair
of any damage to that personal pnjperty because of the
relocation. The amount We will pay You under this
paragraph Is limited to the value of the personal
property before You relocate It
d. All payments We make under this Policy reduce the Policy
Amount then in force, except for costs, attorneys' fees and
expenses. All payments We make for daims which are covered
only under Covered Risk 16, 18, 19 or 21 also reduce Our
Maximum Dollar Limit of LiatMlity for the particular Covered Risk,
except for costs, attomeys' fees and expenses.
e. If We issue, or have issued, a Policy to the owner of a Mortgage
that is on Your Title and We have not given You any coverage
against the Mortgage, then:
(1) W^ have the right to pay any amount due You under this
Policy to the owner of the Mortgage, and any amount paid
shall be treated as a payment to You under this Policy,
induding under Section 4.a. of these Conditions;
(2) Any amount paid to the owner of the Mortgage shall be
subtraded from the PoWcy Amount then in force; and
(3) If Your daim Is covered only urider Covered Risk 16, 18, 19
or 21, any amount paid to the owner of the Mortgage shall
also be subtraded from Our Maximum Dollar Limit of
Liability for the particular Covered Risk.
f. If You do anything to affect any right of recovery You may have
against someone else. We can sul>tract from Our liability the
amount by which You reduced the value of that right
7. TRANSFER OF YOUR RIGHTS TO US
a. When We settle Your daim, We have all the rights and remedies
You have against any person or property related to the daim.
You must not do anything to affed these rights and remedies.
When We ask, You must execute documents to evidence the
transfer to Us of these rights and remedies. You must let Us use
Your name In enfordng these rights and remedies.

b. We will not be liable to You If We do not pursue these rights and
remedies or if We do not recover any amount that might be
recoverable.
c. We will pay any money We colled from enforcing these rights
and remedies in the following order:
(1) to Us for the costs, attorneys' fees and experises We paid to

(2) to You for Your loss that You have not already colleded;
(3) to Us for any money We paid out under this Policy on
account of Your daim; and
(4) to You whatever is left.
d. If You have rights and remedies under contrads (such as
indemnities, guaranties, tionds or other policies of Insurance) to
recover all or part of Your loss, then We have all of those rights
and remedies, even If those contrads provide that those
obligated have all of Your rights and remedies under this Policy.
8. THIS POUCY IS THE ENTIRE CONTRACT
This Policy, with any endorsements, Is the entire contrad between
You and Us. To determine the meaning of any part of this Policy,
You must read the entire Policy and any endorsements. Any
changes to this Policy must be agreed to In writing by Us. Any daim
You make against Us must be made under this Policy and Is subject
to Its terms.
9. INCREASED POUCY AMOUNT
This Policy Amount then In force will Increase by ten percent (10%)
ofthe Policy Amount shown in Schedule A each year for the first five
years following the Policy Date shown in Schedule A, up to one
hundred and fifty percent (150%) of the Policy Amount shown in
Schedule A The Increase each year will happen on the anniversary
of the Policy Date shown in Schedule A.
10. SEVERABILITY
If any part of this Policy is held to be legally unenforceable, both You
and We can still enforce the rest of this Policy.
11. ARBITRATION
a. If pemiitted in the state where the Land Is located, You or We
may demand arbitration.
b. The law used in the arbitration is the law of the state where the
Land is located.
c The arbitration shall be under the Title Insurance Arbitration
Rules of the American Land Title Assodation ("Rules'). You can
get a copy ofthe Rules fi^om us.
d. Except as provided In the Rules, You cannot join or consolidate
Your daim or controversy with daims or controversies of other
persons.
e. The arbitration shall be binding on both You and Us. The
arbitration shall decide any matter In dispute between You and

12. CHOICE OF LAW

TIlis early public notice is to let you know that a development application for a Coastal Development
Permit project within your neighborhood has been submitted to the City of Carlsbad on September 13,
2013. The project application is undergoing its initial review by the City.
LOCATION: 2371 Buena Vista Circle
PROJECT DESCRIPTION: Addition and remodel of existing single-family residence to include a second
dwelling unit, new second floor and four-car garage, a pool in the front yard, and landscaping
improvements.
Please keep in mind that this is an early public notice and that the project design could change as a
result of further staff and public review. A future public hearing notice will be mailed to you when this
project is scheduled for public hearing before the Planning Commission.

