Dear Mr. Holzmiller;
The purpose of this letter is to bring to the attention of the planning departrru
my request to build a basement stairway in my home which was approved under C(
99-32.
My home is currently under construction. While under construction, the archi
has recommended and my wife and I have agreed, that the house would be vastly
improved and the house and neighborhood made safer, by the addition of basemer
stairs to be built from the basement, up to the first floor elevation.
Acting upon our architect's recommendation and our desire, we asked our
architect to design and submit plans for the basement stairway to the city. These pi
are about to be returned and approved by the building department.
During the process of having the building department approve of the stairwa;
had a discussion with Mike Grim, the planner for the project, to insure that the stain
was consistent with planning department guidelines. Mr. Grim suggested that I writ
letter and request a review of the stairway to insure that their was a record of my
request and a planners review of the stairway.
Enclosed please find an attachment showing the stairway. The exact plans a
specifications for the stairway have already been submitted. The stairway is intend*
allow for additional emergency egress to and from the basement for any occupants
the home, and for any emergency firemen or crews that may need to use the stairw
In addition, please note, that the stairway is on the west side of the home, cannot b
seen from the street, and does not involve any height or set back issues. In additio
the exterior elevations of the home are not being changed in order to accommodate

stairway and no additional costs are required as it is estimated that the elimination
flat work and wall areas in the basement is the same as the cost of the stairway.

stairway as soon as possible.

PCR 02-99 - REVISIONS TO BUILDING PLANS FOR CDP 99-32
The Planning Department has reviewed the plans submitted for the proposed addition of a
stairway to access the basement of your home at 5319 Carlsbad Boulevard (PCR 02-99).
Judging by the submitted building permit plans and the approved Coastal Development Permit
exhibits, it appears that the creation of the basement access stairway causes that portion of the
building to exceed the 30 foot high maximum allowed in the One Family Residential (R-1) zone.
All building heights must be measured from the grade directly under the roof. Since the
stairway access exits the building envelope at the floor elevation of the basement, it appears
from the available cross-sections that this causes the building to be over height. Should you
desire to proceed with the proposed stairway, revised cross-sections and building elevations are
necessary to show how the project revision still complies with the applicable building height
standards.
You should also be aware that, based upon consultation with the Building Department, your
previous plan indicating a light well with access ladder met all applicable fire codes and exiting
requirements and no "additional emergency egress to and from the basement" is required by
code. It should also be noted that the proposed plancheck revision (PCR 02-99) includes the
addition of a bedroom in the basement and the proposed stairway would provide direct access
to the bedroom from the exterior of the building. This arrangement was not reviewed by the
original Coastal Development Permit (CDP 99-32) or its amendment (CDP 99-32(A)), and,
therefore, should be included in your request for permit consistency of the proposed revisions.
Thank you for your consistency request. Upon submittal of the necessary cross-sections and
building elevations, Planning Department staff will be able to make a determination on your

SUBJECT: CDP 99-32(A) - JENSEN RESIDENCE EXPANSION
Dear Bill:
Thank you for the request for additional information for the Jensen Residence
Expansion CDP Amendment. Please find enclosed a copy of your notice, the
project staff report and resolution, and the project exhibits. Put simply, the
project involves the complete habitable use of the basement, rather than only
partial use of the basement. No expansion or revision of the previously approved
building footprint or site grading is proposed with this CDP amendment.
As you know, the Jensen residence is currently under construction as allowed by
CDP 99-32. The exhibits for that CDP showed only 1,608 square feet of the
basement being used as habitable floor area; the remaining 851 square feet was
non-habitable storage area. The applicant chose to revise this plan, making the
entire basement habitable floor area. While this revision did not alter the building
exterior or site grading, the expansion of floor area was deemed to be
intensification and, therefore, an amendment to the approved CDP was required.
Due to the fact that no additional grading was proposed, no additional soils
analysis was required.

At the Planning Commission meeting of June 20, 2001, your application was considered. The
Commission voted 5-0 (Compas/L'Heureux Absent) to APPROVE your request. The decision of the
Planning Commission became final on June 20, 2001.
The time within which judicial review of this decision must be sought is governed by Code of Civil
Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad
Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate
court not later than the ninetieth day following the date which this decision becomes final; however, if
within ten days after the decision becomes final a request for the record of the proceedings accompanied
by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record,
the time within which such petition may be filed in court is extended to not later than the thirtieth day
following the date on which the record is either personally delivered or mailed to the party, or his attorney
of record, if he has one. A written request for the preparation of the record of the proceedings shall be
filed with the Planning Director, Michael J. Holzmiller, Secretary of the Planning Commission, 1635

Development Coordinating Committee (DCC) meeting which will be held on June
11, 2001. A twenty (20) minute appointment has been set aside for you at 11:00.

