NOTICE OF DECISION

SUBJECT: CDP 97-49 - FLOWER FIELDS RETAIL SALES BUILDING
The City has completed a review of the application for a Minor Coastal Development
Permit for development located at the northeast corner of Palomar Airport Road and
Paseo Del Norte (5702 Paseo Del Norte).
It is the Planning Director’s determination that the project Minor Coastal Development
Permit, CDP No. 97-49, is consistent with the City’s applicable Coastal Development
Regulations (Chapters 21.201 - 21.205) and with all other applicable City ordinances
and policies. The Planning Director, therefore, APPROVES this request based upon
the following:

That the total cost of the proposed development is less than $60,000.
That the proposed development requires no discretionary approvals other than a
Minor Coastal Development Permit.
That the development has no adverse effect individually or cumulatively on coastal
resources or public access to the shoreline or the coast, in that the project site is
located a considerable distance to the east of the first public road paralleling the
coast and the visitor serving use of the building will further promote public access to
a coastal agriculture use.
That the proposed development is in conformance with the Certified Local Coastal
Program and all applicable policies in that proposed use is permitted by the
Carlsbad Ranch Specific Plan which services as partial mitigation for the Mello II
Segment of the Local Coastal Program.

5. That the development is in conformity with the public access and public recreation
policies of Chapter 3 of the Coastal Act, in that it does not interfere with any required
public accessways.
6. That a request for a minor coastal development permit was adequately noticed at
least fifteen (15) working days before the date of this decision pursuant to Section
21.201.080(B) and (C) of the Carlsbad Coastal Development Regulations.
Conditions:
Planning:
1. The Planning Director does hereby APPROVE the Minor Coastal Development
Permit, CDP 97-49 for the 2,000 square foot retail sales building addition project
entitled “Flower Fields Retail Sales Building”. (Exhibit(s) “A” through “D”, dated
February 3, 1998, on file in the Planning Department and incorporated by this
reference, subject to the conditions herein set forth. Staff is authorized and directed
to make, or require the Developer to make, all corrections and modifications to the
Minor Coastal Development Permit documents, as necessary to make then
internally consistent and in conformity with the final action on the project.
Development shall occur substantially as shown on the approved Exhibits. Any
proposed development substantially different from this approval, shall require an
amendment to this approval.
2. Building permits shall be issued for this project within two (2) years of approval or
this coastal development permit will expire unless extended per Section 21.201.210
of the Zoning Ordinance.
3. All structures noted as “to be removed” on the project exhibits must be removed
prior to the granting of an occupancy permit for the new structure.
4. Required landscaping identified on the project exhibits must be installed prior to the
granting of an occupancy permit for the new structure.
Engineering:
NOTE: Unless specifically stated in the condition, all of the following conditions, upon the
approval of this Coastal Development Permit, must be met prior to issuance of any
building permit.
General:
46. Prior to hauling dirt or construction materials to or from any proposed construction

site within this project, the developer shall submit to and receive approval from the
City Engineer for the proposed haul route. The developer shall comply with all
conditions and requirements the City Engineer may impose with regards to the
hauling operation.
Fees/Aareements:
50. The developer shall pay all current fees and deposits required.
Dedica tions/lmrprovemen ts:
70. The developer shall comply with the City’s requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide best
management practices as referenced in the “California Storm Water Best
Management Practices Handbook” to reduce surface pollutants to an acceptable
level prior to discharge to sensitive areas. Plans for such improvements shall be
approved to the satisfaction of, and by the City Engineer, in accordance with
the following:
A. Surface runoff shall be directed to a vegetated swale before
draining into existing catch basin(s). Fossil type filters, if not
already installed, shall be installed at storm drain inlets/inverts, as
indicated on sheet 2 of 4 of the Coastal Development Permit site
plan.
65. Prior to issuance of occupancy, Curb return right of way radii shall be
dedicated by the owner at the Palomar Airport RoadlPaseo Del Norte northeast
corner and Palomar Airport Road/Armada Drive northwest corner, along the
project frontage, based on a right-of-way radius of 25 feet and in conformance with
City of Carlsbad Standards.
65. Prior.to issuance of occupancy, a 12’ dedication shall be irrevocably offered by
the owner, along the project frontage, along Palomar Airport Road, from Paseo
Del Norte to Armada Drive, in conformance with City of Carlsbad Standards.
Code Reminder:
The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:

35. The developer shall exercise special care during the construction phase of this
project to prevent off-site siltation. Planting and erosion control shall be provided in
accordance with the Carlsbad Municipal Code and the City Engineer.
