The subject property is located at the southeast corner of Poinsettia Lane and Ambrosia Lane, also known as Aviara Planning Area 18, and is legally described as Lots 1 and 2 of Carlsbad Tract No. CT 92-3, Phase III, Unit 1, according to Map No. 13434, filed in the Office of the County Clerk on June 23, 1997, City of Carlsbad, County of San Diego. The Jefferson at Aviara project site is zoned Planned Community (P-C) and is therefore subject to the provisions of the Aviara Master Plan (MP 177). According to the master plan, the allowed land uses for Planning Area 18 are multifamily residential uses, with associated recreational uses and parking. The development standards of the Residential Density Multiple (RD-M) zone, except as modified by the master plan. As stated in the approving resolutions and staff reports, the proposed 288 unit apartment proposal is consistent with all applicable regulations of the P-C and RD-M zones, as well as being consistent with the provisions of the Aviara Master Plan. The project is permitted on the site, subject to the terms and conditions of Site Development Plan No. SDP 98-10 and Coastal Development Permit No. CDP 98-43, as approved by the City Council on December 8, 1998.
