This preliminary report will be discussed by staff at the Development Coordinating Committee (DCC) meeting which will be held on May 12, 2014. A 24 foot wide, with vertical clearance "clear-to-the-sky", fire access road in accordance with Carlsbad Municipal Code 17.04.010 shall be provided or alternatively a 20 foot wide, with vertical clearance "clear-to-the-sky" fire access road in conjunction with a NFPA 13 fire sprinkler system throughout the project shall be provided. 2. The drive aisle shall be designated as a fire lane and it shall become the responsibility of the developer to have the fire access road restrictions recorded and that the owner is responsible to maintain the fire road access and enforce the recorded fire road access restrictions. 3. The proposed site layout provides limited available areas for stormwater facilities. Address the existing slope failure due to erosion identified in the soils report by Allied Earth Technology dated October 10, 2013. Show how the drainage from the existing 70 feet high slope along the rear, southeast boundary of the property is captured and controlled. Based on the proposed site plan, it appears that the drainage from the existing 70 feet high slope has been diverted and discharged in a concentrated manner directly into the adjacent property using the proposed swale behind the proposed retaining wall. Diversion of drainage and discharge of concentrated drainage into the adjacent property is not allowed. Please revise. 5. However, a minimum 24 foot depth is required in front of each garage to provide adequate back-up/maneuvering area and additional width may also be required for vehicle/emergency vehicle maneuvering area. A minimum 24 foot width is therefore required. 2. Cantilevered projections into the required 24 foot wide drive aisle are limited to unenclosed and uncovered balconies and decks if, in addition, all Fire and/or Engineering Department requirements are met. The third floor enclosed habitable areas may not cantilever into the required 24 foot drive aisle width. 3. The unenclosed and uncovered balcony on the northwest side of unit No. 5 may only encroach into the front yard setback up to two feet. 4. The project must be reviewed by the Housing Policy Team to determine the appropriate method of satisfying the Inclusionary Housing Ordinance. Engineering: 1. Provide a vehicular turn-around at the end of the driveway to preclude vehicles backing onto a public street (see Engineering Standard Chapter 4.1.B). The engineering department is recommending that the project be approved, subject to the following conditions: Engineering Conditions NOTE: Unless specifically stated in the condition, all of the following conditions, upon the approval of this proposed subdivision, must be met prior to approval of a final map, building or grading permit whichever occurs first. General 1. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, developer shall apply for and obtain approval from, the city engineer for the proposed haul route. 2. Based upon a review ofthe proposed grading and the grading quantities shown on the site plan, a grading permit for this project is required. Developer shall prepare and submit plans and technical studies/reports for city engineer review, post security and pay all applicable grading plan review and permit fees per the city's latest fee schedule. 12. Developer shall comply with the city's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution control practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution Page 2 of 15 prevention and educational practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable. Developer shall notify prospective owners and tenants of the above requirements. 13. Developer shall complete and submit to the city engineer a Project Threat Assessment Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF, developer shall also submit the appropriate Tier level Storm Water Compliance form and appropriate Tier level Storm Water Pollution Prevention Plan (SWPPP) as determined by the completed PTAF all to the satisfaction of the city engineer. Developer shall pay all applicable SWPPP plan review and inspection fees per the city's latest fee schedule. 14. Developer is responsible to ensure that all final design plans (grading plans, improvement plans, landscape plans, building plans, etc) incorporate all source control, site design, and Low Impact Design (LID) facilities. 15. Developer acknowledges the upcoming City of Carlsbad BMP Design Manual pursuant to provision E.3.d of the new California Regional Water Quality Control Board (RWQCB) Order No. R9-2013-001 adopted on June 27, 2013. During final design, developer shall demonstrate compliance with latest storm water requirements to the satisfaction ofthe city engineer. 16. Developer shall incorporate measures with this project to comply with Standard Stormwater Requirements per the city's Standard Urban Stormwater Management Plan (SUSMP). Developer shall design the private drainage systems, as shown on the tentative map to the satisfaction of the city engineer. All private drainage systems (12" diameter storm drain and larger) shall be inspected by the city. Developer shall pay the standard improvement plan check and inspection fees for private drainage systems. 18. Developer shall design all proposed public improvements including but not limited to driveways, water services/meters, curb drains, etc. as shown on the tentative map/site plan. These improvements shall be shown on one ofthe following, subject to city engineer approval: A. Grading plans processed in conjunction with this project; or B. Developer shall pay plan check and inspection fees using improvement valuations in accordance with the city's current fee schedule. Developer shall apply for and obtain a right-of-way permit prior to performing work in the city right-of-way. Non-Mapping Notes 20. Add the following notes to the final map as non-mapping data: A. Developer has executed a city standard Subdivision Improvement Agreement and has posted security in accordance with C.M.C. Section 20.16.070 to install public improvements shown on the tentative map. These improvements include, but are not limited to water services/meters, driveways and curb drains. B. Building permits will not be issued for development of the subject property unless the appropriate agency determines that sewer and water facilities are available. C. Utilities 21. Developer shall meet with the fire marshal to determine if fire protection measures (fire flows, fire hydrant locations, building sprinklers) are required to serve the project. Fire hydrants, if proposed, shall be considered public improvements and shall Page 4 of 15 be served by public water mains to the satisfaction ofthe district engineer. 22. Developer shall design and construct public facilities within public right-of-way or within minimum 20-foot wide easements granted to the district or the City of Carlsbad. At the discretion ofthe district or city engineer, wider easements may be required for adequate maintenance, access and/or joint utility purposes. 23. Prior to issuance of building permits, developer shall pay all fees, deposits, and charges for connection to public facilities. 24. Developer shall install or post security for potable water services and meters at locations approved by the district engineer. Depending on the results of the BMP sizing calculations, it may be necessary to revise the site design to provide adequate stormwater facilities to comply with the City of Carlsbad storm water requirements.
