An enforcement action based on the exercise of a governmental pollee power not covered by Covered Risk 5 if a notice of the enforcement action, describing any part of the Land, is recorded In the Public Records, but only to 1t1e extent of the enforcement referred to in that notice. 7. The exercise of the rights of eminent domain If a notice of the exercise, describing any part of 1f1e Land, is recorded in the Public Records. 3. Any taking by a governmental body that has occurred and is binding on the rights of a purchaser for value without Knowledge. 9. Title being vested other than as stated In Schedule A or being defective (a) as a result of the avoidance In whole or in part, or from a court order providing an alternative remedy, of a transfer of aU or any part of the title to or any Interest in the Land occurring prior to the transaction vesting Title as shown In Schedule A because that prior transfer constituted a fraudulent or preferential transfer under federal bankruptcy, state insolvency, or similar creditors' rights laws; or (b) because the instrument of transfer vesting Title as shown in Schedule A constitutes a preferential transfer under federal bankruptcy, state insolvency, or similar creditors' rights taws by reason of the failure of Its recording In the Public Records (I) to be timely, or (II) to impart notice of Its existence to a purchaser for value or to a judgment or lien creditor. 10. (a) Any law, ordinance, permit, or governmental regulation (including those relating to building and zoning) restricting, regulating, prohibiting, or relating to (i} the occupancy, use, or enjoyment of the Land; (il) the character, dimensions, or location of any Improvement erected on the Land; (ill) the subdMslon of land; or {lv) environmental protection; or the effect of any violation of these laws, ordinances, or governmental regulations. This Exclusion l(a) does not modifY or limit the coverage provided under Covered Rlsk 5. (b) Any governmental police power. This Exdusion l(b) does not modifY or limit the coverage provided under Covered Rlsk 6. 2. Rights of eminent domain. This Exclusion does not modify or Dmit the coverage provided under Covered Rlsk 7 or 8. 3. Defects, liens, enaJmbrances, adverse daims, or other matters (a) created, suffered, assumed, or agreed to by the Insured Oaimant; (b) not Known to the Company, not recorded In the Public Records at Date of Polley, but Known to the Insured Claimant and not disclosed in writing to the Company by the Insured Claimant prior to the date the Insured Calmant became an Insured under this policy; (c) resulting in no loss or damage to the Insured Claimant; (d) attaching or created subsequent to Date of Policy (however, this does not modifY or limit the coverage provided under Covered Risks 9 and 10); or {e) resulting In loss or damage that would not have been sustained if the Insured Claimant had paid value for the Title. 4. Any claim, by reason of the operation of federal bankruptcy, state Insolvency, or similar creditors' rights laws, that the transaction vesting the Title as shown in Schedule A, is (a) a fraudulent conveyance or fraudulent transfer; or (b) a preferential transfer for any reason not stated in Covered Risk 9 of this policy. 5. Any lien on the Title for real estate taxes or assessments Imposed by governmental authority and created or attaching between Date of Policy and the date of recording of the deed or other instrument of transfer in the Public Records that vests Title as shown In Schedule A. CONDI110NS 1. DEfiNITION Of TERMS The following terms when used in this policy mean: (a) "Amount of Insurance": The amount stated In Schedule A, as may be increased or decreased by endorsement to this policy, Increased by Section 8(b), or decreased by Sections 10 and 11 of these Conditions. {b) "Date of Polley": The date designated as "Date of Polley" in Schedule A. (c) "Entity•: A corporation, partnership, trust, limited liability company, or other similar legal entity. (d) "Insured": The Insured named in Schedule A. (I) The term "Insured" also includes (A) successors to the Title of the Insured by operation of law as distinguished from purchase, Including heirs, devisees, survivors, personal representatives or next of kin; (B) successors to an Insured by d'ISSOiutial, merger, consolidation, distribution, or reorganizatioo; {C) successors to an Insured by its conversion to another klnd of Entity; (D) a grantee of an Insured under a deed delivered without payment of actual valuable consideration conveying the Title (1) if the stock. shares, membershipS, or other equity Interests of the grantee are whoRy-owned by the named Insured, (2) if the grantee whoRy owns the named Insured, (3) if the grantee Is wholly-owned by an affiliated Entity of the named Insured, provided the affiliated Entity and the named