space/recreation/private driveway lots on property generally located on the west
side of Donna Drive and north of Carlsbad Village Drive within Local Facilities
Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 6452, 6453, and
6454 APPROVING a retroactive two year extension of Tentative Tract Map (CT 04-14(A)),
Hillside Development Permit (HDP 04-07), and Planned Development Permit (PUD 04-12)
based upon the findings and subject to the conditions contained therein.
II. INTRODUCTION
The applicant has requested a retroactive two year time extension of Tentative Tract Map (CT
04-14JA)), Hillside Development Permit (HDP 04-07), and Planned Development Permit (PUD
04-12) to grade and subdivide a 2.79 acre site into 14 residential lots and 3 open
space/recreation/private driveway lots in order to construct a residential twin-home development
project on property generally located on the west side of Donna Drive and north of Carlsbad
Village Drive within Local Facilities Management Zone 1.
The requested two year extension would allow the owner to preserve existing property
entitlements, while processing grading, improvement, and landscape plans, and a final map.
III. PROJECT DESCRIPTION AND BACKGROUND
The 2.79 acre project site is located on the west side of Donna Drive and north of Carlsbad
Village Drive, within Local Facilities Management Zone 1 in the northwest quadrant of the City.
The site is bordered on the north, south and west by existing single-family and multi-family
residential neighborhoods and on the east by a City of Carlsbad water tank.
On March 1, 2006 the Planning Commission conducted a public hearing for the project which
consisted of a Zone Change, Tentative Tract Map, Hillside Development Permit, and Planned
Development Permit. Staff recommended approval, finding the project consistent with the
General Plan, Hillside Development Ordinance and Guidelines, and the Planned Development
Ordinance. The Planning Commission discussed the merits of the application, and voted 4-1

(Baker-No, Segall Absent, and Heineman-Abstain) to approve the Trails End project, and to
recommend approval/adoption to the City Council for the associated Zone Change (ZC 04-10)
and Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program
(MMRP). Subsequently, on June 27, 2006, the City Council approved ZC 04-10 and adopted the
MND and MMRP.
On September 19, 2007 the Planning Commission conducted a public hearing to amend the
conditions of approval for CT 04-14 to allow the purchase of affordable housing credits to satisfy
the Inclusionary Housing Requirement for the project as an alternative to the construction of two
on-site attached townhome inclusionary units. Staff recommended approval of the revised
condition. The Planning Commission discussed the merits of the application, and voted 7-0 to
approveCT 04-14(A).
Planning Commission Resolution No. 6035, Condition No. 68, for CT 04-14 reads that the
tentative map shall expire twenty-four (24) months from the date the tentative map approval
becomes final. The final project approval date was June 27, 2006 and the project approvals
expired on June 27, 2008. However, the applicant made a timely filing for an extension of the
project on April 21, 2008, prior to expiration of the Tentative Map.
Staff has received the application and has scheduled the extension in accordance with Section
66452.6 of the Subdivision Map Act. Staff recommends that the Planning Commission approve
the requested two (2) year Tentative Map extension retroactively from June 27, 2008, resulting in
a new expiration date of June 27, 2010. Additionally, staff recommends that the Planning
Commission extend the Hillside Development Permit and Planned Development Permit
concurrently with the Tentative Map.
During staff review of the extension application, it was discovered that a typographical error had
been made on the project number for the associated Planned Development Permit (PUD). The
PUD was incorrectly referenced as PUD 04-10 throughout the documents and should have been
referenced as PUD 04-12. The correct project number is now referenced on the current
documents.
The developer cites several reasons for requesting a two-year extension to the tentative map.
Changes to the conditions of approval for the affordable housing requirement resulted in a delay
for submittal of a final map, grading, improvement, and landscape plans. Secondly, as a result of
the changing market demands, minor design modifications are being made to the housing
style/floor plans. The developer also indicated that obtaining funding for the development has
been difficult and that it could take over a year to obtain financing for the project. The
developers request for a two-year extension is included as Attachment 5 of the staff report.
IV. ANALYSIS
According to Section 20.12.110(a)(2) of the Carlsbad Municipal Code (CMC), no extension shall
be granted or conditionally granted unless the Planning Commission (or City Council on appeal)
finds:

