Please add or alter the following conditions to Planning Commission Resolution Number 3100:
1. Edit condition 48.
48. No grading permits shall be issued for this subdivision prior to the
recordation of the final map except as approved for model homes.
2. Revise condition 70 to reflect the following wording:
70. The subject property is within the boundaries of Assessment District No. 88-1
(Alga Road). Upon the subdivision of land within the district boundaries,
the subdivider may pass through assessments to subsequent owners only if
the subdivider has executed a Special Assessment District Pass-Through
Authorization Agreement. Said agreement contains provisions regarding
notice to potential buyer of the amount of the assessment and other
provisions and requires the subdivider to have each buyer receive and
execute a Notice of Assessment and an Option Agreement. In the event that
the subdivider does not execute the Authorization Agreement, the assessment
on the subject property must be paid off in full by the subdivider prior to
any subdivision of the land.
3. Add Condition 74(B)(4).
74 (B) (4) Phase 9, the final phase, shall consist of constructing residential units
in the model parking area.
4. The first phrase of 74(C) shall read:
"The two open space lots..."
5. Edit condition 74(D)(1).
74(D)(1) A common area in perpetuity as a covenant running with the land
over the areas shown as old Lot 3 and portions of Lots 15 and 19 on
the tentative map, for landscaping, maintenance and recreational

Remove condition 75 and add the following conditions:
1. The lot configurations as shown on the tentative map are specifically not
approved. This project shall have a total of eleven (11) lots. New Lot 1
shall be comprised of Lots 16 and 17. New Lot 2 shall be comprised of Lots
I, 2, 3 and 4. New Lot 3 shall be comprised of Lots 5, 6 and 7. New Lot 4
shall be comprised of Lots 8, 9 and 10. New Lot 5 shall be comprised of Lots
II, 12 and 13. New Lot 6 shall be comprised of Lots 14 and 15. New Lot
7 shall be comprised of Lot 18 and 19. New Lot 8 shall be comprised of Lots
20 and 21. Open space Lots 22, 23 and 24 shall be renumbered Lots 9, 10
and 11.
2. The phasing shall be consistent with the lot numbers except:
A. Phase 4 shall include the portion of Ardeola shown in Phase 5.
B. The landscaping for new Lot 9 (old Lot 22) shall be included no latter
than Phase 2.

Dear Ms. McCoy:
Thank you for your comments regarding street light spacing on Aviara Planning Area 5,
Unit 3. The placement of proposed street lights on the private street for Unit 3 has
been guided by the City of Carlsbad standards for public streets. Tanager Drive is a
cul-de-sac, having no outlet and serving 34 dwelling units. According to the public
design standards enclosed, standards would dictate a street light at the intersection of
the street, at the end of the street, and at midblock if the street is over 300 feet in
length. Tanager is approximately 600 feet long. A street light was installed at the
intersection with Hummingbird Road. The street light at the end of Tanager was
proposed about 100 feet before the end, to better light a curve in the road. Due to the
layout of the residences, the mid-block light ended up closer to the intersection.
However, the design as currently proposed approximates the 300-foot spacing
specified in the standards, and is consistent with the designs already approved by the
City for Units 1 and 2.

of Carlsbad for our soils report dated February 12,1996 (Reference). The item

In our referenced report, we recommended that the building pads be over-
excavated to a depth of 3 feet and to a minimum horizontal distance of 5 feet
beyond perimeter building lines. The earthwork quantities of this remedial
grading will be determined by the project civil engineers, Hunsaker & Asso-
ciates San Diego, Inc., and will be shown on the plans.

Asphalt paving requires a 4-inch minimum per current standards.
Response
In our referenced report, we provided a tentative pavement section of 3 inches
of asphalt overlying 4 inches of aggregate base. The city minimum requires 4
inches of asphalt; accordingly, we have revised our recommended pavement sec-
tion to 4 inches of asphalt overlying 4 inches of aggregate base. As mentioned
in our referenced report, this pavement section should be considered tentative
and will need to be verified by testing of actual subgrade soils existing at grade
at the completion of grading.
We trust the information provided herein adequately addresses the plan check
comments by the City of Carlsbad. Should you have any questions, please do
not hesitate to call.

