RE: RESPONSE TO YOUR LETTER DATED OCTOBER 25, 1996
REGARDING TEMPORARY USE OF MODULAR BUILDING
Dear Mr. Schulberg:
We are in receipt of your letter dated October 25, 1996 regarding the request by the Batiquitos
Lagoon Foundation (BLF) to house a temporary modular building at Batiquitos Lagoon. In
accordance with City of Carlsbad, Community Development Department, Policies and Procedures
Number 7 regarding interpretation of Carlsbad Municipal Code Sections 21.42.010(8), 21.53.090,
and 21.53.110, this request is approved subject to the following conditions:
1. The requested temporary modular building shall be approved for a period of time
not to exceed six (6) months from the date of installation.
2. Prior to installation of the modular building, BLF shall secure all necessary City,
State, and Federal agency permits and approvals.
3. Prior to installation of the modular building, BLF shall submit a completed
application for a City of Carlsbad Conditional Use Permit for use of the modular
building beyond the approved six (6) month period as addressed in Number 1
above.
4. Prior to installation of the modular building, BLF shall submit to the City written
approval from the underlying property owner(s) upon which the modular building
is to be located.
5. The site plan submitted with the October 25, 1996 letter shall be modified to delete
the proposed parking near the modular building location.
6. BLF shall coordinate all required location and installation details, utility and access
requirements, and other issues as may be required to enable installation and
continued occupation of the modular building. External portable toilet facilities

and/or temporary internal sewage storage facilities or equipment shall not be
permitted.
7. The modular building shall be equipped with a minimum of two (2) external lights
(one in the front and one in the rear of the building) for night security lighting.
The external lighting shall be in operation each day from dusk to dawn.
8. The modular building shall be equipped with a commercial security system with
security response in the event of unauthorized activation of the system.
9. The modular building shall meet all applicable safety and building codes for
commercial installations.
10. Upon expiration of the approval for the modular building, BLF shall, within thirty
(30) days, remove, or cause to be removed, the modular building and all facilities,
utilities, kiosks, access structures, decks, signage, and all other improvements
associated with this temporary use.
11. Within thirty (30) days of the above date, BLF shall secure a letter from the
California Department of Fish and Game (CDFG) outlining any comments,
suggestions, concerns, or other input regarding the BLF's use of the modular
building at Batiquitos Lagoon. BLF shall forward a copy of said letter to the
City's Planning Department.
Please direct all questions and submit all materials required by this letter of approval to Mr. Mike
Grim at the Carlsbad Planning Department.