Insured are both wholly-owned by the same person or Entity, or ( 4) if the grantee is a trustee or beneficiary of a trust created by a written instrument established by the Insured named In Schedule A for estate planning purposes. Policy Page 2 Polley Number: 523626 (ii) With regard to (A), (B), {C), and {D) reserving, however, all rights and defenses as to any successor that the Company would have had against any predecessor Insured. (e) "Insured Calmant": All Insured claiming loss or damage. (f} "Knowledge" or "Known": Actual knowledge, not constructive knowledge or notice that may be imputed to an Insured by reason of the Public Records or any other records that impart constructive notice of matters affecting the Title. (g) "Land": The land described in Schedule A, and affixed Improvements that by law constitute real property. The term "Land" does not indude any property beyond the lines of the area described in Schedule A, nor any right, title, interest, estate, or easement in abutting streets, roads, avenues, alleys, lanes, ways, or watsways, but this does not modifY or limit the extent that a right of access to and trom the Land is insured by this policy. (h) "Mortgage": Mortgage, deed of trust, trust deed, or other security instrument, inducling one evidenced by electronic means authorized by law. (i) "Public Records": Records established under state statutes at Date of Policy for the purpose of imparting constructive notice of matters relating to real property to purchasers for value and without Knowledge. With respect to Covered Risk S(d), "Public Records" shall also include environmental protection liens filed in the records of the clerk of the United States District Court for the district where the Land Is located. (j) 'Title": The estate or Interest described In Schedule A. (k) "llnmarlcetabie Title": Title affectecl by an alleged or apparent matter that would permit a prospective purchaser or lessee of the Title or lender on the Title to be released from the obligation to purchase, lease, or lend if there is a contractual condition requiring the delivery of marketable title. 2. CONnNUATION OF INSURANCE The coverage of this policy shall continue in force as of Date of Polley in favor of an Insured, but only so long as the Insured retains an estate or interest In the Land, or holds an obligation !i!!CI.II'ed by a purchase money Mortgage given by a purchaser from the Insured, or only so long as the Insured shaH have liability by reason of warranties In any transfer or c:onveyance of the Title. This policy shall not continue In force In favor of any purchaser from the Insured of either (i) an estate or interest in the Land, or (II) an obligation secured by a purchase money Mortgage given to the Insured. 3. NOTICE Of ClAIM TO llE GIVEN BY INSURED CLAIMANT The Insured shall notify the Company promptly in writing {i) In case of any litfgatlon as set forth in Section S(a) of these Conditions, (il) in case Knowledge shall come to an Insured hereunder of any dalm of title or Interest that Is adverse to the Title, as insured, and that might cause loss or damage for which the Company may be liable by virtue of this policy, or (iii) if the Title, as Insured, Is rejected as unmarketable Title. If the Company Is prejudiced by the failure of the Insured Claimant to provide prompt notice, the Company's liability to the Insured Calmant under the policy shall be reduced to the extent of the prejudice. 4. PROOf Of LOSS In the event the company is unable to detenmine the amount of loss or damage, the Company may, at its option, require as a condition of payment that the Insured Claimant furnish a signed proof of loss. The proof of loss must describe the defect, lien, encumbrance, or other matter Insured against by this policy that constitutes the basis of loss or damage and shall state, to the extent possible, the basis of calculating the amount of the loss or damage. 5. DEFENSE AND PROSECUTION OF AcnONS (a) Upon written request by the Insured, and subject to the options contained in Section 7 of these Conditions, the company, at its own cost and without unreasonable cletay, shall provide for the defense of an Insured in litfgatlon In which any third party asserts a claim covered by this policy adverse to the Insured. This obligation is limited to only those stated causes of action alleging matters insured agalnst by this policy. The Company shall have the right to select counsel of its choice (subject to the right of the Insured to object for reasonable cause) to represent the Insured as to those stated causes of action. It shall not be liable for and will not pay the fees of any other counsel. The Company will not pay any fees, costs, or expenses incurred by the Insured in the defense of those causes of action that allege matters not insured against by this policy. (b) The Company shall have the right, in addition to the options contained in First American Tttle Insurance Company Form No. 1402.06 ALTA OWoer's Polley (6-17-06) Section 7 of these Conditions, at its own cost, to institute and prosecute any action or proceeding or to do any otner act that In its opinion may be necessary Qr desirable to establish the Title, as insured, or to prevent or reduce los$ or damage to the Insured. 