SUBJECT: SDP 99-12/CDP 99-33 - DAKMIN CONDOS
At the Planning Commission meeting of March 15, 2000, your application was considered. The
Commission voted 7-0 to APPROVE (AS AMENDED) your request. The decision of the Planning
Commission became final on March 15, 2000.
The time within which judicial review of this decision must be sought is governed by Code of Civil
Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad
Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate
court not later than the ninetieth day following the date which this decision becomes final; however, if
within ten days after the decision becomes final a request for the record of the proceedings accompanied
by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record,
the time within which such petition may be filed in court is extended to not later than the thirtieth day
following the date on which the record is either personally delivered or mailed to the party, or his attorney
of record, if he has one. A written request for the preparation of the record of the proceedings shall be
filed with the Planning Director, Michael J. Holzmiller, Secretary of the Planning Commission, 1635
Faraday Avenue, Carlsbad, CA 92008.

SUBJECT: SDP 99-12/CDP 99-33 - DAKMIN CONDOS
Your application has been tentatively scheduled for a hearing by the Planning Commission on
March 15, 2000. However, for this to occur, you must submit the additional items listed below.
If the required items are not received by February 29, 2000, your project will be rescheduled for
a later hearing. In the event the scheduled hearing date is the last available date for the City to
comply with the Permit Streamlining Act, and the required items listed below have not been
submitted, the project will be scheduled for denial.
1. Please submit the following plans:
A) 10 copies of your (site plans, landscape plans, building elevation plans, floor
plans) on 24" x 36" sheets of paper, stapled in complete sets folded into 81/2' x
11" size.
B) One SVz" x 11" copy of your reduced site plan, building elevation and floor
plans. These copies must be of a quality which is photographically
reproducible. Only essential data should be included on plans.
2. As required by Section 65091 of the California Government Code, please submit the
following information needed for noticing and sign the enclosed form:
A) 600' Owners List - a typewritten list of names and addresses of all property
owners within a 600 foot radius of the subject property, including the applicant
and/or owner. The list shall include the San Diego County Assessor's parcel
number from the latest equalized assessment rolls.
B) 100' Occupant List - (Coastal Development Permits Only) a typewritten list of
names and addresses of all occupants within a 100 foot radius of the subject
property, including the applicant and/or owner.

PROPOSED MINOR SUBDIVISION NO. MS 99-11, DAKMIN MINOR SUBDIVISION
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad
Municipal Code, to approve the tentative parcel map of the proposed minor subdivision subject
to conditions that follow in this letter.
Unless specifically stated in the condition, all of the following conditions, upon 4he approval of
this tentative parcel map, must be met prior to approval of a final parcel map or certificate of
compliance.
1. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when such a
program is formerly established by the City.
2. Approval of MS 99-11 is granted subject to the approval of CP 99-12/CDP 99-
33/SDP 99-12. MS 99-11 is subject to all conditions of approval contained in CP 99-
12/CDP 99-33/SDP 99-12.
3. The developer shall provide the City with the approved tentative parcel map. The map
shall be to scale on a reproducible 24" x 36" xerox mylar or photo mylar. It shall reflect
the conditions of approval by the City. The reproducible shall be submitted to the City
Engineer, reviewed and signed by the City's project engineer and project planner prior to
submittal of the building plans, final map, improvement or grading plans, whichever
occurs first
4. The developer shall defend, indemnify and hold harmless the City and its agents, officers,
and employees from any claim, action or proceeding against the City or its agents,
officers, or employees to attack, set aside, void or null an approval of the City, the
Planning Commission or City Engineer which has been brought against the City within
the time period provided for by Section 66499.37 of the Subdivision Map Act.
5. The net developable acres shall be shown for each parcel.
6. The developer shall pay all current fees and deposits required.
7. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.