1. That the design and improvements of the subdivision are consistent with the
General Plan, Titles 20 and 21, and any public facility or growth management
policies in existence at the time the extension is approved.
The project remains in compliance with the General Plan, current codes, policies and
Growth Management Ordinance requirements as conditioned.
2. That the subdivider is diligently pursuing those acts required to obtain a final map
for the subdivision.
A final map, grading, improvement and landscape plans are currently being prepared by
the developer. Delays in submitting these items were due to the fact that the developer
recently applied for an amendment to the conditions of approval to allow an alternative to
the construction of on-site inclusionary housing due to financial feasibility concerns; and
because the developer is proposing minor design modifications to the housing style/floor
plans due to changing market demands. These modifications have been submitted to the
Planning and Engineering departments and are currently under review through an
administrative Consistency Determination. Additionally, the developer states that
obtaining funding for the development has been difficult and the developer estimates that
it could take over a year to obtain financing for the substantial site grading and
improvements that are necessary for the project.
3. That all related permits or approvals issued pursuant to Title 21 have been extended
to expire concurrently with the Tentative Map.
A condition has been added establishing that Hillside Development Permit HDP 04-07x1
and Planned Development Permit PUD 04-12x1 will expire concurrently with the
Tentative Map.
4. That such permits and approvals as extended are consistent with the requirements
of Title 21 of this code at the time of the extension of the Tentative Map.
The project remains in compliance with current standards of Title 21.
The project remains in compliance with the General Plan, current codes, policies and Growth
Management Ordinance requirements as conditioned. The original conditions of approval
contained within City Council Resolution No. 2006-143, dated June 27, 2008, which
incorporates Planning Commission (PC) Resolutions No. 6035 (CT 04-14), 6036 (HDP 04-07),
and 6036 (PUD 04-10) [sic]; and PC Resolution No. 6329 (CT 04-14(A) are still applicable to
the project, and new conditions of approval have been added as follows:

reference and remain in effect.
3. This Tentative Map Extension is granted for a period of two (2) years
retroactively from June 27, 2008 through June 27, 2010, unless an extension
is approved pursuant to the Carlsbad Municipal Code.
New Conditions have been added to PC Resolution No. 6453 for HDP 04-07x1 as follows:
1. All the conditions contained in Planning Commission Resolution No. 6036
dated March 1, 2006, for HDP 04-07 are incorporated herein by reference
and remain in effect.
2. This approval shall become null and void upon the expiration of Tentative
Map CT 04-14(A)xl.
New Conditions have been added to PC Resolution No. 6454 for PUD 04-12x1 as follows:
1. All of the conditions contained in Planning Commission Resolution No. 6037
dated March 1, 2006, are incorporated herein by reference and remain in
effect with the exception that the all typographical errors referencing the
project number as PUD 04-10 shall be changed to reflect the correct project
number as PUD 04-12.
2. This approval shall become null and void upon the expiration of Tentative
Map CT 04-14(A)xl.
New engineering conditions were incorporated into the conditions of approval for CT 04-14(A)
on September 19, 2007 and no additional conditions are required with the request for a two-year
extension for CT 04-14.
V. ENVIRONMENTAL REVIEW
On June 27, 2006, the City Council adopted a Mitigated Negative Declaration and Mitigation
Monitoring and Reporting Program (City Council Resolution No. 2006-143) for the Trails End
project. Staff has reviewed the request for the Tentative Map, Hillside Development Permit and
Planned Development Permit extension and the Planning Director has determined that; the
project complies with and is within the scope of the prior environmental documents, the project
has no new significant environmental effect not analyzed in the prior Mitigated Negative
Declaration, and none of the circumstances requiring a subsequent Negative Declaration under
CEQA Guidelines Section 15162 exist. No further CEQA analysis or action is required.

Description and Justification
This 2.79 acre project is located west of Donna Drive and north of Carlsbad Village
Drive. It consists of a 17 lot subdivision with a total of 7 buildings with 14 multi-level
twin homes; and 3 commonly owned lots (which will be maintained by the Home Owners
Association), The tentative tract map was approved by the Planning Commission with a
a Hillside Development Permit and a Planned Development Permit, on March 1, 2006.
The City Council Approved the Zone Change on June 27,2006.
Soon after approval, it became apparent to the applicant, Luke Development, LLC. that
the deterioration of the real estate market and the economy were having at least three
significant effects:
1. Obtaining funding for the construction of the project was becoming more
difficult.
2. The spread between ihe allowable sales price of the affordable units on the
project had increased and construction of the affordable units on site had
become very impractical.
3. The housing market has changed enough so that the style and lloor phin
needed modifications. While these modifications are in substantial
conformance with the approved tract map, the revisions have impacted our
final engineering schedule.
Since the approval of the project, the applicant has had their Civil Engineer prepare final
engineering plans, including Grading Plans, Improvement Plans, Erosion Control Plans
as well as a Final Map.
In spite of the condition of the economy, it is anticipated that the final engineering plans
will be ready to submit in Summer of 2008, after making the design adjustments
mentioned in Hem 3, above.
In order to address the increasing disparity between costs and allowable sales prices for
the affordable units, Luke Development applied for a TM amendment in 2007 to allow
them to purchase 3 affordable housing credits within the Northwest Quadrant, as an
option to the requirement to deed restrict two affordable units onsitc. This should
increase flexibility in providing tor affordable for sale units.
Due to the condition of the housing market, the applicant anticipates that it could take
over a year to obtain financing for the substantial site grading and improvement!? that are
necessary for this project. For this reason, Luke Development is requesting a 2 year
extension to the Tentative Map and related entitlements.
The granting of this application will allow time for the applicant to preserve their existing
entitlements and process the final engineering documents for ihe project.