RE: PLAN FOR USE OF REMAINDER OF BASEMENT
Dear Mr. Grim:
On April 13, 2001, and pursuant to the city's request, I filed a CDP application for
the use of the balance of the basement area in my home designating it as a habitable area.
As you are aware, this application only deals with in filling the basement area which has
already been approved on a prior CDP. In addition, and prior to the filing, I have also
provided the city with four sets of blue line prints. Each set contains one sheet that shows
a floor plan of the basement that was previously approved which showed both habitable
and unhabitable space designated and one sheet that shows a new floor plan of the
requested in fill area of the basement making the entire basement area that was previously
approved substantially all habitable. Please note that the new habitable area floor plan
inside the basement that was previously approved will add approximately 851 square feet
to the habitable area of the basement.
Since this request merely deals with in filling the basement area of the home that
has been previously approved and does not change any item above ground or outside the
designated basement area which was previously approved, no other items were submitted
with the latest requested CDP. In addition, the prior CDP and building permitted plans
arising out of such CDP which were previously approved by the building, planning, and
engineering departments for the house presently have two stamped plans from the building
department. One plan is located in the building department and the other is required to be
kept on the job site during construction. Therefore, and if the city requires further exhibits
in the form of the approved permitted building plans, copies will either need to be made
from the present city files, or a bonded blueprint company will need to be retained by me
for the purpose of making sure that only the approved building set is used as exhibits. In
this regard, please fax me and inform me if the present sets are sufficient for the
processing of the application, or if you would like me to provide further exhibits.

Dear Mr. Grim:
As you are aware, I recently processed a CDP for my home located at 5319
Carlsbad Boulevard, Carlsbad, California. At the time of the hearing and approval of
the CDP for my home, I informed the planning commission that if economics allowed, I
wanted to build out the basement area and use all the basement footprint. In addition,
and although the entire basement footprint was shown on the plans and approved,
some of the basement area within the footprint was not shown as usable floor plan area
at that time.
Following the approval, I decided to build out the basement and use all of the
basement footprint that was originally shown to the planning commission as basement
area and specifically I wanted to show a floor plan for the entire basement footprint. In
addition, the structural engineer also recommended that if I ever wanted to utilize the
entire basement footprint, that I should at least develop a plan now so that any future
build out of the footprint area was consistent with the structural engineering for the
house.
Proceeding on this advise, a floor plan for the entire basement was drawn up
and submitted to the building department for their approval. Following the review of the
plan by the building department, the full basement floor plan was approved. After the
approval, the plans were then sent back to planning, where it was noted that although
the entire footprint was approved by the planning commission, the square footage was
different than the approved square footage, because among other things, the entire
basement footprint square footage was not shown on the front page of the house plans.
At that time I was asked to change the plans back to the partial build out of the
basement so that a permit could be issued that was consistent with the square footage
shown on the front page of the house plans. In addition, and at that time we also had
discussions as to how to best show the entire basement footprint square footage.

During those discussions, however, we never considered that since the entire
footprint was already approved, that only the square footage needs to be corrected as
a ministerial act on the approvals. However, and if this is not possible, then the
quickest and easiest way to adjust the square footage would seem to process the
adjusted footprint and floor plan as an administrative Coastal Development Permit.
Therefore, I would like to know how you would like to proceed with my proposed
adjustment to the basement footprint. Put another way, would the city like to adjust the
square footage of the old CDP ministerially, or would the city like an additional Coastal
Development Permit.
If the city would like to have me process an administrative Coastal Development
Permit, then I would like to add the basement floor plan adjustments to CDP 00- 54
which is an administrative CDP application for Debris removal. In this regard, both the
Debris removal and the additional floor plan adjustments together would not exceed the
monetary amount or threshold for a regular CDP, and both could still be processed
administratively. At any rate, please tell me what action I need to take regarding the
adjustment to the basement floor plan.
In order to assist you, please find both the floor plan that I have already pulled a
building permit for and for which I am under construction, and the floor plan which uses
the entire footprint for the basement. In this regard, and as soon as the adjusted floor
plan can be incorporated into my construction project, the better it would be for me and
for the contractors undertaking the work. Also, please note, that the adjusted floor plan
will not need any modifications to any portions or site plan for the house, since it is only
filling in area that was under the house and not even seen because it is a basement.
Also please find inclosed a copy of the report for the Debris removal for CDP 00-
54 which the staff requested. I would like to thank you for your continued cooperation
and would appreciate a response as soon as possible.
