SUBJECT: PUD 50(A) - PACKARD LANE PROJECT
The City has completed a review of the application for an amendment to the
Planned Unit Development located at 4007 Packard Lane, Carlsbad.
It is the Planning Director's determination that based on the attached findings and
conditions, the project is consistent with the City's planned development
regulations (Chapter 21.45) and with all other applicable City Ordinances and
Policies. Further, the project has been found to be categorically exempt from
environmental review according to Section 15301(k} of the California
Environmental Quality Act and a Notice of Exemptions will be filed.
This memo, including the listed findings and conditions, constitutes approval of
PUD 50(A).
Findings:
1. The project is consistent with the City's General Plan Land Use Element, and
with all other elements of the City's General Plan.
2. Adequate public facilities necessary to serve this project are provided as required
by the City Engineer in conjunction with the approval of the parcel map recorded
for this project.
3. The project is consistent with the design criteria and development standards of
Chapter 21.45 (Planned Development Ordinance) of the City's Zoning Code.
Conditions:
1. Staff is authorized and directed to make, or require the Developer to make, all
corrections and modifications to the planned development documents, as
necessary to make them internally consistent and in conformity with the final

2. Approval is granted for PUD 50(A), as shown on Exhibit(s) "A" - "C", dated
June 16, 1999, on file in the Planning Department and incorporated herein by
reference.
3. Approval of PUD 50(A) is granted subject to the approval of CDP 99-20. PUD
50(A) is subject to all conditions contained in CDP 99-20 for the Coastal
Development Permit.
4. Unless otherwise stated herein, this planned development project shall comply
with all applicable City Ordinances and requirements.
5. Prior to the issuance of building permits, or prior to the approval of a final map
and/or issuance of certificate of compliance for the conversion of existing
apartments to air-space condominiums, the Developer shall pay to the City an
inclusionary housing impact fee as an individual fee on a per market rate
dwelling unit basis.

I. PROJECT DESCRIPTION
The subject property consists of a roughly rectangular .79
acre parcel with frontage on Monroe Street and Sunnyhill
Drive. A large single family home is located on the north
half of the subject property, while the south portion of the
property is vacant except for an existing swirtiming pool.
Most of the surrounding property has been developed with
single family homes on large lots.
II. ANALYSIS
Planning Issues
1. Can the necessary findings required by the Zoning
Ordinance be made, specifically that the property
cannot be adequately served by a public street
without panhandle lots due to unfavorable conditions
and that approval of panhandle lots will not
preclude the ability to provide full public street
access to other properties in the same block?
2. Do the proposed panhandle lots conform with the
zoning requirements of the R-1-15,000 zone in which
they are located?
Discussion
As shown on Exhibit "A", the applicant proposes to subdivide
a .79 acre parcel into two lots, one of which would be a
panhandle lot. The resulting panhandle lot will have an
area of 19,078 square feet while the other lot which has
186 feet of frontage on Monroe Street and Sunnyhill Drive
will have an area of 15,700 square feet. As proposed the
project meets all of the requirements of the R-1-15,000
zone relating to panhandle lots. Specifically, the project
meets the minimum buildable area, the minimum panhandle width
requirements, and does not exceed the maximum allowable length
for a panhandle.
However, before the Planning Commission can approve a panhandle
lot, the following findings must be made:
1) The property cannot be served adequately with a public
street without panhandle lots due to unfavorable
conditions resulting from unusual topography, surrounding
land development, or lot configuration.
2) Subdivision with panhandle lots will not preclude or
adversely affect the ability to provide full public
street access to other properties within the same
block of the subject property.
Staff feels that the Planning Commission can make the first
finding that this property cannot be adequately served by
a public street due to unfavorable lot configuration. Due
to the configuration of the intersection of Alder Avenue,
Sunnyhill Drive and Monroe Street, as well as the existing
development, the city has previously determined that it
would be undesirable to extend Alder Avenue. This extension
would have gone through the northern part of the applicant's
property and the southern part of his neighbor's property.
However, this extension would have created a dangerous
intersection with a blind corner. The unusual configuration
of the panhandle serving the rear lot will allow a driveway
to be constructed far enough away from the intersection to
allow safe entry and exit.
Secondly, the creation of this panhandle lot will not preclude
or adversely affect the ability to provide full public
street access to other properties within the same block.
The other parcels surrounding the subject property all have
frontage on existing public streets.
III. RECOMMENDATION
Staff recommends that the Planning Commission adopt
Resolution No. 1715, recommending APPROVAL of MS-491,
based on the findings and subject to the conditions contained
therein.

Our district has reviewed the proposed parcel split as
defined in Exhibit A and has evaluated the impact of the
development on the facilities of the distric^t.
The governing board wishes to advise the city officials and
the residents of Carlsbad that as residential units are added
to the community, it is likely that many classes in the district
will be crowded, resulting in possible impairment to the
educational and transportational services offered to the students.
It is also likely that school schedules may have to be changed,
resulting in an increase in the year-round program, or double-
sessions, or both. However, the district is able to assure you
that school physical facilities will be available concurrent
with need for this development as it is presently proposed.

INTERDEPARTMENTAL MEMORANDUM
DATE: January 11, 1983

FROM: Land Use Planning Office
SUBJECT: PUD-50/MS-597
The City has completed a review of the application for a four lot
planned unit development located at the end of Alder Avenue in
the R-1--15,000 zone.
It is the Land Use Planning Manager's determination that based on
attached conditions, the project is consistent with the City's
Planned Development Ordinance (Chapter 21.45) and with all other
applicable City ordinances and policies. Further, the project
has been found to be categorically exempt from environmental
review according to Section 19.04.070 of the Carlsbad
Environmental Ordinance and a Notice of Exemption was filed on
January 11, 1983.
This memo, including the listed findings and conditions, con-
stitutes approval of PUD-50.
Findings
1. The project is consistent with the City's General Plan Land
Use Element, and with all other elements of the City's
General Plan.
2. Adequate public facilities necessary to serve this project
will be provided as required by the City Engineer in con-
junction with the approval of the parcel map required for
this project.
3. The project is consistent with the design criteria and de-
velopment standards of Chapter 21.45 (Planned Development
Ordinance) of the City's Zoning Code.
Conditions
1. Approval is granted for PUD-50 as shown on Exhibits "A" -
"D", dated January 10, 1983, on file in the Land Use
Planning Office and incorporated herein by reference.
2. A copy of the final Planned Unit Development site plan,
incorporating all conditions of approval, shall be submitted
to and approved by the Land Use Planning Manager prior to
final map approval of PUD-50.
3. All conditions of MS-597 are incorporated herein by
reference and shall be complied with in their entirety.
Any significant modifications to the approved Planned Unit
Development site plan required by said conditions shall be
approved by the Land Use Planning Manager prior to final
approval of MS-597.
4. Unless otherwise stated herein, this Planned Unit
Development project shall comply with all applicable city
ordinances and requirements.
5. All lots shall be developed per the standards of the R-1-
15,000 zone.
6. Parcel 4 shall be jointly maintained by Parcels 2 and 3.
