STANDARI CONDITIONS
CITY 0 ARLSBAD J TENTATIVE SUBDIVISION MAP
Subdivision and development shall meet all requirements of the
subdivision, zoning, building codes, and General Plan and other
laws, ordinances or regulations of the City of Carlsbad, and other
governmental agencies. Some of the more pertinent requirements
and procedures of the City are listed below for your information
and concurrence. Please read this list carefully and feel free
to ask for further information or explanation.
1. Final Map shall be completed within 18 months from the
date of final City Council action on the Tentative
Subdivision Map. Two extensions of one year each may
be approved by City Council upon staff review of the
original decision.
2. The Final Map shall substantially conform to the
Tentative Subdivision Map. If otherwise, the Final Map
will be rejected and new Tentative Subdivision Map
hearings will be required for the revised plan.
3. All public improvements shall be made in conformity with the
Subdivision Ordinance and other City Standards, to the satis-
faction of the City Engineer, without cost to the City of
- Carlsbad and free of all liens and encumbrances.
4. Prior to any construction, the applicant shall submit plans
to the appropriate entity providing domestic water to the
proposed development, for its approval of the location,
type and adequacy of water lines.
5. Prior to any construction, the applicant shall obtain approval
from the City Fire Department of the location and size of
fire hydrants.
6. The applicant shall install all required fire hydrants and
dry-stand pipes prior to framing construction, and said
fire appurtenances shall be functional prior to commencing
such work.
7. Street trees, as required by the City, shall be installed
by the applicant at his expense. Trees shall be of a
type approved by the Parks Department and shall be installed
to their specifications. If removal of any existing trees
is required by the City, said removal shall be at the
applicant's expense. It shall be the responsibility of
the applicant to make all arrangements with the Parks
Department concerning the requirements of this condition.
8. A detailed grading plan which includes proposed drainage
and erosion control landscaping and for other measures
such as desilting basins shall be approved by the City
Engineer prior to Final Map.
9. Immediately after grading, erosion control landscaping
and/or other measures such as desilting basins shall
be installed. This, control may be the final landscaping,
if so approved.
10. A detailed landscape and sprinkler plan shall be sub-
mitted for Planning Director's approval for all graded
slopes 5' or greater in height and any other 'areas re-
quired by the City.
11. Prior to final building inspection clearance, all land-
scaping shall be installed or adequate bonding accepted.
Said landscaping shall be maintained in a manner accept-
able to the Planning Director.
.12. No signs or advertising of any type whatsoever shall be
erected or installed until plans thereof have been approved
by the City of Carlsbad.
As part of the approval process, the City may modify these conditions

Development shall meet all requirements of the subdivision, zoning

Carlsbad, and other governmental agencies. Some of the more" pertinent
requirements and procedures of the City are listed below for your in-
formation and concurrence. Please read this list carefully and feel

1) All conditions for Conditional Use Permit, Variance, Planned
Unit Development and Special Use Permit shall be completed and
the project commenced within 18 months from final City action,
unless otherwise stated as part of the approval. There is no
time limitations for Specific Plans unless required as part
of the approval.
2) Development shall substantially conform to the approved plan.

Form Planning 27 /Date of Planning Commission Approval
PROCEDURES
1) Application to Planning Commission: In an effort to aid the
applicant, the Planning Department requests that it he given an
opportunity to evaluate and discuss the application in its various
stages of development prior to submittal. It is more effective if
applicant meets directly with staff; however, written or telephone
communication is acceptable. It is the responsibility of the
applicant to make the initial contact for such meeting.
2) Submittal: Application will be accepted only if the application,
plans and other pertinent materials are included.
3) Review: After accepting the application staff will submit it to
the department review board (DCC) to ascertain if further information
is necessary. Staff will attempt to conclude this review within
two weeks, but in no case shall the review period be longer than
30 days from receipt of application.
4) Notice; Upon completion of the application review, the applicant
will be informed by letter if further information is required if
any, or if the application is complete what date it will be heard
by the Planning Commission.
5) Planning Commission Calendar: The Planning Commission adopts an
annual calendar that indicates application closing dates, staff
review dates, a staff recommended review dates as well as Planning
Commission hearing dates. The date your request will be heard is
selected from this calendar. You may acquire this calendar at the
Planning Department.
6) Staff Review: Staff prepares a report for the Planning Commission.
This report is reviewed by the Departmental Coordinating Committee
(DCC), which is made up of representativ'es from the departments of
Planning, Engineering, Fire, City Manager and other as may be
necessary. You are invited to this meeting to explain the project
and respond to staff recommendations. Upon completion of this
review, staff will prepare final staff recommendations to be sub-
mitted to the Planning Commission. The final report with rec-
ommendations will be available at the Planning Department five days
prior to the Planning Commission hearing (Friday afternoon prior to
th& Planning Commission meeting date).
7) Hearing: The Planning Commission meets every 2nd and 4th Wednesday
of the month at 7:00 P.M., or as indicated on the Planning
Commission calendar. Depending on the type of application, the
Planning Commission will either make a recommendation and forward
to City Council or take final action.
8) Appeals: Final actions by the Planning Commission may be appealed
to the City Council, provided such appeal-is filed within ten
(10) days after the Planning Commission action. The applicant
should review with staff the procedure on the various types of
applications.
9) Final Decision: The City will notify the applicant and property
owner of the final decision.