8. Prior to approval of any grading or building permits for this project, the owner shall give
written consent to the annexation of the area shown within the boundaries of the subdivision
into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form
provided by the City.
9. The owner shall make an offer of dedication to the City for all public streets and easements
required by these conditions or shown on the tentative parcel map. The offer shall be made
by a certificate on the final map or by separate document if a certificate of compliance is
filed for this project. All land so offered shall be granted to the City free and clear of all liens
and encumbrances and without cost to the City. Streets that are already public are not
required to be rededicated.
10. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, the developer shall submit to and receive approval from the City Engineer
for the proposed haul route. The developer shall comply with all conditions and
requirements the City Engineer may impose with regards to the hauling operation.
Parcel Map Notes
11.Unless a certificate of compliance is recorder in lieu of a parcel map, note(s) to the
following effect(s) shall be placed on the parcel map as non-mapping data:
1 la. Building permits will not be issued for development of the subject property unless
the District Engineer determines that sewer facilities are available.
Code Reminder
12.The tentative parcel map approval shall expire thirty-six (36) months from the date of the
letter containing the final decision for tentative parcel map approval.
13. The project is approved under the express condition the developer pay the additional public
facilities fee in accordance with City Council Resolution No. 9169 adopted July 28, 1987
and as amended from time to time. The developer further agrees to pay any development
fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal
Code. The developer's written agreement to pay said fees is on file with the office of the City
Clerk and is incorporated herein by this reference. If the fees are not paid, this application
will not be consistent with the General Plan and approval for this project shall be void.
The developer may request a review of the preliminary decision with the City Engineer in
writing within ten (10) days of the date of this letter. Upon such written request the City
Engineer shall arrange a time and place with the developer for such review.
The City Engineer has reviewed each of the exactions imposed on the developer contained in
these conditions of approval, and hereby finds, in this case, that the exactions are imposed to

mitigate impacts caused by or reasonably related to the project, and the extent and degree of the
exaction is in rough proportionality to the impact caused by the project.

RE: MS 99-11 DAKMIN MINOR SUBDIVISION
Dear Ms. Garfin:
The Engineering Department has completed its third review of the above referenced project for
compliance with the previously determined issues. The project still has issues which must be
addressed. The following is a list of these issues:
1. The tentative parcel map and site plan are inconsistent. The driveway for the guest space is
shown as "existing drive apron to remain" on the site plan. The same driveway is labeled as
"proposed driveway" on the tentative parcel map. Both plans should show the driveway as
"proposed driveway location". The driveway must be located such that the point of transition
from curb to driveway is 3 feet from an extension of the side property line. In addition, the
flare cannot be reduced in size as shown. The flare (curb height transition) must be 3 feet
wide per City Standard. These standards will require that the driveway approach be relocated
further east.
2. On the tentative parcel map:
a) indicate which existing structures/facilities will be removed. Structures which need to
be labeled accordingly include the existing house, the existing concrete paving at the
northwest corner of the property, and the existing driveway and approach located
nearest the intersection. Also specify that the driveway approach will be replaced with
curb. Specify any portion of the existing fence that will be removed as well.
b) change the width of the guest driveway space from 10 feet to the minimum required
width of 12 feet.
c) indicate the diameter of the existing sewer lateral.
3. On the site plan:
a) correct the bearings of the property lines orientated parallel to Juniper Ave. The
property line bearings currently read "N 35 27' 00" E". The bearings for the same
property lines shown on the tentative parcel map read "N 55 28' 00" E".

b) Indicate the point at which the fence drops from 6 feet in height to 3.5 feet in height.
c) change the width of the guest driveway space from 10 feet to 12 feet.
d) specify that the "enhanced" concrete driveway will not encroach into the public right-of-
way. All concrete within the public right-of-way must be mixed and pored to City
standard.
4. On the tentative parcel map, two water meters are shown. Is one of these meters serving the
neighbor's property? Since two units are proposed, each unit needs its own meter. If the
meter in question is already being used by the neighbors, then an additional meter will be
needed. Where will it be placed?
5. Based on the spot elevations provided on the tentative parcel map, it appears that the
drainage patterns are flowing against the grade. The spot elevations shown at the east end of
the property suggests that surface drainage would flow northward and away from Juniper
Street. The drainage arrows, however, indicate that drainage is flowing in the opposite
direction towards Juniper Street. Please clarify this discrepancy. Also, the flow from the high
point (59.44 EL) at the north end of the property to the east and west is at less than the
required one percent grade. All drainage across pervious surfaces must be at a minimum
grade of 1%. Across concrete, the minimum grade permissible is 0.5%. Please indicate the
grades of the driveways and provide percent grades next to all drainage arrows. If grades
need to be altered to obtain drainage, then illustrate such alterations with existing and
proposed spot elevations and contour lines. Also, General Note #10 would need to be
replaced with grading quantities.
Please submit two (2) sets of corrected plans to my attention in the Engineering Department.
Since the project planner, Greg Fisher, has not completed his review of the latest set of plans, I
suggest that you wait for his comments before making your revisions and submittal. If you or the
applicant have any questions regarding the above, please either see or call me at extension 4324.

