The City of Carlsbad Planning Department would appreciate the

STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MP
CITY OF CARLSBAD
The Subdivision Map Act sets a fifty (50) day time restriction on
Planning Commission processing of Tentative Naps. This time limit
can only be extended by the mutual concurrance of the applicant and
the City. By accepting applications for tentative maps concurrently
with other applications; i.e., Environmental Assessment, Environ-
mental Impact Report, Condominium Plan, Planned Unit Development,
etc., the fifty (50) day time limit is often exceeded. If you
wish to have your application processed concurrently, this agree-
ment must be signed by the applicant or his agent. If you choose
not to sign the statement, the City will not accept your application
for the tentative map until all prior necessary entitlements have
been processed and approved.
The undersigned understands that the processing time required by
the City may exceed fifty (50) days, therefore the undersigned
agrees to extend the fifty (50) day processing limitation and
fully concurs with any extensions of time up to one year from
the date the application was accepted as complete, may be required
to properly review all of the applications.

You are hereby granted a coastal development permit. This permit is issucd after a duly he
public hearing before the Sari Diego Coast Regional Corrimission and after the Regional
Commission found that the proposed development is in conformity with the provisions of the
California Coastal Act of 1976 including the following:
1. That the development is in conformity with Chapter 3 of the California Coastal-
Act of 1976 (commencing with Public Resources Code, Section 30200)
2. That the permitted development will not prejudice the ability of any affected
local government to prepare a local coastal program that is in conformity with Chapter 3
of the California Coastal Act of 1976.
• 3. That if the development is located between the nearest public road and the sea or
shoreline of any body of water located within the coastal zone, that the development is
in conformity with the public access and public recreation policies of Chapter 3 of the
California Coastal Act of 1976 (Public Resources Code, Sections 30210 - 30224).
4. That there are no feasible alternatives ox' fasible mitigation measures, as pr-.
iiided in the California wironmental Quality Act, available which would substantially
lessen any significant -adverse impact that the development as finally proposed may have
on the environment.
This permit is limited to development described below and set forth in material on file wi
the.Reginal Comrnission.arid subject to the terms, conditions, and provisions hereinafter
stated: -
A. DEVELOPMENT: Subdivision of approx. 15 acres into 45 parcels and construction, of single-
family residences. Project would include constriction of roads and :in-
stallation. of utilities (water, sewer, electrical). 20,0(0 Cu yds. of
balanced cut-and-fill and 40,030 cu. yds. of inported fill would be required.
Project has previously been approved as F5595, June 1977. Revisions to
circulation system including Arenal Road have been made.

I. That the applicant agrees to adhere strictly to the current plans for the project
as approved by the Regional Commission.
2. That the applicant agrees to notify the Regional Commission (or State Commission
if there is no Regional Commission) of any changes in the project.
3. That the applicant will meet all the local code recuirements and ordinances, and
obtain all necessary permits from State and Federal Agencies.
4. That the applicant agrees to conform to the permit rules and regulations of the
California Coastal Commission.
5. That the applicant agrees that the Commission staff may make site inspections of
the project during construction and upon completion.
SPECIAL CONDITIONS:
Applicant agrees to comply with the conditions imposed by the City of Carlsbad in
approval of Tentative Map (CT 76-7) regarding landscaping and erosion and siltation
control. Any changes to the tentative map conditions shall require review by the
Executive Director.
Terms and Conditions are to run with ths land. These terms and conditions shall be per-
petual and it is the intention of the part..ics to bind all future owners and possessors
of the subject property to said terms and conditions.
C. STANDARD ?RCIISTOS: I) STRIgrCO.PLIANCE: permit-tee is under obligation to conform strictly to permit
under penalties established by California Coastal Act of 1976.
(2) TINKLY ITOP-ENT AND CO-if LEIOP: permittee shall commence development within
two years foflowing final approval of the project by the San Diego Coast
Regional Commission. Construction shall be pursued in a diligent manner and
completed within a reasonable period of time.
(3) REQUEST FOR EX'F1STOS: Permi&.tee may request an extension of time for the corn-
mencement of construction provided the request is applied for prior to expiration
of the permit.
(4) ASSIC-NABILITY OF PERMIT: This permit is not assignable unless the Permittee's
obligations under the permit are assumed by assignee in writing within one year,
and a copy of the required assumption agreement delivered to the Regional Commission
or State Commission if there is no Regional Commission.
(5) APPEAL: Unless appealed to the State Commission within ten (10) working days
filowing final. action by the San Diego Coast Regional Commission, all terms and
conditions shall be final.
(6) DISCLAIMER: The permit is in no way intended to effect the rights and obligations
tofore existing under private agreements nor to effect the existing regulations
of other public bodies.
(7) PERNTTTEE TO RETJRN COPY: This permit shall not be valid unless within ten (10)
- iRing a; Peimittee returns a signed copy acknowledging contents to San aLego
Coast Regional Commission.
