RIGHT OF WAY ENCROACHMENT
Dear Chris,
I have been asked by Principal Civil Engineer, Bob Wojcik, to respond to your telephone
message yesterday to Associate Engineer, Clyde Wickham, regarding the "Stop Work
Order" (Red Tag) for landscaping which is being installed along Palomar Airport Road
(PAR), directly east of Paseo Del Norte (PDN). Both Bob and Clyde are out of the office
today, so Bob has asked me to respond so as not to impact any schedule that you may
have for your landscaping project. Therefore, to help keep your project moving forward,
the following must be done:

The red tag is still in effect for any work being done within the existing right of
way. Do not do any more work within the existing right of way.
The red tag is still in effect for any work being done within the future right of
way. However, if you submit a letter to the Public Works Director stating that
you will remove any landscaping and irrigation within the existing and future
right of way, at the direction of the City and at your expense, then this portion
of the red tag will be lifted.
You will be permitted to continue on-site work now that does not impact
existing or future right of way. Any landscaping and sign placement that does
not encroach into the ultimate right of way or block sight distance sight lines
can be completed.
In accordance with CDP 97-49, Planning Director Approval, dated February 10,
1998, Engineering Condition of Approval No.'s 65 and 66, immediately begin
processing the right of way dedication along PAR and the PDN and Armada
Drive curb returns. Currently, the existing project is not in compliance with the
Conditions of Approval for the previous project's (2000sf retail building) Coastal
Development Permit. (Application attached.)
Apply for and concurrently process an Encroachment Permit for the work being
done in the existing and future right of way. (Application attached.)

As was discussed with Mr. Mike Cardosa from your ofice, staff will work with you on
these issues. However, there must be cooperation between both parties. It is not the
City’s intent to have you incur greater costs with your landscaping project, and as such,
that is one reason why the project was red tagged. The City does not wish to see a
property owner install improvements that will eventually have to be removed to facilitate
future public improvements. The City fully intends to eventually widen PAR east of PDN
to lessen traffic impacts at the PAWPDN intersection. Installing your landscaping out of
this future widening area now will save you time and costs in the future.
Again, I was asked to forward this correspondence to you today, so that you can
immediately make decisions concerning your project so as not to cause you further
delays. If you have questions, please contact Bob Wojcik at 438-1 161, extension 4333,
