HomeMy WebLinkAboutCP 90-11; Shinn Condominium Conversion; Condo Permit (CP) (8)APRIL 25, 1991 TO: ENGINEERING DEPARTMENT FROM: Planning Department SUBJECT: CP 90-1 I/MS 852 APPLICANT: George Shinn The Planning Department has completed a review of the application for a two-unit condominium conversion located at 4537 Cove Drive, Carlsbad, California. It is the Planning Director's Determination that based on the attached conditions, the project is consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable City ordinances and policies. Further, the project has been found to be categorically exempt from environmental review according to Section 15303(b) of the California Environmental Quality Act and a Notice of Exemption has been prepared. This memorandum, including the listed findings and conditions, constitutes approval of CP 90-11. Findings: 1. The project is consistent with the City's General Plan Land Use Element meeting the density in an RH designation, and with all other elements of the City's General Plan. 2. Adequate public facilities necessary to serve this project will be provided as required by the City Engineer in conjunction with the approval of the parcel map for this project. 3. The project is consistent with the design criteria and development standards of 21.45 (Planned Development Ordinance) of the City's Zoning Code. Conditions: 1. Approval is granted to CP 90-11 as shown on Exhibits "A" - "I", dated April 24, 1991, on file in the Planning Department and incorporated herein by reference. 2. Approval of CP 90-11 is subject to the approval of MS 852 and subject to all conditions of MS 852, incorporated herein by reference. CP 90-11 APRIL 25, 1991 PAGE 2 3. Approval of this request shall not exclude compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of final map approval. 4. The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Director prior to final map approval. 5. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. 6. This project is being approved as a condominium permit for residential home ownership purposes. If any of the units in the project are rented, the minimum time increment for such rental shall be not less than 26 days. A condition so stating this shall be placed in the CC&R's for the project. 7. This project shall comply with all conditions and mitigation required by the Zone 1 Local Facilities Management Plan approved by the City Council on September 1, 1987, incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the final map approval. 8. The applicant shall have a compliance inspection performed by the Building Department prior to final map approval. 9. The applicant shall notify all tenants that the units are converting to condominiums and submit a tenant notification form to the Planning Director prior to final map approval.
