Kelly Ranch - Village 'E'
Dear Mr. Holzmiller:
Please accept with this letter a signed application for Coastal Permit Amendment to allow a one-time extension
to the grading season for Kelly Ranch - Village 'E'. This extension would allow Shea Homes to grade the site
until December 15, 1998, to complete the grading operation necessary for the project, in order that the project
proceed along with Cannon Road construction, and that it not be delayed until next summer. Also with this
application, we are submitting Check No. 37537805 in the amount of $1,060.00 for the processing fee of the
Permit Amendment.
Planning Systems, our planning consultant, informs us that this appears to be the most applicable procedure for
allowing such a grading extension, although they note that City permit authority for this matter is relatively
new. This amendment request directly parallels the procedures followed by the Coastal Commission for
similar grading extensions for projects within its jurisdiction.
You should be aware that the Village 'E' approval documents do not actually include any prohibition to winter
grading. In addition, the existing Kelly Ranch Master Plan allows administrative approval of winter grading
upon City Staff concurrence that the erosion control is adequate. The Mello II LCP does indicate a winter
grading prohibition; however, this is the exact same prohibition that the Coastal Commission has routinely
allowed amendments.
As you can imagine, time is of the essence in this matter. Please proceed with the processing of this request as
soon as possible so our grading operation will not be shut down. We would be pleased to provide any
additional information that you may need.
