Case No. CT 93-09f A> Dear Ms. Hysong: Pursuant to our discussion, and at the request of Brian Milich of Catellus Residential Group, Inc., we have made additional revisions to the Ocean Bluff (Cantamar) Declaration of CC&R's, to incorporate the requirements of Condition 7 of Resolution No 4318, pertaining to a trail easement maintained by the Homeowners Association. Enclosed please find the original and redlined pages showing these revisions, which are described as follows: 1. Section 1.16, Common Area - This definition now includes reference to the "trail easement"on Lots 78 to 84 and 86. 2. Section 9.2, Maintenance Obligations of Association - The description of the Association's obligations now includes reference to maintenance of the trail as a private trail, if its dedication is not accepted by the City. With respect to these provisions, the Declaration of CC&R's will be recorded in this form following both the recording of the Final Map, and the developer's receipt of final approval of the project from the Department of Real Estate.
