LOCATION AND SIZE: Within the City of Carlsbad, located east of La Portolada Drive and north of the extension of Tamarack Avenue. This is the second and last of a two phase project and consists of approximately 15.42 acres divided into 54 residential lots or parcels in addition to the common area which consists of Lots 91 and 92, to be improved with only slopes and recreational Lot 20 of Phase I, on which community facilities consisting of a 30 X 60 sports court, which may -2- of 6 pages FILE NO. 39647 I . be used as a paddle tennis court, volleyball court and a children's jungle gym with sand box and common area landscaping have been constructed. The first phase of this project consists of approximately 6.25 acres divided into 33 lots or parcels in addition to the common areas which consist of Lots 35 and 36, im- proved with only slopes and a recreational Lot 20. Phases I and II purchasers will share the common areas and facilities. NOTE: The first phase of this project is not covered by this Report. Completion of Common Areas. Purchase escrow instructions to be used in selling units in this project provide, among other things, the following: No purchase escrow to close until all common facilities, improvements, land- scaping and all structures, including a total of 33 Phase I residential units in Carlsbad Tract 75-2, have been completed and a Notice of Completion (as defined in Civil Code Section 3093) covering all the foregoing units, and im- provements has been recorded. The statutory period for recordation of all project mechanics lien claims has expired, or the unit purchaser is provided a policy of title insurance with an endorsement insuring the purchaser against unrecorded mechanics liens. MANAGEMENT AND OPERATION: The Carlsbad Meadows Association, which you must join, manages and operates the common area(s) in accordance with the Restrictions, Articles of Incorporation and the Bylaws. MAINTENANCE AND OPERATIONAL EXPENSES: The subdivider has submitted a Phase II budget for the maintenance and operation of the common areas. You should obtain a copy of this budget from the subdivider. Under this budget, the monthly assessment against each Phase II subdivision lot will be $19.54, of which amount $2.15 is for reserves for major repairs and replacements. IF THE BUDGET FURNISHED TO YOU BY THE DEVELOPER SHOWS A MONTHLY ASSESSMENT FIGURE WHICH VARIES 10% OR MORE FROM THE ASSESSMENT AMOUNT SHOWN IN THIS PUBLIC REPORT, YOU SHOULD CONTACT THE DEPARTMENT OF REAL ESTATE BEFORE EN- TERING INTO AN AGREEMENT TO PURCHASE. The remedies available to the association against owners who are delinquent in the payment of assessments are set forth in the CC&Rs. These remedies are available against the subdivider as well as against other owners. The subdivider has posted an assessment bond, in the amount of $6160, in escrow, at California First Bank, a corpo- ration, 200 "D" Street, Encinitas, California, as partial security for his obligation to pay these assessments. The governing body of the association should assure itself that the subdivider has satisfied his obligations to the association with respect to the payment of assessments before agreeing to a release or exoneration of the secu- rity. The subdivider should provide the owners' association a copy of the Assessment Bond and Statement of Compliance in accord with Regulation 2792.9. EASEMENTS: Easements for drainage over portions of Lot 1, City of Carlsbad water line and other purposes are shown on the title report and subdivision map 8584, recorded in the Office of the San Diego County Recorder, May 26, 1977, as File 77-205325. USES AND ZONING: The City of Carlsbad, Planning Department advises that this property is zoned P-C (Planned Community), all of the immediately adjacent properties are zoned P-C, R-1 (single family, minimum building site 10,000 square feet) and A-1(8) county territory (single family, minimum building site 8 acres). RESTRICTIONS: This subdivision is subject to restrictions recorded in the Office of the San Diego County Recorder, February 16, 1977, as File 77-058673 and Phase II Annexation Restrictions on June 19, 1977, as File 77-228801, which include, among others, the following: No livestock, poultry or animals of any nature shall be raised, bred or kept in any lot, except caged birds, and not exceeding two (2) domesticated household pets (such as dogs or cats), may be kept in a lot, provided they are not kept or maintained for any commercial purposes. Such household pets shall not be permitted in the common