The entire potable water system, reclaimed water system and sewer system shall be evaluated in detail to insure that adequate capacity, pressure and flow demands can be met. 2. The Developer shall be responsible for all fees, deposits and charges which will be collected before and/or at the time of issuance of the building permit. The San Diego County Water Authority capacity charge will be collected at issuance of application for meter installation. Meet with the City Fire Marshal and establish the fire protection requirements. Also obtain G.P.M. demand for domestic and irrigational needs from appropriate parties. B. Prepare a colored reclaimed water use area map and submit to the Planning Department for processing and approval. C. Prior to the preparation of sewer, water and reclaimed water improvement plans, a meeting must be scheduled with the District Engineer for review, comment and approval of the preliminary system layouts and usages (ie - GPM - EDU). This project is approved upon the expressed condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water service and sewer facilities are available at the time of application for such water service and sewer permits will continue to be available until time of occupancy. The application and plans submitted for this proposed project are currently considered complete in terms of Engineering requirements. The applicant has improved the amendment considerably by withdrawing his request to phase or improve this project as separate units. This alone resolves most of Engineering Department issues with this application. Specific plancheck comments will be forwarded to the project planner as soon as time permits, and will be in the form of a red-lined check print for the applicants use in making the requested revisions. E W1CKHAM Assocate Engineer- Land Use Review Attachment SEPTEMBER 10, 1997 TO: ERIC MUNOZ, ASSOCIATE PLANNER FROM: Clyde Wickham, Associate Engineer PROCESSING PLANNING AREA "B-l" WITH A CONDO PERMIT AMENDMENT The project applicants have asked staff to review their latest processing proposal for Planning Area "B-l" in the Poinsettia Shores Master Plan. It involves what appears to qualify as a minor condominium permit amendment to the northern half of B-1. The southern half of B-1 would be processed and built exactly as currently approved. The entire planning area will be constructed, graded and improved as a single (1) phase. Despite the condo permit change to the northern half of B-l, the Engineering Department has no issues with the continued processing of the improvement plans and final map approval for B-l (CT 94-08). This is Engineering's position as long as there are no changes to the approved grading, streets or other infrastructure components. Should the proposed minor condo permit amendment for B-l be considered a major condo permit amendment by the Planning Commission, such an amendment would not affect the ability of CT 94-08 to go on to receive final map approval assuming no phasing requests and no changes to approved grading, streets or infrastructure. The Engineer has informed us that they intend to phase the project per the parcel lines shown on the Financial Parcel Map. The proposed phasing was never approved, in fact the Parcel Map was specifically conditioned and a note was placed on the record map to clarify our position. " "MS 96-13 IS CONSIDERED A MINOR SUBDIVISION FOR FINANCIAL PURPOSES ONLY. NO FURTHER DEVELOPMENT OF ANY PARCEL SHALL OCCUR UNTIL CARLSBAD TRACT 94-08 AND CONDOMINIUM PERMIT 94-01 ARE RECORDED. THIS SUBDIVISION SHALL NOT RESTRICT PHASING OR DEVELOPMENT CONDITIONS AS APPROVED BY CITY COUNCIL RESOLUTION 95-151. The resolution identified in this note contains a condition that the project is specifically approved as 1 (single) phase. Any change to the phasing would require a specific change to the condition of approval. Due to our heavy workload, additional comments will follow as soon as they become available. • The applicant should be aware that the Parcel Map Lines shown are for financial purposes only and do not constitute approval of Phase or development approvals. It appears that the Engineer added a note that multiple phases may be proposed. If that is the case we want to see the phase lines before approval. • The Key Map is incorrect and has errors that do not reflect the design on the subsequent sheets. • As far as I can determine the exact elevations as originally approved and the exact design as originally approved are still proposed. If there are changes or differences in the original we request that they be called out or highlighted to expedite the process. We hereby recommend approval of the proposed project, subject to the following conditions: Please include these conditions in your staff report for this project. ENGINEERING CONDITIONS General # . All conditions and requirements of CT 94-08, CP 94-01 and MP are hereby incorporated in this amendment. This approval is not considered a separate phase or isolated development with respect to grading or improvement requirements of Planning Area B-1. 43. The developer shall provide an acceptable means for maintaining the private easements within the subdivision and all the private: streets, sidewalks, street lights, storm drain facilities and sewer facilities located therein and to distribute the costs of such maintenance in an equitable manner among the owners of the properties within the subdivision. Adequate provision for such maintenance shall be included with the CC&Rs subject to the approval of the City Engineer. 45. The developer shall defend, indemnify and hold harmless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, the Planning Commission or City Engineer which has been brought against the City within the time period provided for by Section 66499.37 of the Subdivision Map Act. 46. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 47. Rain gutters must be provided to convey roof drainage to an approved drainage course or street to the satisfaction of the City Engineer. 50. The developer shall pay all current fees and deposits required. 70. The developer shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The developer shall provide best management practices as referenced in the "California Storm Water Best Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be approved by the City Engineer. Said plans shall include but not be limited to notifying prospective owners and tenants of the following: A. All owners and tenants shall coordinate efforts to establish or work with established disposal programs to remove and properly dispose of toxic and hazardous waste products. B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. Code Reminder The project is subject to all applicable provisions of local ordinances, including but not limited to the following: 79. The developer shall exercise special care during the construction phase of this project to prevent offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. Engineering will allow one additional lot to be created for the private streets; resulting in a total of three lots . All air space ownership dwelling units are approved on one residential lot. Increasing the number of residential lots (even though the number of dwelling units is not changing) is considered a major reconfiguration of the approved lots and requires a requires a tentative map amendment per Engineering Policy No. 30. Grading quantities Acceptable per Engineering and Planning Department review. Pad elevations Acceptable; however it is noted that the substantial conformance review is allowing for the correction of the grades as noted/approved with the tentative map with regards to the 100 foot pad elevations for units located near the entrance of future Area D and Avenida Encinas. This is done is most cases but not all; some units appear to cross a matchline/fence line. The building adjustments related to the units next to the recreation lot are not acceptable. A.C.