'The Company may take any appropriate action under the terms of this policy, wheltler or not It shall be liable to the Insured. The exercise of these rights shall not be an admission of liability or waiver of any provision of this policy. If the Company exerdses Its rights under this subsection, It must do so diligently. (c) Whenever the Company brings an action or asserts a defense as required or permitted by this policy, the Company may pursue the litigation to a final determination by a court of competent jurisdiction, and It expressly reserves the right, in Its sole discretion, to appeal any adverse judgment ororder. · 6. DUlY OF INSURED CLAIMANT TO COOPERATE (a) In all ~ where thiS policy permits or requireS the Company to prosecute or provide for the defense of any action or proceeding and any appeals, the Insured shaH secure to the Company the right to so prosecute or provide defense in the action or proceeding, including the right to use, at its option, the name of the Insured for this purpose. Whenever requested by the Company, the Insured, at the Company's expense, shall give the Company all reasonable aid (I) In securing evidence, obtaining witnesses, prosecuting or defending the action or proceeding, or effecting settlement, and (H) in any other lawful act that in the opinion of the Company may be necessary or desirable to establish the 11tle or any otner matter as insured. If the Company Is prejudiced by the failure of the Insured to furnish the required cooperation, the Company's obligations to the Insured under the policy shall terminate, induding any liabiUty or obligation to defend, prosecute, or continUe any litigation, with regard to the matter or matters requiring such cooperation. (b) 'The Company may reasonably require the Insured Calmant to submit to examination under oath by any authorized representative of the Company and to produce for examination, inspection, and copying, at such reasonable times and places as may be designated by the authorized representative of the Company, all records, In whatever medium maintained, indudlng books, ledgers, checks, memoranda, correspondence, reports, e-mails, disks, tapes, and videos whether bearing a date before or after Date of Polley, that reasonably pertain 10 the loss or damage. Further, if requested by any authorized representative of the Company, the Insured Oaimant shall grant Its permission, in writing, for any authorized representative of the Company to exam~, inspect. and copy an of these records In the custody or control of a third party that reasonably pertain to the loss or damage. All Information designated as confidential by ltle Insured Claimant provided to the Company pursuant to thiS Section shall not be disclosed 10 others unless, In the reasonable judgment of the Company, it is necessary in the administration of the claim. Failure of the Insured Claimant to submit for examination under oath, produce any reasonably requested information, or grant permission to secure reasonably necessary information from third parties as required in this subsection, unless prohibited by law or governmental regulation, shall terminate any liability of the Company under this policy as to that claim. 7. OPTIONS TO PAY OR OTHERWISE SETTLE CLAIMS~ TERMINAllON OF LIABILITY In case of a claim under this policy, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Insurance. To pay or tender payment ot the Amount of Insurance under this policy together With any costs, attumeys' fees, and expenses incurred by the Insured Calmant that were aultloriled by the Company up to the time of payment or tender of payment and that the Company is obligated to pay. Upon the exerdse by the Company of ltlis option, all liability and obligations of the Company to the Insured under this policy, other than 10 make the payment required in this subsection, shall terminate, including any liability or obligation to defend, prosecute, or continue any litigation. (b) To Pay or Otherwise Settle With Parties Other Than the Insured or With the Insured Claimant. (i) To pay or otherwise settle with otner parties for or in the name of an Insured Claimant any claim insured against under this policy. In addition, the Company will pay any costs, attorneys' fees, and expenses incurred by the Insured Claimant that were authorized by the Company up to the time of payment and that the Company is obligated to pay; or (ii) To pay or otherwise settle with the Insured Caimant the loss or damage provided ror under this policy, together with any costs, Polley Page 3 Polley Number: 523626 attorneys' fees, and expenses incurred by the Insured Claimant ltlat were authorized by the Company up to the time of payment and that the Company is obligated to pay. Upon the exercise by the Company of either of the options provided for in subsections (b)(i) or (II), the Company's obligations to the Insured under this policy for the claimed loss or damage, other than the payments required to be made, shall terminate, lnduding any liability or obligation to defend, prosecute, or continue any litigation. 