HomeMy WebLinkAboutCP 93-01; Trolson Residence; Condo Permit (CP) (6)City of Carlsbad Planning Department March 15, 1993 Mr. & Mrs. Trolson 5001 Silas Court North East Albuquerque NM 87111 RE: CP 93-01/MS 93-01 - TROLSON RESIDENCE The City has completed a review of the application for a two-unit condominium development located at 6730-6732 Antilope Street. It is the Planning Director's determination that based on the attached conditions, the project is consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable City Ordinances and Policies. Further, the project has been found to be categorically exempt from environmental review according to Section 15301 (k) of the California Environmental Quality Act and a Notice of Exemption was filed on March 15, 1993. This memo, including the listed findings and conditions, constitutes approval of CP 93-01. Findings: 1. The project is consistent with the City's General Plan Land Use Element, and with all other elements of the City's General Plan. 2. Adequate public facilities necessary to serve this project will be provided as required by the City Engineer in conjunction with the approval of the parcel map (MS 93-01) required for this project. 3. The project is consistent with the design criteria and development standards of Chapter 21.45 (Planned Development Ordinance) of the City's Zoning Code. Conditions: 1. A copy of the final planned development site plan, incorporated all conditions of approval, shall be submitted to and approved by the Planning Director prior to final map approval of MS 93-01. 3. All conditions of MS 93-01 are incorporated herein by reference and shall be complied with in their entirety. 4. Unless otherwise stated herein, this condominium project shall comply with all applicable City Ordinances and requirements. 5. The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Director prior to final map approval. 6. Building identification and/or address shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. 7. This project is being approved as a condominium project for residential homeownership purposes. If any of the units in the project are rented, the minimum time increment for such rental shall be not less than 26 days. A condition so stating this shall be placed in the CC&R's for the project 8. This project shall comply with all conditions and mitigation required by the Zone 6 Local Facilities Management Plan approved by the City Council on November 10, 1987, incorporated herein and on file in the Planning Department and any future amendments to the plan prior to the final map approval. 9. The applicant shall have a compliance inspection performed by the City of Carlsbad Building Department prior to final map approval. 10. The applicant shall notify all tenants that the units are converting to condominiums and submit a tenant notification form to the Planning Director prior to final map approval. The applicant is aware that the City is preparing a housing impact fee as an alternative to the incluslonary requirements stipulated in Policy 3.6b of the Housing Element. If in the development of the impact fee program, it is determined by the City Council in order to find consistency with the Housing Element of the General Plan as well as consistency with Section 66473.5 of the Government Code (Subdivision Map Act), that this project is subject to this fee and a parcel map has not been issued, the applicant or its successors in Interest shall pay whatever reasonable impact fee that is required and in effect at the time of issuance of parcel map. If required fees are not paid, this application will not be consistent with the General Plan and approval for this project will be void. No impact fee will be required if a parcel map is issued prior to the effective date of the Inclusionary Ordinance (ZCA 91-06).
