Stuart Fisk of Hofman Planning Associates has notified me that you requested that the City of Carlsbad
provide additional information for the Kelly Corporate Center’s proposed impact to habitat adjacent to
Palomar Airport Road. Policy 3-7 of the Mello II Land Use Plan provides for impacts associated with
the expansion of existing circulation element roads and the associated installation of utilities provided
there is no feasible less environmentally damaging alternative. The area of impact is the result of the
construction of an east bound right turn lane on Palomar Airport Road, a prime arterial in the Circulation
Element, at the intersection of Hidden Valley Road as well as Aviara Parkway. At both locations
Palomar Airport Road is constructed with three existing lanes on both sides in addition to left turn lane
pockets. The Traffic Analysis prepared for the project identified the need for the right turn lanes to
maintain the roadway capacity on Palomar Airport Road. As a result of the roads existing location there
is no feasible less environmentally damaging alternative for the location and construction of the right
turn lanes.
Also contributing to the impact is the creation of a detention basin. The basin is necessary to collect
offsite runoff entering the site as well as runoff from the project and containing it so as not to exceed the rate associated with the property prior to development. The Mitigated Negative Declaration for the
project was sent directly to the California Department of Fish and Game, the U.S. Fish and Wildlife
Service, and the San Diego Office of the California Coastal Commission during the public review period.
As specified in Policy 3-7 and 3-8 appropriate mitigation ratios and buffer zones are to be determined in
consultation .with the California Department of Fish and Game and the U.S. Fish and Wildlife Service.
Comments were received from the wildlife agencies which caused revisions to the originally proposed
mitigation ratio and buffer zone resulting in the required mitigation measures and project design
approved by the City of Carlsbad.