Please advise the applicant to make the following revisions to the plans so that they will meet the
requirements of the City of Carlsbad's Landscape Manual.
Numbers below are referenced on the red line plans where appropriate for ease in locating the
area of the comment concem.
1. The Landscape Manual indicates that plans shall be prepared by a licensed landscape
architect, licensed civil engineer, licensed architect, or other qualified professional
licensed by the state to do this work. Please provide a valid license stamp on the
landscape plan.
2. Please add the street name.
3. Please add a bar scale to the plan.
4. Please show the existing and proposed contours on the landscape plans.
5. Please indicate positive surface drainage (2% grade in planting areas) away from
structures and terminating in an approved drainage system. This may be provided in a
note on the plans.
6. Please specify/label all paving (i.e. existing to remain, proposed paving identifying
materials).
7. Please identify all proposed plantings in all areas.
8. Please specify the plant species proposed for the hedge.
9. The planting palette shall include:

11. Please provide a maintenance responsibilities exhibit. This may be covered with a note
on the planting plan (i.e. property owner shall be responsible for the maintenance of all
landscape areas shown on the plans).
12. The Landscape Manual indicates thatthe landscape shall feature ground cover, shrubs,
and trees to screen elements of unsightliness and screen/soften new improvements. The

Plan Review Recommendations
The City of Carisbad Police Department's Crime Prevention Unit has provided the following optimal security
recommendations. The purpose of this document is to safeguard property and public welfare by regulating and
reviewing the design, construction, quality of materials, use and occupancy, location, and maintenance of all
buildings and structures. The standards used in this document represent model international standards.
Crime Prevention through Environmental Design
The proper design and effective use of the built environment can lead to a reduction in the fear and incidence of
crime and an improvement in the quality of life. The proper design influences this by positively affecting human
behavior. The design includes the physical environment, the planned behavior of people, the productive use of
space and an effective crime/loss prevention program.
Natural Surveillance
1. Place and design physical features to maximize visibility. This will include building orientation, windows,
entrances, walkways, landscape trees and shrubs, fences and any other physical obstruction.
2. Design the placement of persons and or activities to maximize surveillance possibilities.
3. Design lighting that provides for appropriate nighttime illumination of walkways, entrances and
driveways.
Natural Access Control
1. Use walkways, pavement, lighting and landscaping to clearly guide guests to and from selected entrances.
2. Use real or symbolic barriers like fences or landscaping to prevent and or discourage access to or from
dark and or unmonitored areas.
Provisions for territorial reinforcement
1. Use pavement treatments, landscaping and fences to define and outline ownership or property.
Lighting
1. Equip building on all sides with light fixtures.
2. All types of exterior doors should be illuminated during the hours of darkness.
3. Install lights on the building in the eaves to illuminate the perimeter of the house.
4. Choose light fixtures with dawn to dusk sensors or timers not motion sensors.

Landscaping
1. Plan a landscaping design that enhances surveillance and security.
2. Tree canopies should be no lower than six (6) feet and should not allow access to roofs or balconies.
3. Ensure landscaping plan does not deter from lighting and addressing.
4. Plant only low profile shrubs that can be maintained below two (2) feet.
5. Use security plants where necessary to prevent entering and tampering.
6. Install walls and fences that are see-through and enhance surveillance.
7. Install lockable gates that allow surveillance.
Addressing
1. Locate numerals where they are clearly visible from the front street
2. Contrast the numeral's color to the background on which it is affixed.
3. Numerals shall be no less than four (4) inches in height and illuminated during the hours of darkness.
Entrances
1. Design front entrances to provide vision from the front door to the front access street.
2. Keep entranceways clear of clutter.
Doors
1. Do not use of glass within 42 inches of a locking device.
2. A single or double door shall be equipped with a double cylinder deadbolt with a bolt projection
exceeding one inch or a hook-shaped or expanding deadbolt that engages the strike sufficiently to prevent
spreading. The deadbolt lock shall have a minimum of five-pin tumblers and a cylinder guard.
3. Install wooden doors of solid core construction with a minimum thickness of one and three-fourths (1-3/4)
inches.
4. Provide a double door inactive leaf with metal flush bolts having a minimum embedment of five-eighths
(5/8) of an inch into the header and footer of the doorframe.
Strike Plates
1. Reinforce all deadbolt strike plates. Choose Strike plates constructed of a minimum 16 U.S. gauge steel,
bronze, or brass and secure it to the jamb by a minimum of two screws, which should penetrate at least
two (2) inches into the solid backing beyond the surface to which the strike is attached. Re-enforcement
ofthe door area around the lock is also suggested.
Viewer
1. Arrange entrance doors so that the occupant has a view of the area immediately outside the door without
opening the door. Except doors requiring a fire protection rating that prohibits them, such a view may be
provided by a door viewer having a field of view of not less than 190 degrees. Mounting height should not
exceed fifty-four (54) inches from the floor.
Windows and sliding glass doors
1. All exterior sliding glass doors and windows should be equipped with locking devices which will keep the
sliding panel ofthe door or window from being opened from the outside horizontally or vertically.
2. Ensure windows have security features preventing the window from being forced to slide or rise.
3. Consider security glazing.
Alarm system
1. When considering an alarm system, consider a verified system.