B. Drafting of Plan:
I) Sheets to be 24"x36" with 1" border (standard "D" size).
2) Scale to indicate: 1" = 10' is generally sufficient; however,
the scale is to be appropriate for sheet size.
3) North arrow oriented to top or left side of sheet.
4) Lettering must be legible. It is preferred that it be drawn
by mechanical means, in ink, and heavy upper case.
5) Location map showing the distances to the center line of the
nearest intersection.
6) Title block with name and address of applicant and drafter,

LOCATED AT THE SW CORNER OF LEVANTE AND CENTELLA
(CT 79-22/CP-31)
DISCUSSION
The proposed project involves an application for a 10 unit
condominium development located on the corner of Levante and
Centella in La Costa. The site is approximately 112 acre in
area, and has been previously graded to a relatively level pad.
Since the property has been graded, it is devoid of any signifi-
cant flora or fauna, and is only sparcely covered with low-lying
native vegetation.
The units will be arranged in three separate clusters, served by
a central recreation area. In addition, all on-site parking will
be provided within a semi-subterranean garage, with access off of
Levante Street.
In order to develop the parking structure, the applicant has
indicated that a 65'X100'X8' (deep) area will be excavated.
Approximately 1925 'cu-yards of excavation is proposed.
The project as proposed would result in a net density of 18.3
du/ac. This falls within the density range allowable under the
City's current land use plan. The property to the south has been
developed with condominiums, while single-family residences exist
to the west. The property to the north and east is currently vacant.
RECOMMENDATION
It is recommended that a declaration of negative environmental
impact be issued with regard to the project based on the following
justification.
JUSTIFICATION
1) The subject property has been previously graded and is
devoid of any significant flora, fauna or any unique or
historical environmental resources.
2) The project would not result in any significant environ-
mental impacts since no significant resources exist on
the site.
3) Although a substantial amount of excavation is proposed,
this will be limited to a relatively small area which
has been previously disturbed.
4) The immediate area has been committed to development and
the project is consistent with the General Plan Land Use
Designation

The project has been processed through environmental review and a negative
declaration has been issued for the following reasons:
1) The subject property has been previously graded and is devoid of any
significant flora, fauna or any unique or historical environmental
resources.
2) The project would not result in any significant environmental impacts
since no significant resources exist on the site.
3) Although a substantial amount of excavation is proposed, this will be
limited to a relatively small area which has been previously disturbed.
4) The immediate area has been committed to development and the project
is consistent with the General Plan Land Use Designation.

General Plan Information
A. Land Use Element
The Land Use Element designates this property as RMH, Residential Medium
High Density. The recommended density is 10 du/acre. The density may be
increased to a potential maximum of 20 du/acre, if certain criteria are fulfilled.
These criteria include soil and slope stability, compatibility with surrounding
uses and on-site amenities. This project has a density of 20 du/acre.
B. Public Facilities
Sewer: Leucadia County Water District will service this area. Ten sewer
permits are available for this project.
Water: Water service will be provided by the Olivenhain District. Each unit
will have a separate meter.
Schools: School fees will be paid at time of building permit application to
the Encinitas Union and San Dieguito High School Districts.
Gas & Electric: Gas & Electric service will be provided by SDG&E. Separate
meters will be provided.
On-site & Adjacent Public Improvements: Public improvements will he required
per the C11 Public Improvement Ordinance and/or as conditions of approval.
Other Public Facilities: All other public facilities necessary to
serve this project will not be available concurrent with need. However,
the Planning Commission may, by inclusion of an appropriate condition
require that the project contribute to the costs of such facilities
according to the City Council Policy No. 17. Since the development would
pay its appropriate share of the public facility it would require, the
Planning Commission could be assured that the requirements of the Public
Facilities Element of the General Plan would be satisfied. In addition
park-in-lieu fees would be assessed at the time of building permit
issuance.
C. Other Elements of the General Plan
The project is consistent with all other elements of the City's General Plan.
History and Related Cases
CP-6, O'Grady, City Council Resolution No. 5905.
On July 3, 1979, the Council approved this 23 unit condominium project. The
project is located between Almaden Lane, Zamora Way and Alicante Road. This
detached unit project was conditionally approved requiring modification to
grading and drainage, requirements for automatic garage door openers, fencing
and landscaping requirements. This project met all the requirements of the
condominium ordinance.
Major Planning Considerations
1) Is the provision of all guest parking on-street acceptable? Does this
project meet all the development standards of the condominium ordinance?

