SUBJECT: KAIZA DEPOSIT
On May 5, 1993, applications were received from Kaiza Poinsettia Corp for CT 93-06, CP 93-03,
PUD 93-05, HDP 93-06, an EIA, Notice Deposit and PFF. The total amount of your check number
3083 was 531,967.00. These applications were subsequently withdrawn and all monies except the
S50.00 for PFF were available for refund. It was decided to leave the money on deposit and draw
against it as new applications for the Poinsettia Shores Master Plan were submitted.
On January 17, 1994, the following applications were submitted: CT 94-01, HDP 94-03, an EIA,
Notice Deposit and PFF - totaling 54,570.00 in fees. Following is the recap and remaining balance
available:

This submittal is incomplete. A list of items needed to make the application complete follows:
1. It appears that two different directions of processing are being sought,.
I. Some items appear to indicate that the Master Tentative Map, CT 94-01 will
become final before this map and this map will then become a subdivision upon
Lot 2 of that final map. Examples are lack of off site streets and sewers needed
for this map to stand alone.
II. Other items appear to indicate that this map is intended to not depend on CT 94-
01 becoming final first. Examples are the legal description, the listing of all
easements over the master tentative map without an explanation which easements
apply to this map.
The applicant must choose one direction of processing and make all items consistent with
that choice. We believe that having each planning area capable of becoming a final map
on it's own merits will require a lot of duplication of requirements for the offsite
improvements for Avenida Encinas, the drainage west of the railroad, grading and sewer
improvements.
2. Footprints of structures are not plotted.
3. Offsite sewer and water which is needed to serve the project is not clearly shown. We
suggest that the overall systems be shown on the "key map".
4. All drainage is not shown. A drain is needed from the cul-de-sac to the existing 66 inch
S. D. How this project will drain into the offsite Windrose Circle drainage system is not
shown.
5. State the traffic generation for this map alone.
6. Sight distances are not plotted at the site exits.
We continued the review on the assumption that this map is not intended to stand alone but will

depends on CT 94-01 becoming final first. Under this assumption there a few issues, as follows:
i. A complete realignment of the entrance so that it is opposite Navigator Circle is needed.
ii. Verify and identify on the map that the only existing easements on this map are Items 21,
39, 42 and 43 on the easement list. These easements will most likely be quitclaimed on
final map for CT 94-01 and if so, should be shown only in reference to CT 94-01
iii. The grading analysis as presented is likely to be confusing to one not familiar with the
processing of the overall project. Please clearly show the grading needed for this map
alone. A reference to the sheet grading done on the Master Tentative Map CT 94-01 may
be needed for a complete explanation. A statement such as "this map proposes minimum
grading upon the sheet grading for Master Tentative Map sufficient only to establish
streets, drainage and lot pads. Whether the map will balance onsite or needs to export
or barrow offsite needs to be addressed.
iv. Driveway grades and vertical curves, if needed, needs to be looked at.
v. The exit-only onto Avenida Encinas needs to be a minimum of 24 feet wide. The City
Council has asked if this exit might also be used for entry. In the case that it does
become an entry, the minimum width will need to be 30 feet. If the project is to be
gated, additional area for turn around will be needed.
Do a warrant analysis as a full intersection and as exit only, accounting for Street "A"
including pedestrian demand to the recreation area.
vi. If the project is to sewer to the proposed pump plant in Area-4, approval from CMWD
will required prior to approving the tentative map.
vii. A letter from a soils engineer is needed to allow less than the standard 5 foot distance
from structure to the swale.
viii. Street "R" has a sump drainage condition on the west end. Providing a fail-safe overflow
will be a requirement.
ix. Be consistent in labeling open space lots on key map and tentative map.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your Tentative Tract Map/Planned Unit Development, application no. CT 94-05/PUD
94-04, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information
which must be submitted to complete your application. This list of items must be submitted directly
to your staff planner by appointment All list items must be submitted simultaneously and a copy
of this list must be included with your submittals. No processing of your application can occur until
the application is determined to be complete. The second list is a list of initial project issues of
concern to staff. More project design issues will likely be identified and require resolution after the
application is deemed complete. When all required materials are submitted the City has 30 days
to make a determination of completeness. If the application is determined to be complete,
processing for a decision on the application will be initiated. In addition, please note that you have
six months from the date the application was initially filed, April 29, 1994, to either resubmit the
application or submit the required information. Failure to resubmit the application or to submit
the materials necessary to determine your application complete shall be deemed to constitute
withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new
application must be submitted.