Dear Ms. Vialpando:
We have reviewed the city comments from plan check no. 2 that pertain to soil engineering
and have prepared the following report.
On sheet 3 the city has expressed a concern regarding the lowered grade at the toe of the
slope along Alga Road. Our As-Graded Geotechnical Report indicates that this slope was
constructed as a cut slope during grading. Lowering the grades in this area should not have
an adverse effect on the stability of the slope provided the slope is extended out at a 2:1
slope ratio. A representative of the soils engineer should be on-site to map the cut areas
while finish grading is being performed.
Sheet 4 shows a small sliver fill behind unit 118. We recommend that this fill be placed
in accordance with our standard grading recommendations. These include providing a
suitable firm bottom for the fill soils to bear on and proper benching into the existing soils
while the fill is being placed.
Sheet 5 shows an existing desilting basin which will be filled during precise grading. We
recommend that all soft soils be removed down to competent soils prior to placing
additional fill. A representative of the soils engineer should be present to confirm that all
soft, wet or uncompacted soils have been removed.

It is our understanding that you wish to install a Bomanite pavement section at the intersections of
Cinerea Place, King Eider, and Ardeola Drive with Hummingbird Drive. We have used an R value
of 7 which was also the value used for Hummingbird Drive this is approximately equivalent to a
modulus of subgrade reaction of 100 pci. Our design is based on the Simplified Design Procedure
presented by the Portland Cement Association. Based on this method we recommend that a Bomanite
section of 5.5 inches be used with a minimum rupture modulus of 650 pound per square inch.

Dear Derek:
In response to the substantial conformance plan check No. 1,
I would like to address the issues of concern.
1. Pad elevations were evaluated with respect to driveway grades
and I have highlighted all pad elevations that have changed.
2. Per our meeting with Doug Helming the 3'-5' access & utility
easement was intended to be on one side of street. Therefore,
if the tentative map shows a wall behind sidewalk I will leave
on pending a planning discussion. The following wall changes
have been made:
a) The wall in Lot 2 at Ardeola Drive & Marabou Way has been
eliminated, however, the 15'xl5' useable yard is now in
sideyard.
b) Sideyard wall in Lot 6 has been eliminated.
c) Wall in Lot 4 has been shortened to pull back off street.
d) Wall in Lot 2 along Ardeola Drive behind sidewalk has
been moved to top of slope.
Tentative map did not show a wall in Lot 11 because the rec
area was not laid out. I need to add wall to allow for all rec
facilities.
3. You indicated some concern about storm drain changes from
tentative map to substantial conformance:
a) Storm drain change in Ardeola Court was revised for
better engineering design.
b) The new storm drain and inlets in Ardeola Drive were put
in per condition #74.

c) Storm drain in Cinerea Place has been revised to place
curb inlets at low point of street. Condition #74 states
that inlets will be placed on Cinerea Place. Tentative
map did not show these inlets therefore I have placed
them at the sump location.

Dear Sherri:
The above referenced item included in the City letter dated March 30,
1990 required the offsite dedication (by Hillman) of a portion of Rock
Dove Street. Upon discussion with Curt Noland of Hillman, we found
that this dedication has occurred. Map 12411, recorded June 29,
1989, File No. 89-346187 shows this dedication and describes it on
page 10 of 11 sheets. This was the map recorded for Phase I, Unit C.
If this does not meet your requirements, please advise. The ap-
propriate notation of this dedication will be shown on our tentative

Gentlemen:
It is our understanding that recent lot line adjustments in
the above referenced planning areas will result in sideyard
swales being located 3 feet from structures. Provided side
yards are adequately sloped away from the building and the
sideyard swales adequately slope toward the street or
appropriate drainage inlet, the proposed configuration should
be suitable with regard to geotechnical concerns. It is
important that drainage in these areas be maintained so that
water is not allowed to pond or soak into the foundation.