2) Does the design meet the design criteria of the condominium ordinance?
II. DISCUSSION
This is a request for approval of a condominium permit for 10 units. A final
map has been filed (Map No. 7457) which designates this property as a condo-
minium lot. Therefore, no additional tentative map is necessary.
The proposed project contains 10 units of 2 different floor plans. All of
the tenant parking will be provided in a subterranean garage on the western
edge of the property. Access to this garage is from Levante Street. There
is a stairway leading to the center of the project from the garage. The
center of the development is a common recreation area including a pool,
jacuzzi and barbecue. Each unit has a private entry yard and a patio.
Development Standards
All development standards have been met. The 20 required parking spaces are
provided in the subterranean garage. Guest parking is provided on-street.
Five spaces are required; there is room for seven spaces. There are no
open driveways and therefore no additional setbacks are necessary.
The refuse area has been provided in the subterranean garage just inside
the entrance. The applicant has provided a letter from Coast Waste Management
indicating that this is acceptable.
The 480 cubic feet of storage space are provided outside each unit, with
access from the private patio. The storage room is 6x8x10. Laundry facilities
will be provided individually. A stacking washer/dryer will be put in each
unit. For 10 units, a total of 2,000 square feet of common recreation area
must be provided. Over 2,000 square feet of recreation area, including a
pool, jacUzi and barbecu, have been provided. Separate utility meters will
be provided.
Design Criteria
This project was comprehensively planned and embraces buildings, parking,
recreation and landscaping. It is very compatible with the proposed medium-
high density and commercial land uses. The single family area to the west
will be buffered by a 10' landscaped yard and by a grade difference. The
provision of all tenant parking in a subterranean garage will reduce the
negative impacts on both the tenants and the neighbors. The driveway/
parking area is not dominant. The common areas are centrally located and
are reached by a landscaped walkway. Pedestrian access leads to both streets,
the parking area and the recreation area and is safe and well integrated.
General Plan
The Land Use Element specifies a density of 10 du/acre for this propei'ty.
However, the density may be increased to a maximum of 20 du/acre provided
that certain criteria have been met. These criteria include but are not
limited to slope of land, soil stability, compatibility with surrounding
land uses, adequacy of public facilities and on-site amenities.

This project has been provided with underground parking, which eliminates
all visible driveways and garages. More space can therefore be devoted to
living, recreation and landscaping. A large common recreation area, as well
as private patios and yards have been provided. There are not excessive
slopes; the property had been graded previously. Soils are stable.
There are single family homes to the west, at a lower elevation. There is
a 10' landscaped yard between the proposed units and the property line
adjacent to the single family area. The density is compatible with other
proposed land uses in the area which include medium-high density residential
and commercial. Traffic from this project is routed on to Levante. The
easiest access to this property is from La Costa to Levante. This will
direct traffic away from the single family area.
Zoning
The zone on this property is RDM. There are 10 foot yards on the north,
east and west sides and a 5 foot yard on the south. This meets the require-
ments of the zone. The zone allows a zero foot setback for subterranean
parking garages. The building reaches a maximum height of 24 feet above
street level. The proposed project meets all other requirements of the
zone.
III. RECOMMENDATION
Staff recommends APPROVAL of CP-31, based on the following findings and
subject to the following conditions:
Findings
1. The proposed project is consistent with the General Plan because:
a) The proposed project is within the density range allowed by
the Land Use Element.
b) The proposed project is consistent with all other elements of
the General Plan.
2. The proposed project is consistent with all City Public Facility
policies and ordinances because:
a) Ten sewer permits have been obtained from the Leucadia County
Water District.
b) School fees to mitigate conditions of overcrowding are required
at the time of building permits pursuant to Chapter 21.55 of
the Carlsbad Municipal Code.
c) Water service will be provided through separate meters by the
Olivenhain Municipal Water District.
d) Gas and Electric service will he provided by SDG&E through
separate meters.