LIST OF ITEMS NEEDED
TO COMPLETE APPLICATION:
No. CT 94-05/PUD 94-04 - PLANNING AREA A-2
PLANNING:
1. A complete application for an affordable housing project Site Development Plan (SDP) is
required for either on-site or off-site affordable units; unless off-site affordable housing
units are existing in which case a draft affordable housing agreement must be submitted to
make the individual tentative map applications complete.
2. As proposed, this map requires the final map approval of the master tentative map currently
under review (CT 94-01). Otherwise, this map must be a "stand alone" map with all offsite
improvements shown, etc. On the cover sheet for this map, eliminate all lot and footprints
shown for areas outside this specific planning area. Show the lots created by the master
tentative map (CT 94-01) and label area outside this planning area as "not a part". List only
the easements relevant to this planning area. The grading summary needs to reflect minor
finished grading beyond the mass grading associated with CT 94-01. The amount of
finished grading beyond the mass grading will be the basis for determining if additional
environmental review specific to this planning area is required; or if the grading is minor
enough so that it was covered with the master tentative's mass grading.
3. Show information such as easements, lot areas and street cross sections that are relevant
to this planning area and not on a master tentative map level. Sheets cannot be missing
from exhibits packages for application completeness.
4. Plotting of units/footprints on lots and pads; and full architectural exhibits for all proposed
plan types, all elevations and all floor plans. These exhibits must reflect items a-e as shown
under #17 on the application checklist.
5. Landscape plans at 40 scale including trail and any noise wall landscaping. Provide items
a-f as shown under #16 on the application checklist.
6. Trail plans for the trail system required for this planning area consistent with the Poinsettia
Shores Master Plan.
7. Noise study with attenuation/mitigation measures to comply with City's noise policy.
8. List the Average Daily Traffic amount specific to this planning area.
9. Provide percent of landscaping for this planning area.
10. Provide number of parking spaces required/provided for this planning area. Distinguish
between resident parking and guest parking.
11. Provide location, height and materials of all walls and fences. Indicate top, bottom and
highest condition elevations at both ends and in the middle of walls/fences.
12. One copy of 8 1/2 x 11" reduced site plan and building elevations.
13. Provide an Environmental Impact Assessment form. The environmental assessment needs
to, at a minimum, address the proposed project and the environmental issues specific to this
planning area as outlined in the master plan.
14. Public Facility Fee Agreement: Two (2) copies: one (1) notarized original and one (1)
reproduced copy.
15. Three copies of the Preliminary Title Report (current within the last six (6) months).
16. The SDP for Planning Areas E and M must be deemed complete for this application to be
deemed complete.

This letter represents Kaiza's waiver of any and all required timelines for the processing of
pending incomplete applications (CT 94.04, CT 94.05, CT 94.06, CT 94.07, CT 94.08, and CP
94.02) so that Planning Area D (CT 94.10) may first be deemed complete by either an on-site
or off-site project. The pending applications referenced above may be re-submitted for a new
30 day completeness review but will not be deemed complete until Planning Area D is deemed
complete. Because the re-submittals will be made under the original pending applications, no
fees will be required with the re-submittals and all fees previously paid are applicable to the re-
submittal. As we have discussed, both the City and Kaiza will work as diligently as possible
to process and approve the above referenced maps.