The City has completed a review of the application for a Minor Coastal Development Permit for the
development of a 640 square foot second dwelling unit located at 2371 Buena Vista Circle.
It is the City Planner's determination that the project CDP 13-28 - Taylor Remodel and SDU, is consistent
with the city's applicable Coastal Development Regulations (Chapters 21.201 - 21.205) and with all other
applicable city ordinances and policies. The City Planner, therefore, APPROVES this request based upon
the following:
1. That the total cost of the proposed development is less than $60,000.
2. That the proposed development requires no discretionary approvals other than a Minor Coastal
Development Permit.
3. That the development is in conformity with the public access and public recreation policies of
Chapter 3 ofthe Coastal Act, in that the project has been conditioned to dedicate an irrevocable
25 foot wide lateral access easement along the Buena Vista Lagoon to the California Coastal
Commission or their designee as agreed to with the California Coastal Commission.
4. The proposed development will have no adverse effect on coastal resources, in that the second
dwelling unit will be constructed above an existing garage which is located on the front portion
ofthe lot, furthest away from the Buena Vista Lagoon. Furthermore, construction ofthe project
will adhere to the city's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance,
Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff
Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion.
5. That the proposed development is in conformance with the Certified Local Coastal Program and
all applicable policies in that the site is designated for residential uses the project site is
designated for single-family residential development, and is already disturbed and developed
with one single-family home. The development consists of a 640 square foot second dwelling

designated for single-family residential development, and is already disturbed and developed
with one single-family home. The development consists of a 640 square foot second dwelling
unit above an existing garage. The addition will not obstruct views of the coastline as seen
from public lands or the public right-of-way, nor otherwise damage the visual beauty of the
coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive
biological resources located on the property. Furthermore, the proposed residential addition
is not in an area of known geologic instability or flood hazards.
6. That the request for a minor coastal development permit was adequately noticed at least ten
(10) calendar days before the date of this decision pursuant to Section 21.201.080(B) and (C) of
the Carlsbad Coastal Development Regulations.
7. That the City Planner has determined that the project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15303 (New Construction of Small
Structures) ofthe State CEQA Guidelines and will not have any adverse significant impact on the
environment.
8. The City Planner has reviewed each of the exactions imposed on the Developer contained in this
resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts
caused or reasonably related to the project, and the extent and the degree ofthe exaction is in
rough proportionality to the impact caused by the project.
Conditions:
1. The City Planner does hereby APPROVE the Minor Coastal Development Permit, CDP 13-28, for
the project entitled Taylor Remodel and SDU (Exhibits "A" - "L"), dated April 16, 2014, on file in
the Planning Division and incorporated by this reference, subject to the conditions herein set
forth.
2. If any of the following conditions fail to occur; or if they are, by their terms, to be implemented
and maintained over time, if any of such conditions fail to be so implemented and maintained
according to their terms, the City shall have the right to revoke or modify all approvals herein
granted; deny or further condition issuance of all future building permits; deny, revoke or
further condition all certificates of occupancy issued under the authority of approvals herein
granted; record a notice of violation on the property title; institute and prosecute litigation to
compel their compliance with said conditions or seek damages for their violation. No vested
rights are gained by Developer or a successor in interest by the City's approval of this Minor
Coastal Development Permit.
3. Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the Minor Coastal Development Permit documents, as necessary to make
them internally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
different from this approval, shall require an amendment to this approval.
4. The Developer shall comply with all applicable provisions of federal, state, and local laws and
regulations in effect at the time of building permit issuance.

