HomeMy WebLinkAboutCDP 98-71; Beliveau Residence; Coastal Development Permit (CDP) (3)MEMORANDUM October 22, 1998 TO: Senior Planner Brian Hunter FROM: Associate Engineer Steven Jantz VIA: Principal Engineer Land Use Review - Bob Wojcik CDP 98-71 BELIVEAU RESIDENCE CONDITIONS TRANSMITTAL The Engineering Department has completed its review of the subject project and is recommending that the project be approved subject to the following conditions: Fees/Agreements 14. The developer shall pay all current fees and deposits required. 18. The owner shall enter into a lien contract with the City for the future public improvement of Skyline Drive along the subdivision frontage for a half street width of 30 feet. Public improvements shall include but not be limited to paving, base, sidewalks, curbs and gutters, medians, grading, clearing and grubbing, undergrounding or relocation of utilities, sewer, water, fire hydrants, street lights and retaining walls. 19. The owner of the subject property shall execute an agreement holding the City harmless regarding drainage across the adjacent property. Grading 21. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. Code Reminder 35. The developer shall exercise special care during the construction phase of this project to prevent offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. 37. The project is approved under the express condition the developer pay the additional public facilities fee in accordance with City Council Resolution No. 9169 adopted July 28, 1987 and as amended from time to time. The developer further agrees to pay any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code. The developer's written agreement to pay said fees is on file with the office of the City Clerk and is incorporated herein by this reference. If the fees are not paid, this application will not be consistent with the General Plan and approval for this project shall be void. 46. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 47. Rain gutters must be provided to convey roof drainage to an approved drainage course or street to the satisfaction of the City Engineer. 56. Prior to approval of any grading or building permits for this project, the owner shall give written consent to the annexation of the area shown within the boundaries of the subdivision plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided by the City. 58. Based upon a review of the proposed grading and the grading quantities shown on the site plan, a grading permit for this project is required. The developer must submit and receive approval for grading plans in accordance with city codes and standards prior to issuance of a building permit for the project.