area, except as may be allowed by rules and regulation of the Board of Directors. No owner shall install or maintain any water softener which discharges effluent brines except those discharging said brine into sanitary sewer system. Each owner shall keep clean and in good condition and repair, the windows of his lot and shall not permit laundry or other unsightly items to extend from or hang over the windows or balcony, if any, of his lot. All draped windows shall have, facing the exterior, either draperies, drapery linings or casements of a neutral color approved by the Board of Directors. TAX ESTIMATES: If the subdivider is unable to give you the current tax information, you may approximate your taxes as follows: TAKE 250% OF THE SALES PRICE, DIVIDE BY 100, AND THEN MULTIPLY BY THE TOTAL TAX RATE. THE TAX RATE FOR THE 1976/77 FISCAL YEAR IS $10.627. THE TAX RATE AND ASSESSED VALUATION MAY CHANGE IN SUBSEQUENT YEARS. The subdivider's engineer advises that: There are no known active faults in this site or in the Carlsbad area. The closest active fault is the Elsinore Fault, which lies 35 to 40 miles to the northeast. The potentially active Rose Canyon Fault may exist several miles off shore in the Carlsbad area. Its presence is highly speculative. The source of greatest seismic risk is the Elsinore Fault, which is capable of producing a magnitude of 7.3 earthquake during the lifetime of this project. According to the "Generalized Lithology and Earthquake Damage Potential Map", prepared for San Diego County, this property is in the middle of five damage potential groups, which range from greatest to least on the basis of subsurface lithology. The earth- quake hazard for this site is not considered unusual for the Southern California area. FILLED GROUND: Some lots will contain filled ground varying to a maximum depth of 32.3 feet. These soils are to be properly compacted for the intended use under the super- vision of a state licensed engineer. SOIL CONDITIONS: An engineering report has been filed which indicates soil is expan- sive, and included in the report are certain recommendations relative to footings and slabs. Subdivider has certified that he will comply with the recommendations of the engineer, that the purchasers' funds will be impounded in escrow, and that no escrows will close until recommendations have been completed. O PUBLIC TRANSPORTATION: Regularly scheduled public transportation service is available approximately 2000 feet from the project to the corner of El Camino Real and Tamarack. SCHOOLS: The Carlsbad Unified School District advises that the location and distance from the most distant lot in the tract to the nearest schools serving this tract are as follows: Jefferson Elementary School (K-3), 3743 Jefferson Street, Carlsbad, California, approximately 2.92 miles; Pine Avenue Elementary School (4-6), 3333 Harding Street, Carlsbad, California, approximately 2.53 miles; Valley Junior High School (7-8), 1645 Magnolia Avenue, Carlsbad, California, approximately 1.70 miles; Carlsbad High School (9-12), 3557 Monroe Street, Carlsbad, California, approximately 1.42 miles. Junior high and high school students are within walking distance of the schools. Cur- rently, the school district is providing transportation to and from school to other kindergarten through 6th grade students who reside in this area at school district ex- pense. The school district cannot guarantee to continue to provide pupil transporta- tion beyond the 1976/77 school year. The school district administration estimates that upon completion of this development there may be as many as 46 to 49 school age students in residence attending Carlsbad schools. At present, the enrollment in the kindergarten-through-12th-grade schools is just within a few students of reaching full capacity on the standard September to June schedule. It is anticipated that by the time this development is completed, all schools will be over their student capacities and that schedules may have to be changed. In addition to the standard schools schedule from September through June, the district is also providing year-round schedules in some of its schools for the kindergarten- through-8th-grade students. The above school information is based upon current pupil population, established at- tendance areas and formulae for estimating future school attendance. As these condi- tions change, the accuracy of the information may be affected. NOTE: This school information was provided by the school district prior to issuance of the public report.