5. If any condition for construction of any public improvements or facilities, or the payment of any
fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged,
this approval shall be suspended as provided in Government Code Section 66020. If any such
condition is determined to be invalid this approval shall be invalid unless the City Council
determines that the project without the condition complies with all requirements of law.
6. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold
harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims and
costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly,
from (a) City's approval and issuance of this Minor Coastal Development Permit, (b) City's
approval or issuance of any permit or action, whether discretionary or nondiscretionary, in
connection with the use contemplated herein, and (c) Developer/Operator's installation and
operation of the facility permitted hereby, including without limitation, any and all liabilities
arising from the emission by the facility of electromagnetic fields or other energy waves or
emissions. This obligation survives until all legal proceedings have been concluded and
continues even if the City's approval is not validated.
7. This approval shall become null and void if building permits are not issued for this project within
24 months from the date of project approval.
8. Prior to the issuance of a building permit, the Developer shall provide proof to the Building
Division from the Carlsbad School District that this project has satisfied its obligation to provide
school facilities.
9. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the
License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD
#1 special tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code
Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee
for Zone 1, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building
permit. If the taxes/fees are not paid, this approval will not be consistent with the General Plan
and shall become void.
10. Prior to the issuance of the building permit. Developer shall submit to the City a Notice of
Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the City
Planner, notifying all interested parties and successors in interest that the City of Carlsbad has
issued a Minor Coastal Development Permit on the property. Said Notice of Restriction shall
note the property description, location of the file containing complete project details and all
conditions of approval as well as any conditions or restrictions specified for inclusion in the
Notice of Restriction. The City Planner has the authority to execute and record an amendment
to the notice which modifies or terminates said notice upon a showing of good cause by the
Developer or successor in interest. The notice of restriction shall declare that
a. The property owner(s) shall reside in either the main dwelling unit or the second
dwelling unit, unless a lessee leases both the main dwelling and the second dwelling
unit.
b. The obligations and restrictions imposed on the second dwelling unit per Chapter
21.10.030 of the Carlsbad Municipal Code are binding on all present and future property
owners.

11. Approval of this request shall not excuse compliance with all applicable sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit issuance,
except as otherwise specifically provided herein.
12. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project, Developer shall apply for and obtain approval from, the City Engineer for the
proposed haul route.
13. Premise identification (addresses) shall be provided consistent with Carlsbad Municipal Code
Section 18.04.320.

1. The Planning Division staff will be consulting with the California Department of Fish and Wildlife
regarding the Sensitive Plant and Habitat Assessment that was prepared by Planning Systems on
December 26, 2013.
2. Please remove the five (5) foot tall fence from the front yard setback area. Pursuant to Chapter
21.46.130 of the municipal code, no fence, wall, or hedge over forty-two inches in height shall be
permitted in any required front yard setback. Please note that the California Building Code requires a

illustration on plans of existing trees anchor any trees to be removed. There are
no existing trees that are 12" in diameter, or larger, to be removed so the
Landscape MasterPlan sheet 'L.V does not indicate such. The Topographic
Survey Plan sheet'S' and the Existing Slope Analysis, Site and Floor Plan
(sheets '1a', Ex.1'and 'Ex.2') indicate the 36"/18"/5" dia. trees in the front yard
that have been removed previously. The proposed site and floor plans do not
show this tree due to its non-existence: however, they do now show the existing
30" and 10" trees in the front yard that are to remain.

