MEMORANDUM DATE: Septeml-jer 5, 1979 TC: Paul Bussey, City Manager FROM:. Jaraes C. Hagaman, Plann.ing Director SUBJECT: PUBLIC FACILITIES FINDING AND CONDITION On August 29, 1979, the City Council adopted a revised policy requiring discretionary projects to pay a public facilities fee. Prior to that, on August 22, 1979, the Planning Conimis- sion recommended approval of a tentative tract map and condo- minium permit (CT 79-7/ CP-10) for a project. The Planning Commission chose not to include the public facilities finding and condition that the City Council had been using because of the lack of any v/ritten City policy. In order to make the Planning Commission approval (Resolution No. 1544) consistent with the new Public Facilities Policy (Policy No. 17), the following changes must be made: 1. Finding 3)g), on page 3 of Planning Coimnissicn Resolution No. 1544 should be revised to read as follov/s: "At this time, the City Council is not prepared to find that all other public facilities necessary to serve this project will be available concurrent with need. The City Council has, by inclusion of an appropriate condition, required that the project contribute to the costs of such facilities. Since the development v/ill pay its proportionate share of the public facilities which it will require, the City Council is satisfied that the requirem.ents of the public facilities element of the general plan have been satisfied." 2. A condition-of-approval should be added as follows: "23) Prior to the issuance of building permits, the applicant shall pay a public facility fee as established in City Council Policy No. 17." The City Attorney explained modifications made to Ordinance 9531 in response to admiinistrativ- concerns and indicated the Ordinance as now presented met the requirements of the recent California Supreme Court decision. Council introduced the follox'jing Ordinance: ORDINANCE NO. 9531, AMENDING TITLE • 19, CHAPTER 19.04, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 19.04.055 AND BY THE AMENDMENT OF SECTIONS 19.04.130, 19.04.140, • 19.04.153, 19.04.185 AND 19.04.190 TO PROVIDE NOTICE AND HEARING RIGHTS TO AFFECTED PROPERTY OVJNERS IN CONNECTION WITH ENVIRONMENTAL REVIEW. Council adopted the following Ordinance: ORDINANCE NO. 9532, AMENDING CHAPTERS 20.12. 20.24 AND 20.40 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 20.12.080, 20.12.090 AND 20.40.050 AND BY THE ADDITION OF SECTION 20.24.115 AND SUBSECTION (E) TO SECTION 20.24.140 TO PROVIDE FOR NOTICE TO AFFECTED PROPERTY OWNERS IN REGARD TO APPROVAL OF CERTAIN PROJECTS PURSUANT TO THE SUBDIVISION MAP ACT. PUBLIC HEARINGS: 12. AB #5985 - TENTATIVE TRACT MAP AND CONDOMINIUM PERMIT FOR 39 DWELLING UNITS - CT 79-7/CP-10, APPLICANT: FRIES. The Assistant Planning Director gave a staff report with the aid of a transparency and wall maps depicting the location and features of the project in relation to General Plan Land Use and Condominium Ordinance criteria. Council expressed concerns relative to erosion problems associated with new development and inquired into provisions requiring the. developer to maintain landscaping for an extended period and insure against erosion. In response, the City Manager indicated staff would prepare a report addressing same. Vice-Mayor Skotnicki then opened the*matter for public testimony at 6:24 P.M. Council recognized Harry Fries, 34345 Via Fortuna, Capistrano Beach, CA., owner of the project, who referenced favorable results of an earlier similar project. Council directed the City Attorney to prepare documents necessary to approve CT 79-7 and CP-10, as per Planning Commission Resolution ISIo. 1544, with the inclusion of a finding that public facilities are not available and a condition setting the amount of the public facilities' fee. 13. AB #5986 - BUILDING HEIGHT IN RD-M ZONE ZCA-112, APPLICANT: CITY OF CARLSBAD. The staff report was given by the Planning Director who indicated the proposed amendment would conform building height in the RD-M Zone with that of all other zones. Vice-Mayor Skotnicki opened the public hearing at 6:30 P.M. Since no one desired to speak on the matter, the hearing was closed. Council introduced the following Ordinance: ORDINANCE NO. 9534, AMENDING TITLE '21, CHAPTER 21.24 OF THE CARLSBAD MUNICIPAL CODE BY THE A14ENDMENT OF SECTION 21.24.030, TG REVISE REGUIA- TIONS PERTAINING TO BUILDING HEIGHT IN THE RD-M ZONE. 14. AB #5987 - STORAGE OF RECREATIONAL VEHICLES IN SPECIFIED ZONES - ZCA-llO, APPLICANT: CITY OF CARLSBAD. A staff report was given by the Assistant Planning Director, essentially as contained in the August 22, 1979 report to the Planning Commission. Vice-Mayor Skotnicki opened the public hearing at 6:37 P.M. Council recognized Don Brown, 3135 Monroe Street, -Carlsbad, CA., representing the Carlsbad Chamber of Commerce. Mr. Brown indicated the Chamber receives many inquiries from the public regarding permitted RV parking and therefore appropriate zones were favored. Since no one else wishedto speak, Vice- Mayor Skotnicki closed the public hearing at 6:38 P.M. Council directed that the City Attorney pre- pare the necessary documents approving ZCA-llO as per Planning Commission ResolutionNo. 