e) Park-in-lieu fees are required as a condition of approval.
f) All necessary on-site and adjacent public improvements have
been provided or will be required as conditions of approval.
g) Sewer service is not available for this project at this
time. The Planning Commission has, by inclusion of an
appropriate condition, insured that the final map for each
phase shall not be approved unless the City Council finds that
sewer service is available to serve the project. In addition,
a condition has been added requiring that a note be placed on
the final map stating that building permits may not be issued
unless the City Engineer determines that sewer service is
available.
Since the final map cannpt be approved unless sewer service
is available, the building cannot occur within the project
unless sewer service remains available, the requirements of the
public facilities element of the General Plan have been
met insofar as they apply to sewer service for this and
tentative map approval.
h) At this time, all other public facilities necessary to serve
this project will not be available concurrent with need. The
Planning Commission has, by inclusion of an appropriate condition,
required that the project contribute to the cost of such
facilities. Since the development will pay for its proportionate
share of the public facilities which it will require, the Planning
Commission is satisfied that the requirements of the public
facilities element of the general plan have been satisfied.
3) The proposed project has been proposed through environmental review
and a negative declaration, Log No. 614, has been issued on this
project for the following reasons:
a) The subject property has been previously graded and is devoid of
any significant flora, fauna or any unique or historical
environmental resources.
b) The project would not result in any significant environmental
impacts since no significant resources exist on the site.
c) Although a substantial amount of excavation is proposed, this
will be limited to a relatively small area which has been
previously disturbed.
d) The immediate area has been committed to development and the
project is consistent with the General Plan Land Use Designation.
Conditions
1) Approval is granted for CP-31, as shown on Exhibit B, C, El and E,
dated 10/28/79, on file in the Planning Department. Development
shall be substantially as shown unless otherwise noted herein.

2) The applicant shall submit a reproducible copy of the condominium
plan prior to approval of the final map. The reproducible shall
include a note indicating that laundry facilities and utility
meters will be provided individually. This plan shall incorporate
all requirements of approval and shall be subject to approval of
the Planning Commission.
3) The applicant shall comply with all rules and regulations of the
respective sewer and water districts regarding sewer to the property.
4) The applicant shall pay park-in-lieu fees prior to approval of the
final map.
5) This subdivision is approved upon the express condition that the
final map shall not be approved unless the City Council finds at
the time of such approval that sewer service is available to serve
the subdivision.
6) This subdivision is approved upon the express condition that building
permits will not be issued for development of the subject property
unless the City Engineer determines that sewer facilities are
available at the time of application for such permits and will
continue to be available until time of occupancy. If the City
Engineer determines that sewer facilities are not available, building
permits will not be issued.
7) Street trees of a variety approved by the Parks and Recreation
Department shall be installed to City specifications at 40 foot
intervals along all public street frontages.
8) Prior to issuance of building permits, the applicant shall pay a
public facility fee as established in City Council Policy No. 17.
This approval is expressly conditioned upon the applicant entering
into a secured agreement with the City for the payment of this fee
prior to the approval of the resolution for this project by the
Planning Commission.
9) To insure safe circulation to and from the parking garage, adequate
visibility shall be provided for on both sides of the driveway to
the satisfaction of the City Engineer.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS CONDOMINIUM PERMIT
(CP-31) FOR A 10-UNIT CONDOMINIUM PROJECT
ON APPROXIMATELY .5 ACRE, GENERALLY
LOCATED ON THE SOUTHWEST CORNER OF
LEVANTE AND CENTELLA STREETS. APPLICANT:
ROY WARD.
WHEREAS, on January 9, 1980 the Carlsbad Planning Commission
adopted Resolution No. 1580 recommending to the City Council
that Condominium Permit (CP-31) be conditionally approved; and
WHEREAS, The City Council of the City of Carlsbad, on
March 4, 1980, held a public hearing to consider the recommenda-
tions and hear all persons interested in or opposed to Condominium
I Permit (CP-31); and
WHEREAS, said Condominium Permit has been declared to have
a nonsignificant impact on the environment and a Negative
Declaration has been prepared and filed in compliance with the
requirements of the City of Carlsbad Environmental Protection
Ordinance of 1972;
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 1580 constitute the findings of the City Council
in this matter.
C. That Condominium Permit (CP--31) is hereby approved
subject to all applicable requirements of the Carlsbad Municipal
Code and to the satisfaction of the following conditions:
1. Approval is. granted for CP-31 as shown on Planning
Commission Exhibit "B", "C", "D" and "E", dated October 28, 1979,

consistent with the General Plan and the project cannot proceed

STATEMENT-Or-THE MATTER
The subject property is approximately a half acre located on the
southwest corner of Levante and Centella Streets in the La Costa
area. The general plan indicates a recommended density of
10 units to the acre with up to 20 units with appropriate amenities.
The subject project's density is the maximum of 20 units to the
acre.
Approval, of the project at this density requires a finding that
substantial amenities have been provided. Staff and the Planning
Commission found that.these amenities are exis-ting •in the way of
subterraneanparking, well integrated common and recreation
areas and quality development. In addition, each unit has a
private entry yard and a patio.
All development and design criteria -of the condominium regulations
have been met.
The property was originally subdivided into a condominium lot,
therefore a tract map is not required with this. condominium
permit. . .
The applicant signed the original agreement for public facility
fees, but did not provide at that time for required security.
The signed agreement is acceptable to continue the processing of
this project, but staff will request the applicant to sign the new
form.