Dear Mr. Taylor:
Planning Systems biologists have completed a Sensitive Plant and Habitat Assessment
for the property located at 2371 Buena Vista Circle in the City of Carlsbad California.
This property is also known as Assessor's Parcel Number (APN) 155-221-08-00 in the
County of San Diego, Califomia. The assessment was conducted at the request of the
City of Carlsbad Planning Department in support of the property owner's application
for remodeling of the existing house on the property. The objective of the assessment
was to detennine if there are any state or federal sensitive/protected plant species
and/or habitats on the property. If such resources were identified the secondary
objective was to determine if the resources would be impacted by the proposed
remodeling. The methods, results and conclusions of this assessment are described in
the sections below.
Methods
On 23 December 2013, Planning Systems' restoration ecologist Greg Evans conducted
a vegetation survey of the subject property to identify plants and habitat present
onsite. The entire property was traversed on foot and the biological resources were
located on both an aerial photograph and the remodeling plan for the project. The site
plan was used to assess potential impacts attributable to the remodeling activity.
Environmental Setting
The subject property is located in an urbanized area and occupies approximately 0.23
acres. Single family residential properties exist uimiediately to the north and to the
south of the subject property. Buena Vista Circle nms along the eastem property line
and Buena Vista Lagoon is located along the westem property line.
The subject property supports a single-family residence, detached garage and a paved
driveway at the southeast corner of the property providing access to Buena Vista
Circle. The land slopes from a high point of approximately 45.5 above mean sea level
(MSL) along Buena Vista Circle to a low point of 11 feet MSL adjacent to Buena Vista

Lagoon (BVL). BVL effectively forms western boundary of the property. BVL
represents freshwater marsh habitat (wetlands) and is therefore protected under state
and federal statute.
Two soil types are present on the property, Marina loamy coarse sand, on 2 to 9%
slopes, and Terrace escarpments per the USDA Soil Survey for San Diego Coimty (1).
Grading of the property appears to have occurred only in the immediate vicinity of
the existing structures and hardscape elements. The balance of the property does not
appear to have experienced any significant excavation or other historical soil
disturbance.
Flora and Habitat Type
During the course of the plant survey 22 species of plants were identified on the
subject property. Sixteen of these species are considered ornamental, four are non-
native weeds characteristic of disturbed lands and two are considered native plants.
The two species of native plants that occur on the property are a single mature Torrey
pine {Pinus torreyana) and stands of vicid bulmsh {Schoenoplectus acutus). The Torrey
pine was most Kkely planted as an omamental and therefore is listed as such on the
attached plant list and is not discussed as a habitat type below. Vicid or hard-stem
bulmsh is a native freshwater marsh plant widely distributed in California.
The only native habitat that exists on the property is a strip of freshwater marsh
habitat located on the western botmdary of the property adjacent to Buena Vista
Lagoon. This wetland habitat is considered sensitive and protected imder state and
federal regulations. The buUc of the wetland exists offsite in Buena Vista Lagoon. A
small wetland area is located along the westem boundary of the property
approximately 50 feet from the proposed remodeling area. Table 1 shows the
approximate percentage of each habitat type on the subject property.

Most vegetation on the parcel consists of omamental plantings which cover
approximately 85% of the undeveloped portion of the site. An additional 10%
represents disturbed habitat occupied by non-native weeds. The remaining 5%
consists of freshwater marsh habitat occupied by vicid bulmsh.
Conclusions
The only native habitat on the property is the freshwater marsh area adjacent to Buena
Vista Lagoon and separated from the proposed remodeling area by a horizontal
distance of approximately 50 feet and a grade separation of approximately 30 feet.
Given this separation and the use of Best Management Practices for storm water
control, no impacts to the wetland area attributable to the remodeling effort is
The only sensitive species identified onsite is the single mature Torrey Pines. A single
specimen does not constitute habitat. Nonetheless the design of the remodeling
activity allows for the preservation of this specimen.
The non-native habitats (Disturbed and Ornamental) occurring onsite do not support
any state or federal sensitive or protected species. Take of these habitat types
therefore will not incur a mitigation requirement.
The subject property is not located within any Carlsbad HMP Focused Planning Areas
(FPA's), Habitat Linkage Area, Existing or Proposed Hardline Conservation Areas,
Standards Areas, or Special Resource Areas and therefore does not incur any HMP
related mitigation requirements.
The findings described above accurately represent the condition encoimtered onsite in
December of 2013.