Dear Ms. Garfin:
Recently, the noticing period for the aforementioned project ended. The City received a
large amount of returned notices due to incorrect addressees. Our records indicate that
several of these notices were sent to the site address rather than the property owner's
mailing address. Enclosed is a computer generated list of the returned notices. The list
includes the City's latest ownership information as provided by the County Assessors
Office. It is your responsibility to check with the Assessors Office to ensure that this list
is current.

Please provide a new set of labels for these properties giving the correct owner's mailing
address so that we may complete the noticing as required per the City Ordinance. Send
the new set of address labels along with payment for the cost of mailing said labels
(current postage rate of thirty three cents times the number of address labels) to my
attention in the Engineering Department.

COMPLETE APPLICATION & INITIAL ISSUES REVIEW
Thank you for applying for Land Use Permits within the City of Carlsbad. Engineering Department staff
has reviewed the tentative parcel map, application No. MS 99-11, as to its completeness for processing.
The application is complete, as submitted. Although the initial processing of the application may have
already begun, the official acceptance date of the application is the date of this letter. Staff may, in the
course of processing the application, request that you clarify, amplify, correct, or otherwise supplement the
basic information required for the application. In addition, design issues exist which must be resolved or
adequately addressed prior to staff making a determination to approve or deny the project. These issues
of concern are as follows:
ENGINEERING ISSUES:
1. The tentative parcel map does not show the proposed development and lot split. Only one lot is
shown with its existing conditions. Please show the proposed development and make the plan
consistent with the plans (SDP 99-12/CP 99-12/CDP 99-33) submitted earlier to the City.
Incorporate the revisions requested in earlier correspondence for SDP 99-12, CP 99-12, and CDP
99-33.
2. On the tentative parcel map:
a) show bearings of property lines;
b) add Minor Subdivision No. 99-11 in the upper right hand corner;
c) correct the sewer district to "Carlsbad Municipal Water District;
d) add average dgily traffic generated by the project;
e) indicate size of proposed dwellings and amount of lot coverage;
f) add grading quantities and show grading. Fine grading for pad drainage can be illustrated
with existing and proposed spot elevations. If no grading is proposed outside of the
building foundation, then state "no grading proposed outside of building envelope".
3. Add the following note on the tentative parcel map: "This is a tentative parcel map of a
condominium project as defined in Section 1350 of the Civil Code of the State of California. The
project contains a maximum of 2 units".
4. The curb to property line and street centerline to curb distance on Juniper Avenue and Garfield
Street is illustrated to be 12 feet wide and 18 feet wide, respectively, on the tentative parcel map.
This distance appears to be correct based on our records. However, the site plan submitted
earlier with your planning department applications indicates a curb to property line distance of 10
feet and a street centerline distance to curb distance of 20 feet. Please make the plans
consistent and accurate.
5. The title insurance report, dated April 15th 1999, indicates that the current property owner is Judith
C. Davis, Trustee of the Judith C. Davis Trust and that David Mahlum is the buyer. The tentative

parcel map indicates that Dakmin, Inc. is the property owner. If Dakmin, Inc. is the current owner,
then provide current title documentation indicating such. Otherwise, state the current owner on
the map and obtain their signature on the application form.

height limit. The maximum height for a fence or wall within the front yard
setback is 42 inches.

paving as shown on the site plan.
3. The Planning Department shall not continue to process these permits until a
minor subdivision application has been applied for.
Engineering:
1. As of today, we still have not received an application for a minor subdivision.
Unit ownership via a condominium permit cannot be established without a
minor subdivision.
2. The minimum distance between the beginning of the driveway approach and
an extension of the side property line to the curb is 3 feet. The current
proposal for the guest parking shows a 0 foot distance. Please revise to
comply with the minimum standard (see enclosed redlined plan).
3. Revise the drainage plan to reflect the changes on the site plan. The drainage
plan still shows the sidewalk as contiguous with the curb. Also, change the
"8% MAX" grade on the guest driveway to "5% GRADE" as five percent is
the true grade based on the spot elevations provided.
4. Indicate on the site plan the sewer, water, and school district serving the
property. All are served by Carlsbad districts.
5. The proposed public access and utility easement at the street corner is
incorrectly plotted. Locate the center of the radius arc twenty feet from each
of the two property lines which form this corner of the property. The outside
of the arc should be facing the street intersection (see enclosed redlined plans).
6. Unless the Planning Department requires that the 6 foot high fence located
within the front yard set back needs to be reduced to 3'6", plot the site
distance line for the driveway located on the northwesterly abutting property.
Intersection site distance measurements shall comply with the current edition
of the CALTRANS Highway Design Manual .