8. DETERMINAllON AND EXTENT OF LIABILITY This policy is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Insured Caimant who has suffered loss or damage by reason of matters insured against by this policy. (a) 'The extent of liability of the Company for loss or damage under this policy shall not exceed the lesser of (i) the Amount of Insurance; or (il) the difference between the valle of the Title as Insured and the value of the Title subject to the risk Insured against by this policy. The purpose of this document is to safeguard property and public welfare by regulating and reviewing the design, construction, quality of materials, use and occupancy, location, and maintenance of all buildings and structures. The standards used in this document represent model international standards. Crime Prevention through Environmental Design The proper design and effective use of the built environment can lead to a reduction in the fear and incidence of crime and an improvement in the quality of life. The proper design influences this by positively affecting human behavior. The design includes the physical environment, the planned behavior of people, the productive use of space and an effective crime/loss prevention program. Natural Surveillance 1) Place and design physical features to maximize visibility. This will include building orientation, windows, entrances, walkways, landscape trees and shrubs, fences and any other physical obstruction. 2) Design the placement of persons, common areas or activities to maximize surveillance possibilities. 3) Design lighting that provides for appropriate nighttime illumination of walkways, entrances and driveways. Natural Access Control 1) Use walkways, pavement, lighting and landscaping to clearly guide guests to and from selected entrances. 2) Use real or symbolic barriers like fences or landscaping to prevent and or discourage access to or from dark and or unmonitored areas. 3) Used managed access on common doors and elevators. Provisions for territorial reinforcement 1) Use pavement treatments, landscaping and fences to define and outline ownership or property. Show clean transformation between public and private space. This requirement applies to defined recessed areas that are within 6 feet of the edge of designated walking surface with an unobstructed pathway to it, not hindered by walls or hedgerow landscaping a minimum of two feet in height. 5) Protect accessible luminaries with vandal resistant light fixtures when they are not less than three feet in height from the walking surface when used to illuminate walkways and a minimum of 78 inches in height above the driving surface when illuminating surfaces associated with vehicles. Light fixtures shall be deemed accessible if mounted within 15 feet vertically or 6 feet horizontally from any accessible surface or any adjoining roof, balcony, landing, stair tread platform or similar structure. Landscaping 1) Plan a landscaping design that enhanced surveillance and security. 2) Tree canopies should be no lower than six (6) feet and should not allow access to roofs or balconies. 3) Ensure landscaping plan does not deter from lighting and addressing. 4) Plant only low profile shrubs that can be maintained below two (2) feet. 5) Use security plants where necessary to prevent entering and tampering. 6) Install walls and fences that are see-through and enhance surveillance. 7) Install gates that allow surveillance. 8) Keep entranceways clear of clutter. Addressing 1) Locate numerals where they are clearly visible from the front street. 2) Contrast the numeral's color to the background on which it is affixed. 3) Numerals shall be no less than four (4) inches in height and illuminated during the hours of darkness. 4) There should be positioned at each entrance of a multiple family dwelling complex with more than four buildings, an illuminated diagrammatic representation of the complex, which depicts the location of the viewer and the unit designations within the complex. It should be lighted during the hours of darkness. Parking Lighting 1) Lighting is the most important security feature in a parking facility. 