Re: Aura Circle CT 03-10 Application for Time Extension
Dear Ms. Harker,
I am writing to request a time extension for the subject project. Aura Circle subdivides 15.02 acres into
nine residential lots and two open space lots on property generally located west of Kelly Drive and
north of Hillside Drive at the terminus of Aura Circle. The time extension would apply to the following
development permits: Coastal Development, Habitat Management, Hillside Development, Site
Development, and Tentative Tract Map (Major Subdivision).
We are requesting the time extension for the following reasons: update the Land Use Engineering
requirements for the new storm water requirements that affect the grading plans, improvement plans,
landscape plans, and final map; finalize the Preserve Management Plan; finalize the various agreements;
obtain financing; and refine the architectural design of the single-family residential units.
The project is now subject to new storm water regulations, including hydromodification requirements.
The grading plans, improvement plans, and landscaping plans must be revised to accommodate the new
regulations. We revised the grading plans and landscape plans to be compliant with the new storm
water regulations. However, the limits of grading necessary to accommodate the biofrltration basin
extends beyond the limits of grading in the Tentative Tract Map. We are working with Land
Development Engineering and Planning to redesign the grading such that a Consistency Determination
can be made. The revised grading, improvement plans and landscape plans have been revised but cannot
be revised, reviewed and approved before the current permits expire in May 2018.
We need additional time to revise the Covenants, Conditions, & Restrictions (CC&Rs); Open Space
Ownership, Management and Funding Agreement; Affordable Housing Agreement; and other
agreements and documents. Additionally, we are working on a financing package that will include the
completion of all consultants related services, development and permit fees, endowment capitalization,
grading, improvements, building permits, vertical construction, and debt service.
Additionally, the Preserve Management Plan (PMP) has been revised to incorporate the approved
Property Analysis Record (PAR). The PMP cannot be reviewed and approved before the current permits
expire. The process to revise and approve the PAR in addition to identifying the appropriate partners
for the preserve management and endowment delayed preparing the revised PMP. We need additional
time to get the PMP approved.

Finally, the time extension would allow us to refine the architectural design to incorporate current
features that homebuyers desire. The design refinements would also incorporate EcoWise technology
and features that improve the homes sustainability and increase affordability. We would like the time
complete a detailed market study to determine if there are any opportunities to satisfy unmet needs in
any market segments.
