RE: CP 93-06/MS 93-09 - MAXEY/JOHNSON RESIDENCE
The City has completed a review of the application for a two-unit condominium development
located at 2201 -2203 Levante Street.
It is the Planning Director's determination that based on the attached conditions, the project is
consistent with the City's condominium regulations (Chapter 21 .45) and with all other applicable
City Ordinances and Policies. Further, the project has been found to be categorically exempt
from environmental review according to Section 1 5301 (k) of the California Environmental Quality
Act and a Notice of Exemption was filed on September 24, 1 993.
This memo, including the listed findings and conditions, constitutes approval of CP 93-06.
Findings:
1 . The project is consistent with the City's General Plan Land Use Element, and with all
other elements of the City's General Plan.
2. Adequate public facilities necessary to serve this project will be provided as required by
the City Engineer in conjunction with the approval of the parcel map (MS 93-09) required
for this project.
3. The project is consistent with the design criteria and development standards of Chapter
21 .45 (Planned Development Ordinance) of the City's Zoning Code.
Conditions:
1 . Approval is granted for CP 93-06 as shown on Exhibit "A", dated September 24, 1 993, on
file in the Planning Department and incorporated herein by reference.
2. A copy of the final planned development site plan, incorporated all conditions of approval,
shall be submitted to and approved by the Planning Director prior to final map approval
of MS 93-09.
3. All conditions of MS 93-09 are incorporated herein by reference and shall be complied
with in their entirety.
4. Unless otherwise stated herein, this condominium project shall comply with all applicable
City Ordinances and requirements.
5. Building identification and/or address shall be placed on all new and existing buildings
so as to be plainly visible from the street or access road; color of identification and/or
addresses shall contrast to their background color. _

6. This project is being approved as a condominium project for residential homeownership
purposes. If any of the units in the project are rented, the minimum time increment for
such rental shall be not less than 26 days. A condition so stating this shall be placed in
the CC&R's for the project.
7. This project shall comply with all conditions and mitigation required by the Zone 6
Local Facilities Management Plan approved by the City Council on November 10, 1987,
incorporated herein and on file in the Planning Department and any future amendments
to the plan prior to the final map approval.
8. The applicant shall have a compliance inspection performed by the City of Carlsbad
Building Department prior to final map approval.
9. The applicant shall notify all tenants that the units are converting to condominiums and
submit a tenant notification form to the Planning Director prior to final map approval.
10. Prior to the issuance of building permits, or prior to the recordation of a final map and/or
issuance of certificate of compliance for the compliance for the conversion of existing
apartments to air-space condominiums, the applicant shall pay to the City an inclusionary
housing in-lieu/impact fee as an individual fee on a per market-rate dwelling unit basis.