Plan Review Recommendations
The following recommendations are optimal security suggestions provided by Carlsbad
Police Department's Crime Prevention Unit. The purpose of this document is to
safeguard property and public welfare by reviewing and regulating the design,
construction, quality of materials, use and occupancy, location, and maintenance of all
buildings and structures. The Crime Prevention Unit presents recommendations in two
sections, site considerations and building recommendations.
Site Considerations
D Lighting
The police department suggests that individual buildings be equipped on all sides with
lighting fixtures to illuminate the sides of the building. Light gives someone the
perception of being seen. The lights do not have to be of considerable wattage, low
levels of light are sufficient to provide a blanket of light.
Further, equip exterior fixtures with dawn to dusk sensors or timers, including balcony
lighting. The department recommends that the fixtures be adapted to use something
other than an incandescent bulb for energy efficiency. Direct the light to illuminate the
sides of the building not just the area surrounding the building. Protect the fixtures with
vandal resistant covers.
D Light Sources
• Incandescent or halogen lamps are short lived and fairly expensive to operate. They
put out a nice bright light and are easy to control. They are compact.
• Fluorescent lamps are less expensive to operate than incandescent or halogen and
have a longer life. They put out a good light but are a little more difficult to direct. They
are larger than the previous two.
• Mercury vapor lamps are less expensive to operate than incandescent or halogen
and have a long life. Their color is not as good as fluorescent but they are easier to
direct and control. They are compact.

• Metal halide lamps require fewer fixtures to illuminate an area but have a shorter life
than mercury vapor. They provide an excellent light and are easy to direct and control.
They are compact.
• High pressure sodium vapor lamps require few fixtures and have a low operating
cost. The fixtures are expensive to purchase. They put out an excellent light and are
easy to direct and control. They are compact.
• Low pressure sodium lamps have the lowest operating cost of all the lamps. The
fixtures are expensive but few are required. They put out a yellow light and the clarity is
not good. They are easy to direct and control. They are longer in size.
D Landscaping
Keep exterior landscaping at a minimal height and fullness giving police, security
services and the public surveillance capabilities into the area. Plant low profile shrubs,
below three feet. Design landscaping to keep a space between the tops of shrubs and
the bottoms of trees. Ensure the canopy of a tree is not lower than five feet. Do not
allow trees to provide access to the roof or balconies. Let landscaping augment, not
deter from lighting.
Apply security plants where necessary to prevent loitering and tampering. Security
plants have prickly leaves or thorns. They limit access over fences and through
windows. They also reduce concealing and loitering. Plant low level security plants on
or around problem areas. Security landscaping, used with appropriate fences provides
excellent security, deterring intruders. For a list of security plants, please contact the
Crime Prevention Office at 931-2105.
Install walls and fences that are see through for surveillance. Prune trees away from
fences to not provided access over the fence. Thick foliage at the fence line impairs
yard visibility and conceals a breach in the fence.
Lock gates and install gates that allow surveillance.
D Addressing
On the street side of the residence, display a street number in a prominent location.
Make the numbers visible to approaching emergency vehicles. The numerals should
be no less than four (4) inches in height and should be of a contrasting color to the
background to which they are attached. Display house numbers in illuminated fixtures.
D Entrances
Keep entrance ways clear of clutter. Make sure you allow vision from the front
access street to front door entrance. Homes that have been designed without this
consideration have been more susceptible to front entrance penetration. Surveillance
is important.
D Territoriality
Define areas of the units using the concept of territoriality. Using ground cover,
landscaping and lighting, define a general territory for both units and a personal territory
as a user moves closer to individual unit. When users have their own defined territory
they protect and care for the space.
Building Considerations
D Doors
Install wooden doors into the residence of solid core construction with a minimum
thickness of one and three-fourths (1-3/4) inches. This includes the garage pedestrian
door, and the door from the garage into the residence.
Further, equip all doors with a single cylinder dead-bolt lock using a 5-pin tumbler.
Connect the dead-bolt to the inner portion of the lock by connecting screws. Ensure the
lock has a one inch throw that can withstand a cutting tool attack. Choose a dead-bolt
that embeds at least three-fourths of an inch into the strike plate. Finally, re-enforce the
strike plate with a minimum of two, 3 inch screws.
Arrange all entry and exit doors to dwelling units so that the occupant has a view of the
area immediately outside the door without opening the door. Except doors requiring a
fire protection rating that prohibits them, provide such a view with a viewer having a
field of vision of not less than 190 degrees. Mounting height should not exceed fifty-
four inches from the floor. Further, install no glass panels within forty inches of a
locking device.
Doors that are partially glass also require a single cylinder dead-bolt lock. Also, equip
these doors with a burglar resistant glaze to prevent someone from breaking the glass
to enter the home.
D Sliding Doors
Install metal guide track at the top and bottom of horizontal sliding. Design the bottom
track so the door cannot be lifted from the track when the door is in the locked position.
Also, equip the door with security hardware such as a pin.
D Double Doors
The inactive leaf of a double door requires the same solid core construction as a single
door and should be equipped with metal flush bolts, having a minimum embedment of
five-eighths (5/8) inch into the head and threshold of the doorframe.
D Hinges
Use hinges for out-swinging doors with non-removable hinge pins or mechanical
interlock to preclude removal of the door from the exterior by removing the hinge pins.
D Garage Doors
Install two receiving points on doors that exceed sixteen feet in width; or, if the door
does not exceed nineteen feet, use a single bolt if placed in the center of the door, with
the locking point located either at the floor or door frame header. Or, use a torsion
spring counter balance type hardware.
D Windows
Equip all movable windows with security hardware to prevent them from being lifted
from the frame.

