HomeMy WebLinkAboutCT 93-09; Ocean Bluff; Tentative Map (CT) (38)City of Carlsbad Planning Department March 22, 1995 Jack Henthorn & Associates 5431 Avenida Encinas, Suite G Carlsbad, CA 92008 SUBJECT: CT 93-09 - OCEANBLUFF - OFFSITE POINSETTIA LANE Dear Jack: Thank you for your March 7, 1995 resubmittal of the subject tentative map. In accordance with the City's requirements, all public facilities and improvements necessary for development of the project must be shown on the tentative map in enough detail to perform the required environmental review. As submitted, the offsite Poinsettia Lane alignment is not shown on the tentative map in the necessary detail to make a determination that the Oceanbluff project is in compliance with the following required Zone 20 EIR mitigation measures: Biological Resources: Section 3.4.3.4: Prior to the approval of each tentative map, implementing permit or grading plan for any phase or unit of development proposed within Environmental Review Areas I and n, a biological field survey update shall be conducted, and a letter report shall be submitted to the City Planning Department for review and approval. Relying on the baseline biological data provided herein, this letter report shall include, at a minimum, a map of the specific biological resources occurring on the subject property, a description of sensitive species and habitats, an evaluation of potential impacts to these resources based on the proposed development plan, and recommended mitigation measures, if necessary. The range of on-site mitigation should include proposed open space easements to preserve sensitive resources, habitat restoration plans to fully compensate the direct loss of sensitive biological habitat, or other feasible options such as conversion fees or mitigation banking, to be determined by future biological studies. Any proposed open space easements onsite shall be required to contain all areas shown on Figure 2.3.1 (at a minimum) and shall be in substantial conformance with Figure 3.4-3 (to the maximum extent feasible). This would avoid the dedication of "patchwork" open space areas throughout the SPA which would serve little biological function. All recommended mitigation measures from these future biological field surveys shall become conditions of approval on subsequent development projects within the SPA, subject to approval by the City Planning Department. In addition, the applicant shall submit the necessary permits, where applicable, to the relevant governmental agencies (i.e., USFWS and CDFG) for review and approval. All conditions specified by these approved permits shall become conditions of approval for each final map or use and reliance upon each implementing permit within the SPA. Implementation of this measure shall mitigate to below a level of significance the potential impacts to sensitive plants, animals, habitats and wildlife species movement resulting from habitat fragmentation due to future SPA development. Section 3.4.3.6.: As mitigation for direct impacts to sensitive biological habitats resulting from future SPA development, a Habitat Restoration Plan shall be prepared by a qualified biologist and submitted to the City Planning Department for review and approval, pursuant to Section 3.4.3.4. All future habitat restoration sites shall be installed and certain specified success criteria met as determined by conditions of the Zone 20 Specific Plan, prior to the issuance of any building permit. They shall be maintained and monitored for a minimum of five years to ensure a successful rate of plant establishment. An open space easement shall be dedicated over all future habitat restoration areas on-site to ensure their long-term preservation and maintenance. The remaining Biological Resource mitigation measures (3.4.3.7 - 3.4.3.10) must also be incorporated into the proposed mitigation. Aesthetics: Section 3.13.3.2.: To reduce the potential visual impacts of manufactured slopes and roadway cuts, all cut and fill slopes shall be landform-graded and contoured. In addition, a landscape plan showing required slope plantings shall be prepared prior to the approval of a tentative map, site development plan, or grading plan for any phase or unit of development proposed within Environmental Review Areas I and n of the Zone 20 SPA. All planted slopes shall be watered with a complete irrigation system using low precipitation-rate sprinkler heads to stabilize exposed slopes and curtail visual impacts associated with possible erosion effects. Final landscape plans for all future development areas shall be prepared by a licensed landscape architect, and shall be subject to review and approval by the City Landscape Architect To avoid further delay in the processing of this tentative map, please submit plans for the offsite Poinsettia Lane alignment in the following detail along with the above described biological survey and analysis of the disturbed area including the 50* landscaped buffer and landscape plans: 1. Show approximate property lines of the affected parcels along the alignment of the proposed right-of-way; 2. Show the approximate tops and toes of slopes of the proposed grading; 3. Show the approximate grading quantities for off-site Poinsettia Lane. 4. Show the required 50* landscaped buffer adjacent to each side of the roadway alignment on the plans, including the 20' wide trail easement within the northern buffer. Provide conceptual landscape plans showing slope planting. Additionally, per Bob Wojcik's January 24, 1995 letter to Jack Henthorn, the City will require by condition that the improvements for Poinsettia Lane onsite and improvements for both Blackrail and Poinsettia offsite be different than they are shown on the tentative map. These differences must be shown on the tentative map and are as follows: 1. Poinsettia Lane shall be fully graded on the project site. The map shows the onsite portion basically ungraded; 2. Poinsettia Lane offsite shall have a concrete curb on both sides of the 32 foot wide section of roadway; 3. Blackrail Court shall have one side fully improved with curb, gutter, sidewalk and street lights. A second environmental issue requiring the submittal of an additional report is cultural resources. Specific mitigation is required for Level 3 sites defined as potentially significant and requiring preliminary significance evaluation. Site number CB-l/SDi-12,026 located in the southeast corner of the Hernandez property may be impacted by the proposed Poinsettia Lane alignment. Mitigation Section 3.6.3.2. of the EIR requires that prior to the approval of a tentative map, a cultural resources testing program shall be conducted by a qualified archaeologist, for those sites listed as either Level 3 or 4 on Table 3.6-1. As specified by the EIR, the recommended mitigation may include either a data recovery program or preservation plan and is dependent on the results of the significance evaluation.
