It is our understanding that the following information is required in order for you to process the permit request. Project Name: Ocean Bluff Project Description: Subdivision of a 31.2 acre parcel into 97 lots including 1 open space lot; construction of 96 detached single-family residences on minimum 7,500 square-foot lots, with associated street and utility improvements; and construction of portion of Poinsettia Lane from Black Rail Road to Aviara Parkway. The project includes the dedication of 3 acres of sensitive habitat onsite as permanent open space, and the acquisition of Coastal Sage Scrub (CSS) habitat offsite. This project includes 160,000 cubic yards of balanced cut and fill grading. Project Location: South of Palomar Airport Road, east of future Aviara Parkway, at the intersection of the future Poinsettia Lane extension with future Black Rail Road. Proposed total loss of Coastal Sage Scrub habitat: 3.98 acres 2. Estimated Gnatcatcher Population on-site: One pair. -1- o 3. Proposed loss of other habitat types:See discussions in Biological Field Survey Update. March 1995, by Anita Hayworth. 4. Proposed Mitigation: In accordance with Planning Commission Resolution No. 3869, Condition 29., the applicant will mitigate the loss of one pair of gnatcatchers and the total 3.98 acres of CSS habitat by acquiring comparable quality habitat at a ratio of 2:1. The applicant has purchased 8.0 acres of CSS habitat from the Carlsbad Highlands mitigation bank. The preservation of offsite habitat serves as mitigation for the approximately 3-acre area of CSS directly impacted and the 0.7 acre area indirectly impacted by the Poinsettia Lane extension, as well as, an impact of .28 acre to disturbed CSS off-site for the grading and construction of "A" Street. Consistent with the Zone 20 Specific Plan PEIR, 3 acres of southern mixed chaparral habitat (including 1.19 acres of Southern Maritime Chaparral (SMC), chamise and wart-stemmed ceanothus) is preserved on-site in the northwestern corner. Since over 90% of the required mitigation results directly from the construction of Poinsettia Lane offsite, which would be constructed even in the absence of the Ocean Bluff project, this project could qualify for priority use of the City's remaining CSS take acreage. I have enclosed the following documents, in addition to those you have received from Brian Milich of the Catellus Group, to address the submittal requirements of (1) previous environmental documents; (2) biologist's reports including recommended mitigation; and (3) maps of the impact site and mitigation site: • Letter to City of Carlsbad from U.S. Fish and Wildlife Service confirming acceptance to the proposed mitigation of CSS habitat. • Letter to City of Carlsbad from California Department of Fish and Game confirming compliance with NCCP Guidelines. • Gnatcatcher Mitigation location map showing Carlsbad Highlands mitigation bank area. • Proof of purchase of environmental credits within the Carlsbad Highland mitigation bank: Acknowledgment of Sale of Conservation Credits and Endowment Deposit Receipt.