1545. CT 79-7/CP-lO, Harry Fries, tentative tract map and condominium permit for 39 condominium units in La Costa, The property is located on the southwest corner of El Fuerte and Santa Isabel Streets. THE PUBLIC HEARING OPENED AT 8:02 P.M. Brian Milich gave the staff presentation, recommending approval and noting several modifications to the staff report, dated August 22, 1979. Commissioner Rombotis asked the depth of the setbacks along the south property line. Staff responded that the setbacks would be 5' as required by the RD-M Zone and that staff would attempt to have auch measurements indicated on all plans in the future. Harry Fries, the applicant, indicated concurrence with the staff report. Commissioner Schick asked the applicant how the door into the garage was to open. Mr. Fries responded that the plans were in error and that the doors would be reversed and open into the units. The Reverand Frederick Flores, pastor of St. Elizabeth Seaton Catholic Church, 6678 Santa Isabel Street, expressed concern regarding the adequacy of parking facilities for the project. Staff replied that the Condominium Ordinance specifies 13 visitor parking spaces must be provided and the applicant has provided 9 on-street visitor parking spaces, in addition to 4 off-street spaces. Also it was noted that each unit has a two car garage with space for two additional cars on the driveway. THE PUBLIC HEARING CLOSED AT 8:10 P.M. Chairman L'Heureux indicated his dissatisfaction with the overall design of the project, citing lack of yards, small and dark alleys, poorly planned recreational facilities, and internal circulation problems. The Coimnission expressed a general concern regarding lack of policy guidance as to public facilities. It was generally agreed that in the absence of contrary evidence that public c PLANNING COMMISSION MINUTES August 22, 1979 A Page Five (5) . facilities are not available or will not be provided concurrent with need, or a clearly articulated City Council policy decision in this regards, the Planning Commission has no alternative but to assume that all public facilities will continue to be provided in the future as in the past. The Assistant City Attorney reminded the Commission that the Public Facilities Element of the General Plan mandates that the record must reflect specific evidence, provided by the applicant, indicating that such facilities are available or will be provided concurrent with need. Staff indicated that public facilities, and their fees will be discussed at the Council workshop meeting scheduled for August 29th and, hopefully, staff will have some information for the Commission in this regards at the next meeting. A motion was made recommending approval of CT 79-7/CP-lO in accordance with the findings and conditions as contained in the staff report, dated August 22, 197 9, and with the deletion of condition of approval #12, and the modification to reflect that water service will be provided by the San Marcos County Water District. At this time, we propose a minor amendment to the ordinance. This amendment would allow an Owner/Builder to furnish a Secured Agreement to the San Marcos Unified School District in lieu of paying these fees when building permits are approved and issued. Fees would then be payable when the Notice of Completion is recorded. •.s " We feel that this change is an opportunity for the City to assist in reducing the housing costs associated with municipal fees. Since almost all costs of con- struction are financed with construction loans, any funds not required during the ten to twelve months during which the project is being completed should help in reducing the builder's expense and the ultimate cost of housing to the buying public. We believe this change to be in the best interest of the general public, and that you, who formulate your city's policies, will want to initiate this ordinance change. FORM PLANNING 20 - February 1, 1979 STATEMENT OF AGREEMENT TENTATIVE SUBDIVISION MAP CITY OF CARLSBAD The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time restriction on Planning Commission processing of Tentative Maps and a thirty (30) day time limit for City Council action. These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applications for other approvals which are prerequisites to the map; i.e..