Planning:
The following is a repeat comment from the first review. Pursuant to Section 21.203.040(B)(1) of
the Cartsbad Municipal Code, a vegetation map is to be submitted. It should be prepared by
qualified professionals with enough detailed information so that the city can locate the
boundary of the wetland and upland areas and to determine whether the onsite slopes possess
endangered plant/animal species and/or coastal sage scrub and chaparral plant communities.
Critena used to identify any wetlands existing on the site shall be those of Section 30121 ofthe
Coastal Act and based upon the standards of the Local Coastal Program mapping regulations,
and shall be applied in consultation with the State Department of Fish and Wildlife. Slopes of
25% and greater possessing sensitive habitat shall be preserved in the natural state unless the
application of this policy would preclude a reasonable use ofthe property. For slopes equal to or
greater than 25% gradient, which do not include sensitive habitat, encroachment may be
allowed pursuant to Section 21.203.40(A)(3) ofthe Carlsbad Municipal Code. This section ofthe
code requires that a soils investigation be conducted by a licensed soils engineer who must
determine that the subject slope area is stable and grading and development impacts
mitigatable for at least 75 years, or the life ofthe structure.

one. Only the 24 foot maximum building height line is applicable because the roof pitch is less
than 3:12.

2. Exhibit "A" in Stewart Title Guaranty Company Polity of Title Insurance dated May 31, 2013
includes a reference to Resolution recorded January 7, 1970. Please provide a copy of this
resolution and demonstrate that the property boundary shown on the site plan reflects the
action of this resolution. An additional copy of Exhibit "A" was submitted with second review.
3. Add to the site plan information referencing City of Carlsbad Resolution No 45 recorded as Doc.
No. 62929 on May 7,1953 in Book 4848 Page 226 of Official Records of San Diego County which
accepted Buena Vista Circle for public use.
NOTE: The following comments are intended to cause all easements shown in Schedule B of
Stewart Title Guaranty Company Polity of Title Insurance dated May 31, 2013 to be plotted or
listed on the site plan. Easements that are un-locatable should be listed on the site plan with
the grantee, purpose, and recording information. Easements that have been vacated or
quitclaimed and are not reflected in Schedule B should not be shown on the site plan.
4. Schedule B of said title policy lists Item 2 as an easement for public utilities etc. in favor of San
Diego Gas and Electric Company recorded July 14, 1921. Please plot and identify this easement

The following is in response to the 1^ Review Letter dated October 8, 2013:
Planning (Items needed to complete application)
1. As per the Section quoted of the Carisbad Municipal Code, 'slopes of 25% and
greater and possessing sensitive liabitat shall be preserved in a natural state.'
The existing slope on this property at the rear of the lot (the northwest quadrant)
is disturbed and has long-standing non-native omamental plantings that have
existed for decades. It most likely was created as a graded slope when the
original house was developed fifty years ago. See attached 'Preliminary Opinion
of Hillside Stability' provided by soils engineers Jaime Cerros and geologist Jay
Heiser of Geotechnical Exploration which, in summary, describes this slope as
being stable graded fill which can easily support the proposed crib retaining
walls. Also attached is a 'Rear Yard Slope' letter provided by landscape architect
Steve Wichmann of Garner Wichmann Dean Landscape Architects which
describes the rear slope as previously disturbed and vegetated with non-native
ornamental plantings. Therefore the slope is clearly not possessing of sensitive
habitat of which to avoid.
2. Provide 'stringlines' on the site plan illustrating the projection of adjacent
structures per Coastal Shoreline Development Overiay Zone guidelines.. The
Site Plan, on sheet 1, now shows the structures located on the immediate
properties to the north and south of our property, as well as the retaining walls
that each property has.

1. Please correct the measurement of the front yard setback... The side yard and
rear yard setbacks have been adjusted on the Site Plan, sheet 1, as requested.
2. The project is required to be consistent with the Hillside Development
Regulations and Hillside Development and Design Guidelines. The .7/1.0 top of
slope setback per Section 21.95.120(1) has been plotted on the Site Section on
sheet 1 as well as the Exterior Elevations on sheet 5. All proposed construction
falls well back from this angled setback.
3. Please correct the scale ofthe Site Plan on sheet 1. This has been done.
4. Pursuant to Section 21.95.120 ofthe Carisbad Municipal Code, natural slopes

