POINSETTIA LANE EXTENSION ACROSS SAKARIA PROPERTY
Thank you for your letter of December 16, 1997. To bring you up to date, the City
is currently working with a nearby developer, Catellus Residential Group, on a
project which is required as a condition of approval to extend Poinsettia Lane from
Aviara Parkway easterly to their subdivision boundary. The developer has recently
submitted for a tentative map amendment to revise their project. One requested
change involves their condition regarding the dedication and improvement of
Poinsettia Lane.
Currently, the project is conditioned to dedicate and improve the northern half of
Poinsettia Lane from Aviara Parkway to Street 'A' (approximately located at their
western property line). They would like to revise their condition to require full
dedication of Poinsettia Lane and construction of the center two lanes, one on each
side of a raised unimproved median. The revision will make their improvement
requirement consistent with the improvements funded by the recently formed
Bridge and Thoroughfare District (B&TD) No. 2. With the revised condition, the
developer can take full advantage of the reimbursement program allowed for under
the B&TD. The tentative map revision must be approved by the Planning
Commission and City Council at publicly noticed meetings prior final approval.
In addition to the developer requested changes, the City is requesting that the
developer accept a condition to extend Poinsettia Lane from Street 'A' to Black Rail
Road. The developer is willing to accept the condition provided that the City
reimburse the developer and assume responsibility for acquiring the necessary
rights-of-way. Since the City sponsored district will fund the acquisition, the City
has agreed to this provision. We are currently in the process of hiring a right-of-way
agent to assist with the acquisition. We expect the agent, Mr. Bill McFarlane, to be
under contract with the City within the next month. Shortly thereafter, he should
be contacting Mr. And Mrs. Sakaria, or you as the case may be, regarding the
acquisition of needed right-of-way across the Sakaria property.
