DETERMINATION
OCEAN BREEZE CONDOS CONSISTENCY
The Assistant Planning Director has completed a review of your application for modifications to
the Ocean Breeze condominium project, a 5-unit condominium project under construction at
3416 Garfield Street (APN: 204-150-03). The proposed modifications include:
• Narrowing the driveway to 24-feet and increasing landscape area.
• Removing the stone veneer from the wall along the down-sloping driveway. The stone
cannot be readily seen from the street.
• Adding more decorative stone and pilasters to the front patio walls.
After careful consideration of the circumstances surrounding this request, the Planning Director
has determined that the application qualifies for a consistency determination with the approved
permits (CT01-11, CP01-04, CDP01-22) and therefore approves the changes to the project
based on Planning Director Administrative Policy No. 35. The approval is subject to the
following conditions, which must be completed before final inspection.
1. The applicant shall submit a reproducible 24" X 36" mylar copy of the amended site plan.
The mylar must be submitted, stamped "Consistency Determination", and signed by the
Planning Director.
2. As required by condition 13 of Planning Commission Resolution 5166 (for CT01-11), the
applicant shall submit and obtain Planning Director approval of a Final Landscape Plan
and Irrigation Plan showing conformance with the approved Preliminary Landscape
Plan, as modified by this consistency determination approval, and the City's Landscape
Manual.
3. Consistent with the approved preliminary landscape plan, the four palms proposed in the
front yard area on either side of the two sidewalks shall be a minimum 24-inch box size.

DETERMINATION
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your consistency determination, application no. PRE 05-32 (CD). The application
involves some modifications to an approved five-unit condominium project on 3416 Garfield
Street. Changes proposed affect the driveway width, a building elevation, and landscape and
hardscape design.
Staff has reviewed your application. Based on our review, we request the following plan
changes and have the following comment:
Planning:
1. Provide bottom and top of wall heights for the new patio walls and pilasters proposed in
the front yard. Walls and pilasters may not exceed 42-inches in height in the front
setback per Zoning Ordinance Section 21.46.130.
2. Provide a revised landscape plan to show how project revisions affect the approved plan.
Show plant types, quantities, and sizes.
Engineering:
1. Plot vehicular site distance at the driveway per Topic 405 of California Department of
Transportation Highway Design Manual. If proposed front yard fence interferes with site
distance, then revise the location and/or height of the fence as necessary. If the fence is
setback 5 feet from the front property line, then there is assurance that the site will
comply with site distance requirements and no plotting of the site distance line is
necessary.
2. The City approved grading plans on file in the Engineering Department must be revised
accordingly. Contact your City Engineering Inspector to determine whether said changes
must be made as a construction change or via as-built.
Once plan changes have been made, please submit three sets of revised plans.

The following is a response to the above-referenced review.
Planning:
1. Please refer to the Exterior Elevations sheet included with this response for patio wall and pilaster height
and to the revised Site Plan for revised patio wall extent.
2. Landscape plans will be supplied under separate cover by the owner's landscape planner.
Engineering:
1. Please refer to the revised Site Plan included with this response for the revised extent of the patio wall to
5'-0" off of the property line (P.L.); per Engineering comment #1, if the patio wall is 5'-0" off the property
line a vehicular site distance plot is not required.
2. Any revised Grading Plan will be provided to the city by the owner's civil engineer for this project.
Please note that a copy of this response letter along with a copy of the review letter dated June 8, 2005 has been
forwarded to the owner for their file and information and to notify the owner of the requirements listed above.
Please find attached three (3) copies of the revised Site Plan along with a revised 1st floor Floor Plan and the
revised Exterior Elevations referenced above in the responses.

Engineering Department staff has completed a preliminary review of the above-
referenced project. Prior to formal application submittal the following items must be
adequately resolved/addressed:
1. Plot vehicular site distance at the driveway per Topic 405 of California

Due to the location on property and the number of dwelling units, this entire project shall
have incorporated into its design an automatic fire sprinkler system. This shall include all
storage areas and the parking garage. The design of this fire sprinkler system may be one
that services the entire complex or individual systems. If it is desired to incorporate a
single system design, then a service and maintenance agreement between owners shall be
required.

The following is a list of items that have been reviewed by the Planning and the Engineering Departments. It was
noted that these items meet the Substantial Conformance requirements as determined by:

1. Decrease driveway width from 30'-0" wide to 24'-0" wide per new codes;
2. Remove proposed stone veneer from wall along down-sloping driveway that cannot be seen from
the street and substitute stucco color coat to match the building colors;
3. Increase the amount of stone at front pilasters to include additional pilasters and patio walls per a
new landscape plan;
4. Increase landscape area (L/A) along driveway;
5. Relocate 6" high concrete curb to new line of driveway edge adjacent to the retaining wall below
the front, street-facing units.
The City of Carlsbad Application Form for Preliminary Review Application used for Substantial Conformance and
the requisite check is attached with this memorandum, along with (2) bond copies of the revised Site Plan sheet
AS1.0 and the revised Exterior Elevations sheet A4.0 plus (1) mylar reproducible copy of the revised Site Plan
sheet AS10, for processing.