Dear Mr. Taylor:
In accordance with your request as required by the City of Carlsbad, we herein
provide our opinion regarding stability of the hillside at your property in the City of
Carlsbad, California. As you know, a representative of Geotechnical Exploration,
Inc. visited your property on October 12, 2013, to evaluate the soil conditions on
the northerly descending slope in the rear yard. We have been asked at this time
to comment on the level of pre-existing disturbance to the slope and give an
opinion of the long term stability. In addition, we have reviewed the plans by
Studio One Architects, dated July 24, 2013.
SOURCES OF INFORMATION
At the time of our site visit we observed the physical conditions across the surface
of the property in the area of the existing residence and adjacent rear yard
improvements. In addition, we reviewed USDA stereo-pair aerial photographs,
dated May 1953 and County of San Diego topographic maps dated 1960 and 1975.

OBSERVATIONS AND FINDINGS
Site surface observations indicated that the upper portion of the property has been
modified by grading to create the relatively level building pad and adjacent
improvement areas. The rear yard slope is an approximately 10- to 15-foot-high,
1.5:1.0 (horizontal to vertical) fill slope which transitions into a moderately sloping,
natural slope down to Buena Vista Lagoon. We observed evidence of concrete
flatwork and soil disturbance at least 20 to 30 feet beyond the top of the rear yard
slope.
It appears that the descending rear slope consists of fill soils varying in thickness
from a few feet on the slope face to at least 5 feet at the top of portions of the
slope. It is estimated that 80 to 100 percent of the site area has been disturbed by
excavation or placement of artificial fill soils to achieve the building pad and
improvement grades. Also, the existing house is visible on the referenced 1975
topographic map. This indicates that the level building pad was created/disturbed
at least that long ago. The rear yard improvements were placed on the same
graded pad at approximately the same time.
OPINION
We reviewed the plans for the proposed crib retaining walls on the slope and it is
our opinion that they can be built without additional earthwork beyond the wall toe
and with minimal disturbance to the existing non-native, previously disturbed slope
area. The slope is considered to be stable and shows no signs of erosion or gross
instability. Proper surface drainage and irrigation practices will help keep long term
slope stability without significant erosion.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Division has review/ed your
Coastal Development Permit, application no. CDP 13-27/CDP 13-28, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which must
be submitted to complete your application. The second list is project issues of concern to staff. In order to
expedite the processing of your application, the "incomplete" items and your response to the project issues
of concern to Staff must be submitted directly to your staff planner; therefore, please contact your staff
planner directly to schedule a re-submittal appointment. As part of your re-submittal package, please
prepare and Include with your re-submittal: (1) a copy of these lists, (2) a detailed letter summarizing how all
identified incomplete items and/or project issues have been addressed; and (3) five (5) sets of revised plans.
No processing of your application can occur until the application is determined to be complete.
When all required materials are submitted, the City has 30 days to make a determination of completeness. If
the application is determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially filed, September
13, 2013, to either resubmit the application or submit the required information. Failure to resubmit the
application or to submit the materials necessary to determine your application complete shall be deemed to
constitute withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new
application must be submitted.
At this time, the City asks that you provide 3 complete sets of the development plans so that the project can
continue to be reviewed. The Citv will complete the review of vour resubmittal within 25 davs.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
Planning:
1. Pursuant to Section 21.203.040(B)(1) of the Carlsbad Municipal Code, a vegetation map is to be
submitted. It should be prepared by qualified professionals with enough detailed information so
that the city can locate the boundary of the wetland and upland areas and to determine
whether the onsite slopes possess endangered plant/animal species and/or coastal sage scrub
and chaparral plant communities. Criteria used to identify any wetlands existing on the site
shall be those of Section 30121 of the Coastal Act and based upon the standards of the Local
Coastal Program mapping regulations, and shall be applied in consultation with the State
Department of Fish and Wildlife. Slopes of 25% and greater possessing sensitive habitat shall be
preserved in the natural state unless the application of this policy would preclude a reasonable
use of the property. For slopes equal to or greater than 25% gradient, which do not include
sensitive habitat, encroachment may be allowed pursuant to Section 21.203.40(A)(3) of the
Carlsbad Municipal Code. This section of the code requires that a soils investigation be
conducted by a licensed soils engineer who must determine that the subject slope area is stable
and grading and development impacts mitigatable for at least 75 years, or the life of the
structure.
2. The subject property is located in the Coastal Shoreline Development Overlay Zone (Chapter
21.204 of the Carlsbad Municipal Code) and must comply with Section 21.204.050(B), which
states all new development shall be subject to a "stringline" development line based on the
location of adjacent structures immediately to the north and south of the subject property.
Please show the "stringlines" for all like structures on the adjacent properties to the north and
south.
Landscape:
Numbers below are referenced on the red line plans where appropriate for ease in locating the area of
the comment concern.
1. The Landscape Manual indicates that plans shall be prepared by a licensed landscape architect,
licensed civil engineer, licensed architect, or other qualified professional licensed by the state to
do this work. Please provide a valid license stamp on the landscape plan.
2. Please add the street name.
3. Please add a bar scale to the plan.
4. Please show the existing and proposed contours on the landscape plans.
5. Please indicate positive surface drainage (2% grade in planting areas) away from structures and
terminating in an approved drainage system. This may be provided in a note on the plans.

