Dear Bob:
Since Friday was his last day in Carlsbad for a few months, Mike Shirey
requested that I provide you with a written summary of the ongoing efforts to
achieve permitting clearances from the USF&WS for the habitat
encroachment at the rear of Village '£'. As you know, an area of sage scrub
habitat was removed in this area for soils remediation, without the benefit of
proper Agency permits. It has been determined by the City that building and
other Village 'E' permits could continue as long as evidence of USF&WS
permit processing was proceeding, but that the "construction change" for the
remedial grading at the encroachment could not be approved by the City until
the Agency permits are completed.
I have been keeping Christer Westman verbally informed on the process of
clearing up the matter with USF&WS, and here is a short written status
report.
Shea Homes has hired Planning Systems to prepare and process the necessary
permits. Planning Systems has conducted field checks of the site, and
determined the exact acreage of encroachment (1.40 ac.), and the biological
quality of the taken habitat (variable, but mostly good). We have identified a
mitigation program, including primarily habitat revegetation at a 2:1 ratio.
Planning Systems believes this program will be supportable by USF&WS.
We are in preparation of the necessary Section 10(A) permit package which is
very involved and technical, but which should be complete for submittal by
the end of June. At this time, we will apply to USF&WS for a Section 10(A)
permit, which would be expected to take about six (6) months of review and
approval. We will provide Christer with a copy of this submittal.