2) Ensure lighting is uniform lighting the edges of parking stalls, storage unit and drive. 3) Use 2 foot-candles as the minimum illuminance in any one point. 4) Position lights over vehicles or near beams rather than in drive aisles to reduce glare. Or choose fixtures with built in shields to reduce glare. Elevators 1) Elevator cabs with interiors that are not completely visible when the door is open from a point centered on and 36 inches away from the door, shall have shatter resistant mirrors or other equally reflective material so placed as to make visible the entire elevator cab from this point. 2) Illuminate the elevator cab at all times with a minimum maintained two foot-candles of light at floor level. 3) Used managed access on elevator doors. A fee has been established and published in the Fee Schedule to be paid at building permit issuance to meet that goal. Bridge & Thoroughfare Fee: The purpose of this fee is to provide fees as a condition of approval of a final map, parcel map or as a condition of issuing a building permit for the purpose of defraying the actual o~ estimated costs of constructing bridges or major thoroughfares pursuant to Section 66484 of the Subdivision Map Act. Building Permit: Building permit fees for building construction projects are collected to cover the costs of permit applications, the issuance of the permits, and required onsite inspections. Community Facilities District (CFD) Fee: A Community Facilities District may be used to fund, through debt financing or available cash balances, a wide variety of public facilities. The philosophy in Carlsbad is that this CFD should be used to finance facilities that are city-wide in both obligation and benefit. The CFD is not intended to relieve any developer of the private obligation to provide funding for infrastructure improvements related to development. The facilities financed by the CFD would have eventually been funded under the existing fee programs, however, the timing of these improvements generally would have been later than can be accomplished with the CFD. Because CFD taxes fund a portion of the City's current fee programs, a property within the CFD will pay reduced development fees. Drainage Fee: Prior to filing of any final map or parcel map, the subdivider shall pay or cause to be paid any fees for defraying the actual or estimated costs of constructing planned drainage facilities for the removal of surface and storm waters from local or neighborhood drainage areas or sanitary sewer facilities for local sanitary sewer areas established pursuant to Section 66483 of the Subdivision Map Act. Payment of the fees for planned local drainage facilities shall conform with the requirements of Chapter 15.08 of the Municipal code and shall be paid prior to filing of the final or parcel map or issuance of building permits, whichever occurs first. Electrical Fee: Per the Carlsbad Municipal Code, the number of affected electrical items increases the fees charged within the building permit. These fees cover the inspection time required to verify compliance with current California building and local municipal codes. Green Building Fee: A fee to support development, adoption, publication, updating, and education efforts associated with green building standards as directed by the State of California Building Standards Commission. Habitat Management Plan (HMP) Fee: The HMP was adopted with the purpose of preserving sensitive habitat located throughout the City. Development of vacant underdeveloped property may incur a fee to offset the cost of acquisition and preservation of the habitat. The requirement to pay the fee and the amount of the fee is determined by the existing condition of the property (developed or undeveloped) and the type of vegetation found on the property. Local Facilities Management Zone Fee (LFMZ): A local facilities management fee is established to pay for improvements or management plan which are related to new development within the zone and are not otherwise financed by any other fee, charge or tax on development, or are not installed by a developer as a condition of a building permit or development permit facilities identified in a local facilities Mechanical Fee: Per the Carlsbad Municipal Code, the number of affected mechanical items increases the fees charged within the building permit. These fees cover the additional inspection time required to verify compliance with current building and municipal codes. Meter Fee (lrr.) Size: Cost of meter for irrigation. Park in Lieu Fee: As a condition of approval of a final map or parcel map, the subdivider shall dedicate land, pay a fee in lieu thereof, or both, at the option of the city, for park or recreational purposes at the time and according to the standards and formula contained in this chapter. Plan Check Fee: The process by which the