Subject: Carlsbad Tract 82-17/PUD 46 -- Mandana Corporation
Costa Real Municipal Water District
Mr. Chairman and Members of the Planning Commission:
The subject tentative subdivision, "Carlsbad Ridge," is located within
the retail water service area of the Costa Real Municipal Water District
as set forth in Resolution No. 256. Public water service has been pro-
vided to the subject lands since the construction of our retail distri-
bution system in 1960. Under the terms and conditions of the "interim
agreement" between the City of Carlsbad and the Water District, retail
public water service will be provided to the entire area by the Costa
Real Municipal Water District.
We take this opportunity to present to your Commission the following
comments and recommendations with respect to the public water service
aspects of the proposed development:
1. The District operates and maintains our main pipeline connection
between our tranmission main in El Camino Real and our Squires
Dam facility by way of a 27-inch pipeline that traverses this
new development in a southwesterly to northeasterly direction.
The tentative map identifies a design of the street system so
that there will be a minimum impact upon our existing facilities
and it must be understood by all parties that in the event there
is any encroachment upon the right-of-way areas of the District,
it will be necessary for the development to obtain specific
approval for the utilization of the District's right-of-way.
2. The District has a currently adopted master plan for public
water service for the entire development area so that the new
subdivision will be required to adhere to all of the specific
requirements for public water system facilities that will be
applicable to the entire 195-acre area.

3. The development will be required to adhere to all of the rules
and regulations of the District with respect to public water
service to the individual lots as well as the entire complex
from the standpoint of common areas as well as the 9-hole golf
course.
4. The District currently has under evaluation a proposed master
plan for non-potable water service so that in the event the
proposed 9-hole golf course can utilize non-potable water for
supplementary purposes, the District will have the capability
to provide service at such time there is an overall master plan
adopted.
5. The development will be responsible for all of the financial
obligations with respect to the construction of all public water
system facilities as well as the District's expenses for the
project and all of the charges for meters, services and other
such expenses.
In the event the Planning Commission has any questions regarding the
public water service aspects of this proposed development, we would be
pleased to respond.

OFFSITE ROAD REQUIREMENT FOR CT 82-7 (MANDANA CORP.)
Effective January 1, 1983, the Subdivision Map Act contains a
bombshell. If the City approves a tentative map with offsite
road improvements, the final map cannot be held up due to the
failure of the developer to acquire the land. Instead, the
City must acquire the land! - Furthermore, if the City does
not acquire the land within 90 days, the requirement for the
developer to construct the offsite streets is deemed to be
waived. This appears to place an unreasonable burden on the
City.
Until the implications of the above are understood, I
recommend that CT 82-7 (Mandana) be placed on hold.

OFFSITE IMPROVEMENTS FOR SUBDIVISIONS
Effective January 1, 1983, are a number of new provisions in
the Subdivision flap Act that will affect the approval of
projects. Potentially, the most far-reaching one is a pro-
vision covering offsite improvement requirements.
It prohibits the City from refusing to approve a final map
because of a condition of approval that public, improvements
be made on land that neither the subdivision nor the City
owns. In such cases, the City could require the developer
to enter an agreement to complete the improvements at such
time as the City adquires the land and it requires the City
to acquire the land within 90 days of the final map approval
TBy negotiation or eminent domain). In the eveiTtfThe land
is not acquired within 90 days, the provision to require the
developer to construct the improvements is deemed to be
waived. The City could require the developer to pay;.;for the
costs of acquiring the land. , ' .
This is very significant to Carlsbad because we have had - and
continue to have - subdivision approval that require offsite
access across other people's property in order to serve the
project. With the one exception of Tamarack Avenue in Calavera
Hills, where the City used eminent domain proceedings, the
City has always left it to the developer to secure his offsite
roads. A major example of this is the Carlsbad Highlands
project. The developer, Mr. Barnes, is required to secure
dedication of portions of Cannon Road and College Boulevard
in order to gain access to El Camino Real.
We are currently reviewing a tentative map - CT 82-7 (Mandana) -
that is not adjacent to any public street. In order to develop
-this project, the developer must acquire land and construct at
at least two access roads across other people's property. These
other people will eventually develop their land but have no
proposals at this time.

As I read the new Subdivision Map Act requirement, the City
could become obligated to acquire the offsite road right-of-
way if this project is approved. Since the the adjacent
owners have no plans yet for development, locating the road
would be difficult or impossible and certainly subject to
very lengthy negotiations. Therefore, I am recommending to
Land Use Planning that the CT 82-7 (Mandana) project be held
up until the effects of this new regulation are understood.
It. will be important for us to get a clear understanding of
the meaning of this provision. The City Attorney's input
would be useful. This should be accomplished prior to the
Engineering Department recommending approval of any sub-
division with offsite road requirements.

Commission Meeting
Dear Don:
This letter is written in response to your question regarding the
scheduling of CT 82-(7 for a Planning Commission hearing. We
cannot schedule this item until the alignment of Los Monos Avenue
has been resolved. The Planning Commission hearing date for the
General Plan Circulation Element amendment to realign Los Monos
is scheduled for December 22, 1982. Assuming the planning
Commission approves the amendment on this date, the earliest it
can be heard by the City Council is January 18, 1983.
If the City Council approves the amendment on January 18,
CT 82-7 will be scheduled for the January 26, 1983 Planning
Commission meeting.
If you have any further questions, please call me at this
office.
