RE: TEMPLIN HEIGHTS, UNIT NO. 3 (CT74-14A)
Your request of January 21, 1982 and its follow-up, letter of January 22,
1982 have been referred to staff to see if something could be done. I
think we can help solve your problem though not in the way you propose.

CT74-14A has received two extensions already. There is no way under City
ordinance or State Subdivision Map Act that you could get the time exten-
sion you need.
I have discussed, with Planning and Engineering, the possibility of your
filing for a new tentative tract on Unit 3. They indicate that the cost
would be about $850.00 ($750 for tentative map and $100 for an environmen-
tal assessment). The map, if submitted so as to conform with existing
Unit 3, could be approved with similar conditions. There would be no
conditions that wouldn't have been part of a time extension. This would
give you all the time you need. All your existing agreements could remain
Intact.
Please let us know if you wish to follow this course of action and we will
try to get your request on the earliest Planning Commission agenda possible.

Dear Mr. Beckman:
We have reviewed your letter of February 2, 1982 which considers
the alternative to a time extension of the tentative map for
Templin Heights Unit No. 3. We will certainly keep that option
open in order to reduce lost staff time in processing.
However, since the tentative map has now expired, the align-
ment of Elm Avenue south and east of Map 10128 (Quail Ridge)
becomes questionable. It is important to us that we be con-
sulted prior to any alignment adoptions for Elm Avenue in the
area that effects our parcel of land.
It was suggested by staff that an alignment study might be in
order for the remaining undedicated portion of Elm Avenue in
this area. McMillin Development, Inc. concurs with this
suggestion and would cooperate with staff on the study.

Because of the history that involves the expiration of
the Tentative Map, I am enclosing a copy of Mr. Beck-
man's letter of February 2, 1982 and my response dated
March 29, 1982.
Under the terms of Mr. BeckmanTs letter, the resubmittal
could be reinstated for the fixed fee with the minimum
amount of processing by City staff. It is our desire
to pursue this reinstatement immediately.

McMillin Development, Inc.
Our district has reviewed the proposed subdivision consisting
of 38 residential units generally located to the east of
Pontiac Drive on extended Victoria Avenue, as referenced
above, and has evaluated the impact of that project on the
facilities of this district.
The governing board wishes to advise the city officials and
the residents of Carlsbad that as residential units are added
to the community, it is likely that many classes in the
district will be crowded, resulting in possible impairment to
the educational and transportational services offered to the
students. It is also likely that school schedules may have to
be changed, resulting in an increase in the year-round pro-
gram, or double sessions, or both. However, the district is
able to assure you that school physical facilities will be
available concurrent with need for this development as it is
presently proposed.

Costa Real Municipal Water District
Mr. Chairman and Members of the Planning Commission:
The subject development is a resubmission of a previously approved tentative
subdivision known as Templin Heights Unit No. 3 (Carlsbad Tract No. 74-14).
At the time the original development was active, the Costa Real Municipal
Water District made extensive plans and entered into several contractual
agreements providing for the public water service for the entire Templin
Heights subdivision as well as construction of several offsite public water
system extensions. Accordingly, retail public water service to the proposed
development will be provided by the Costa Real Municipal Water District in
accordance with all of the contractual obligations that the District now has
with the development as well as the applicable rules of the Water District
and the laws of the State of California.
Accordingly, we offer for the consideration of the Planning Commission sev-
eral comments and recommendations with respect to your review of the subject
development:
1. In view of the complex contractual requirements between the development
and the District as well as the fact that both unit no. 1 and unit no.
2 of the Templin Heights development are already being provided with
water service by the Costa Real Municipal Water District, we recommend
that the Commission include in their resolution of approval, if such
is granted, that retail water service will be provided by the Costa
Real Municipal Water District.
2. The development project has completed all of its engineering construc-
tion drawings and has received approval by the District as part of the
formal approval of Templin Heights Unit No. 2. Accordingly, there
should also be included a requirement that all of the public water
system facilities of the proposed subdivision shall be constructed in
accordance with the previous approvals as well as all applicable re-
quirements for the new project.

Developer requested a 10 foot encroachment
into the open space easement on lots 231
through 244 from top of slope down the bank
into the open space easement for the purpose
of building non-covered assessory structures,
such as decks, and other recreational fac-
ilities. The guidelines for this encroach-
ment are to be covered in the C C & R's
for the subdivision.
Open Space Easement dedicated to the City
of Carlsbad on the final map. Developer
shall be responsible for the maintenance
of this area for a period of two (2) years
after completion of the grading or until
the last unit is sold. After that period,
the individual lot owner shall be responsible
for the maintenance of the open space ease-
ment. These requirements are to be stated
in the C C & R's. The Parks and Rec Depart-
ment will conduct an inspection to start
the two (2) year clock.

the administrative change is to coordinate
the accuracy of records between the Engineer-
ing Department and the Planning Department.
Page 6, Par. 32 Water Supply/Service This paragraph was
included by the City to assure the Developer
of water service to the subdivision regardless
of the outcome of the situation between the
City of Carlsbad and the Costa Real Municipal
Water District. The design of the water
system, the fees paid and the bond posted
at this time with Costa Real will be accept-
ed by the City, if the City prevails in
the situation of which entity provides the
water to Templin Heights Unit No. 3.
Pare 7, Par. 33,34,35 Delete these three (3) paragraphs since the
wording and implication applies to common
areas.
FIRE DEPARTMENT
Seven (7) additional requirements were imposed on the subdivision
by the City of Carlsbad, Fire Department (Watkins). See the
attached project conditions.

Dear Mr. Plender:
We wrote to you on February 18, 1977 concerning "the above-referenced
development advising you -that the letter from the school district
addressed to the Planning Commission dated September 10, 1974 was still
in effect. Since we sent you the letter, it has come to our attention
that the Planning Department is concerned as to whether or not there
should be an elementary school site located within the referenced
subdivision.
The District Superintendent and I have reviewed the district's
roaster<plan as related to the Templin Heights subdivision and have come
to the fallowing conclusion. It is our belief that an elementary school
site would best serve the district if it were located northerly from Elm
Avenue extension or possibly southerly on the ridge from the Templin
Heights tract. •
Therefore, you may be assured at this, time that the district does
not wish to locate an elementary school site within the Teraplin Heights
subdivision.