caliper diameter shall be identified on the plan individually as to caliper size and type and
labeled to be retained or removed.
11. Please provide a maintenance responsibilities exhibit. This may be covered with a note on the
planting plan (i.e. property owner shall be responsible for the maintenance of all landscape
areas shown on the plans).
12. The Landscape Manual indicates that the landscape shall feature ground cover, shrubs, and
trees to screen elements of unsightliness and screen/soften new improvements. The Landscape
Manual also indicates that landscaping shall be used to accentuate and enhance architecture.
Please provide landscaping to include tall trees along the north and south elevations in order to
meet these requirements.
13. 50% of the shrubs (except on slopes 3:1 or steeper) shall be a minimum 5 gallon size. Please
provide forthis requirement on the plans.
14. RETURN REDLINES and provide 2 copies of all plans for the next submittal. Please provide a
written response to all comments clearly indicating where and how each comment was
addressed.

ISSUES OF CONCERN
Planning:
1. Please correct the measurement for the front yard setback width (± 86.5'). The side yard would
then be ± 8.6' or 10% of the front yard width. The rear yard would be twice the amount of the
side yard setback, or ± 17.2'.
2. The project is exempt from a Hillside Development Permit pursuant to Section 21.95.040(A)(1)
of the Carlsbad Municipal Code. However, the project is still required to be consistent with the
Hillside Development Regulations and Hillside Development and Design Guidelines. Please plot
the .7/1 top of slope setback per Section 21.95.120(1) ofthe Carlsbad Municipal Code.
3. Please correct the scale of the site plan on sheet one.
4. Pursuant to section 21.95.120 of the Carlsbad Municipal Code, natural slopes which have all of
the following characteristics shall be undevelopable:
a) A gradient of greater than forty percent; and
b) An elevation differential of greater than fifteen feet; and
c) A minimum area often thousand square feet; and
d) The slope comprises a prominent land form feature.
5. The subject property has a slope in the rear yard with all of the above listed characteristics.
Therefore any portion of the slope in the rear yard with a slope of greater than forty percent is
undevelopable. Please remove the crib walls from the slope.
6. Please correct the maximum building height line on the proposed site section on sheet one. The
maximum height for a building with a roof pitch of less than 3:12 is 24 feet, not 30 feet.
Engineering:
1. Exhibit "A" includes a reference to Resolution recorded January 7, 1970. Please provide a copy
of this resolution and demonstrate that the property boundary shown on the site plan reflects
the action of this resolution.
2. Schedule B of the title policy lists Items 2, 3, 4, 5 and 6 exceptions for public and private utility
and access easements. Please show and identify these easements on the site plan. Item 6 is
listed as having no location given in the document.
3. Amend the site plan to reflect City of Carlsbad Resolution No. 45 recorded as Doc. No. 62929 on
May 7, 1953 in Book 4848 Page 226 of Official Records of San Diego County which accepted
Buena Vista Circle for public use.
4. City records indicate that the sidewalk easement was vacated per Doc # 110930 recorded July 7,
1966. However, the city has no copy ofthe document. Please provide a copy of this document
to verify and add this information to the site plan.