a) Meet with the City Fire Marshal and establish fire protection requirements (ie fire hydrants, fire
sprinkler requirements, fire detector check valve location, fire department connection, etc.).
b) Meet with the District's Project Engineer to discuss preliminary layouts for public water line
improvements (looped pipeline system) if onsite fire hydrants and/or fire sprinklers are required.
c) Meet with the District's Project Engineer to discuss potable water meter, recycled water meter
and sewer lateral locations. The Developer must establish in cooperation with the Water District
the adequacy of the existing water and sewer connections or the necessity for multiple/larger
services. Each unit will need a separate water meter and sewer lateral.
d) The Developer must establish in cooperation with the District the areas required to be irrigated
with recycled water.

COMPLETENESS & ISSUES REVIEW
Engineering Department staff has completed a review of the above-referenced project
for application completeness. The application and plans submitted for this proposed
project are considered complete. Additionally, staff has conducted a review of the
project for engineering issues of concern. Engineering issues which need to be
resolved or adequately addressed prior to staff making a determination on the proposed
project are as follows:
1. An application for a minor subdivision is required. A separate fee, plans and
documents will be needed. I suggest that you submit this application soon so that it
may be reviewed in conjunction with the planning department permits. To record an
approved minor subdivision, a certificate of compliance or final parcel map will also
need to be processed through separate fee and application subsequent to final
approval of the minor subdivision.
2. Do not realign the sidewalk to be contiguous with the curb. Since the existing
sidewalk is aligned as non-contiguous with the curb, we prefer that the sidewalk
remain non-contiguous despite that current standards require sidewalk to be
contiguous with the curb. A non-contiguous alignment provides a smoother
transition from the non-contiguous sidewalk fronting the neighboring properties and
retains a consistent appearance to the neighborhood.
3. Some damaged curb was observed during a field inspection. A condition will be
added to the approving resolution requiring repair or replacement of any damaged
or dilapidated curb or sidewalk.
4. If you are going to replace the guest driveway, then the distance between the point
of transition from top of curb to driveway must be a minimum of 3 feet from an
extension of the side property line. In addition, the minimum driveway width
permissible is 12 feet measured at the property line.
5. Add the following to the site plan:
a) A note stating "This is a tentative parcel map of a condominium project as
defined in Section 1350 of the Civil Code of the State of California. The
project contains a maximum of 2 units".
b) Cross sections of Garfield St. and Juniper Ave.
c) The sewer, water and school districts servicing the property.
d) The average daily trips generated (16 ADT)
6. An easement for public access and utilities will need to be granted at the east
corner of the property. The boundary of the easement shall be defined with a 20
foot radius at the corner of the property. Indicate on the site plan the location of
this easement and label it as "proposed public access and utility easement."