application, plans and specifications filed by an applicant for a permit are reviewed by the Building Official or his authorized representative to demonstrate conformance with current State and Municipal building codes. Plumbing Fee: Per the Carlsbad Municipal Code, the number of affected plumbing items increases the fees charged within the building permit. These fees cover the additional inspection time required to verify compliance with current building and municipal codes. Public Facilities Fee: The continued development of the city, with the consequent increase in population and in the use of public facilities, has imposed increased requirements for such facilities, including but not limited to parks, major streets, traffic signals, storm drains, bridges and public buildings (such as fire stations, police facilities, maintenance facilities, libraries and general offices). The necessity for such facilities results from new construction. Residential Fire Sprinklers: With the adoption of the California 2010 Residential Building Code, fire sprinklers became mandatory in all new single family or duplex homes. This fee covers the plan review and site inspection of the installed fire sprinklers. Sewer Benefit Fee: Concurrently with the issuance of a valid building permit for a new structure or with the issuance of a move-on permit for a mobile home, upon application and payment of the required fees, a sewer permit may be issued by the utilities director authorizing connection of the structure for which the building permit has been issued or the mobile home for which the move-on permit has been issued to the sewer system. A sewer permit shall be required for any structure which is altered, remodeled or expanded where such alteration, remodeling or expansion results in an increase in the equivalent dwelling units of sewage generated from such structure. At the time of issuance of a valid building permit or plumbing permit for such alteration, remodeling or expansion, upon application and payment of the required fee, a sewer permit may be issued by the utilities director, authorizing the connection of the structure for which the building permit has been issued to the sewer system. If the structure being altered, remodeled or expanded is already connected to the city sewer system, and a new connection is not required, the sewer permit shall authorize the use of the sewer system by the altered, remodeled or expanded structure. Sewer Connection Fee: Permits for the connection of an existing structure to the sewer system may be issued by the utilities director at any time upon proper application. Every sewer permit issued pursuant to this subsection shall expire by limitation and become null and void if work on the connection authorized by such permit is not completed within one hundred twenty days from the date of issuance of such permit. Storm Water Permit Fee: This fee funds the review and enforcement of measures to prevent the introduction of materials and soil into the storm water system during the construction process. Strong Motion Fee: Assists in the funding of seismic research and instrumentation as directed by the State of California, Resources Agency, Department of Conservation, Division of Mines and Geology. Traffic Impact Fee: This imposes a fee to pay for various traffic circulation improvements within the city. The amount of the fee is based on a traffic engineering analysis and has been calculated to be equal to or less than the cost of the circulation improvements. Village Parking Fee: On a case-by-case basis, development within the Village Review Area may satisfy all or a portion of the associated parking space demand through the payment of an in-lieu fee. The proposed condominium ownership project is being reviewed pursuant to the Planned Development Ordinance and therefore must comply with the Planned Development standards contained with Chapter 21.45 of the Carlsbad Municipal Code. More specifically, the project must demonstrate compliance with both Tables "C" (CMC Section 21.45.060) and "E" (CMC Section 21.45.080) of the Planned Development Ordinance. Please fill out the attached tables to help staff determine compliance with the Planned Development standards. The tables can also be sent electronically if requested. 2. Pursuant to the City's lnclusionary Housing Ordinance, Chapter 21.85.030 of the CMC, 15% of the total units approved shall be constructed and restricted both as to occupancy and affordability to lower-income households. Accordingly, for this conversion of apartments to condominiums project which includes 19 market rate DUs, three inclusionary DUs are required. However, pursuant to Chapter 21.85.070 of the Carlsbad Municipal Code, alternatives to the construction of inclusionary units may be approved at the sole discretion of the City Council.
