BOX 5201 San Clemente, CA 92674 MS 93-08, CP 93-05, STIPE CONDO CONVERSION This letter is written to clarify the status of the Minor Subdivision subsequent to a decision to hold in abeyance a decision to deny the Condominium Permit. Subsequent to a request by Lee Riley we are reserving (holding in abeyance) the preliminary decision to approve or deny the Minor Subdivision pending the outcome of a zone code amendment. However this zone code amendment must be undertaken as soon as possible. Therefore we are allowing ten (10) days from the date of this letter for you to file for a Zone Code Amendment. If by that time you have not filed for the Zone Code Amendment, we will issue a preliminary decision to deny the Minor Subdivision on the grounds that it does not meet all the requirements of Title 21. In Mister Riley's letter it is stated that all time limitations imposed by the Municipal Code are waived. There is also a State mandated time limitation of six (6) months from the date the application was found complete, September 3, 1993. Therefore the zone code amendment outcome must be completed in time for a preliminary decision to be made on the project by March 3, 1994. You can and may wish to extend or waive the State mandated time limit. If a zone code amendment is undertaken and a final decision on the zone code amendment is reached, the Planning Department will finalize the decision on the condominium permit and thereupon the Engineering Department will issue the preliminary decision for the Minor Subdivision. The preliminary decision has a mandatory 10 day appeal period before the final decision is issued.
