This is a request to amend condition number 19 of Planning Commission Resolution
number 5240 as follows:
"Prior to approval of the grading permit, the developer shall..." etc.
The way the condition is written now, it says, "Prior to approval of the Final Map" etc.
This wording is not a standard city condition. We understand that we need to have our
agency permits before grading or any change to the land can occur.
I have attached to this letter a completed Land Use review application form, a new
disclosure statement, a marked up copy of Condition number 19, and a check from H.G.
Fenton in the amount of $3165.00. Please process our request to amend condition 19 of
PC resolution number 5240

PROJECT DESCRIPTION: A one year Tentative Tract Map extension and extensions and amendments
to the Special Use Permit and Hillside Development Permit for the replacement of a previously approved
1+1/2:1 manufactured slope to a vertical 44 foot tall masonry tie-back wall system on a project previously
approved to subdivide and grade 53.65 acres of land into four lots for industrial uses and one open space lot
on property located adjacent and west of El Camino Real, between College Boulevard and Faraday Avenue.
The HMP permit is for the take of covered species under the Habitat Management Plan.
DETERMINATION: The City of Carlsbad has conducted an environmental review of the above-described
project pursuant to the Guidelines for Implementation of the Califomia Environmental Quality Act and the
Environmental Protection Ordinance of the City of Carlsbad. As a result of said review, the initial study
(EIA Part 2) identified potentially significant effects on the environment, and the City of Carlsbad finds as
follows:
!^ Although the proposed project could have a significant effect on the environment, there will not be a
significant effect in this case because the mitigation measures described on an attached sheet have
been added to the project.
I I The proposed project MAY have "potentially significant impact(s)" on the environment, but at least
one potentially significant impact 1) has been adequately analyzed in an earlier document pursuant
to applicable legal standards, and 2) has been addressed by mitigation measures based on the earlier
analysis as described on attached sheets. (Mitigated Negative Declaration applies only to the effects
that remained to be addressed).
I I Although the proposed project could have a significant effect on the environment, there WILL NOT
be a significant effect in this case because all potentially significant effects (a) have been analyzed
adequately in an earlier ENVIRONMENTAL IMPACT REPORT or NEGATIVE DECLARATION
pursuant to applicable standards and (b) have been avoided or mitigated pursuant to that earlier
ENVIRONMENTAL IMPACT REPORT or NEGATIVE DECLARATION, including revisions or
mitigation measures that are imposed upon the proposed project. Therefore, nothing further is
required.

approved 1+1/2:1 manufactured slope to a vertical 44 foot tall masonry tie-back wall system on a
project previously approved to subdivide and grade 53.65 acres of land into four lots for
industrial uses and one open space lot on property located adjacent and west of El Camino Real,
between College Boulevard and Faraday Avenue.
PROPOSED DETERMINATION: The City of Carlsbad has conducted an enviromnental
review of the above described project pursuant to the Guidelines for Implementation of the
Califomia Enviromnental Quality Act and the Environmental Protection Ordinance of the City of
Carlsbad. As a result of said revievi^, the initial study (EIA Part 2) identified potentially
significant effects on the environment, but (1) revisions in the project plans or proposals made
by, or agreed to by, the applicant before the proposed negative declaration and initial study are
released for pubhc review would avoid the effects or mitigate the effects to a point where clearly
no significant effect on the environment would occur, and (2) there is no substantial evidence in
light of the whole record before the City that the project "as revised" may have a significant
effect on the environment. Therefore, a Mitigated Negative Declaration will be recommended
for adoption by the City of Carlsbad Planning Commissiofn.
A copy of the initial study (EIA Part 2) documenting reasons to support the proposed Mitigated
Negative Declaration is on file in the Planning Department, 1635 Faraday Avenue, Carlsbad,
Cahfomia 92008. Comments fi-om the pubhc are invited. Please submit comments in vmting to
the Planning Department within 30 days of the date of this notice.
The proposed project and Mitigated Negative Declaration are subject to review and
approval/adoption by the City of Carlsbad Planning Commission and City Coimcil. Additional

Allen: After discussions with the wall contractor and the identification of the negative effects of the anti-graffiti
wall coating in color changes and future maintenance issues with the application of the coating, the City will not
require the anti-graffiti coating per condition number 5 of Planning Commission resolution 5936 (CT 00-20x2
(A)). This condition will be considered to be fulfilled by the application of the color treatment and by the future
maintenance responsibilities of the property owner or owners association. Planning would suggest that the wall
contractor be able to provide the property owner with additional color treatment/stain and instructions on how
to treat graffiti if it were to occur.