PROJECT ISSUES STATEMENT ^
POINSETTIA SHORES PLANNING AREA A-2, CT 94-05/PUD 94-04
The Engineering Department has completed its review of the resubmitted project application
for completeness and engineering issues. The application and plans submitted for this
project are now complete for the purpose of continued engineering review. The project does
contain some engineering issues or concerns which remain to be resolved by the applicant.
All engineering issues should be fully resolved or addressed prior to resubmittal of the project
for our review. The outstanding engineering issues or concerns are as follows:
1. Driveways for all lots must be plotted on the tentative map.
2. We are in receipt of an updated title report, dated December 5, 1994. The easement
numbers listed on the tentative map should match the item numbers in this new title
report.
3. Stopping sight distance of 300' is to be plotted, as opposed to the 200' stopping sight
distance presently shown on the tentative map.
4. Please provide a signal warrant analysis for the intersection of Windrose Circle and
Avenida Encinas.
5. Please show the proposed locations for call boxes at the gates. If no call boxes are
shown, this project may have a condition of approval disallowing call boxes.
6. The street lot has been designated as 'Lot A'. Please note that lots should have
consecutive lot numbers. If the final map for CT 94-01 has been recorded, and each
map thereafter is to be recorded separately, then the lot numbers for this and all other
tentative maps can begin with 'Lot 1'. However, a scheme for lot numbering of this
and other maps for other planning areas has never been satisfactorily presented.
7. The typical lot drainage detail should show a sideyard distance of 5' from the face of
building to the toe of slope, as opposed to the top of slope currently shown on the
plans. Additionally, several lots show the proposed sideyard drainage swales located
less than 5' from the buildings. The City requires that finish grading provide a
minimum positive drainage of 2% to swale 5' away from a building. This issue may be
resolved by having the Soils Engineer prepare a letter that indicates their approval of
the proposed drainage design.
8. As this project is to "stand alone", this tentative map will have conditions of approval
requiring installation of improvements including drainage, sewer, utilities, and street
improvements.
Attached is a redlined check print set of the project. Please forward this plan set to the
applicant for corrections and changes as noted. The applicant must return this plan set with
the corrected plans to assist us in our continued review. If you have questions regarding any

your resubmitted Tentative Tract Map and Planned Development
Permit, application nos. CT 94-05/PUD 94-04, as to its completeness
for processing.
The items requested from you earlier to make your application
complete have been received and reviewed by the Planning and
Engineering Departments. It has been determined that the
application is now complete for processing. Although the initial
processing of your application may have already begun, the
technical acceptance date is acknowledged by the date of this
communication .
Please note that although the application is now considered
complete, there may be issues that could be discovered during
project review and/or environmental review in addition to those
already identified. Attached is a list of additional issues
identified during the resubmittal review. All issues need to be
resolved prior to work commencing on the project's staff report and
scheduling for public hearing. In addition, the City may request

INITIAL PROJECT ISSUES
Project No. CT 94-05/PUD 94-04 - Planning Area A-2
PLANNING
1. Please provide a legend for the floor plans explaining any
symbols and abbreviations as shown on the plans.
2. Per item #26 of the CT/PD checklists please provide a
materials board with color samples that will correspond with
the colors and materials noted on the architectural/elevations
exhibit (roofing, exterior walls, pavement, glass, wood, etc.)
3. Please verify that no roof top equipment is proposed or will
be required with the project; otherwise provide roof plans
that depict all roof top equipment, etc.
4. The landscape plan will be reviewed in detail by the City's
landscape consultant now that a complete application has been
achieved.
5. Only provide wall and fence details that correspond and
pertain to the walls and fences involved in this project as
noted on the plans. Use the same terminology between the
plans and details when referencing walls/fences. For example,
"noise barrier wall" is called out on the plans but not given
a corresponding detail with the same name. All wall heights,
materials and colors need to be indicated. Noise wall details
need to specify the materials and thickness proposed
consistent with the requirements of the noise study in order
to achieve adequate noise attenuation. The landscape plan and
site plan must be consistent with each other including
wall/fence information. On the plans, the noise wall height
appears to be called out; however, please call out all wall
heights (noise, retaining, etc.) throughout the length of the
walls including endpoints, midpoints and highest elevation.
Noise wall heights must be in compliance with the project's
noise study. The tentative map exhibits and landscape plans
must be consistent with each other.
6. As part of the landscape plans, please provide an exhibit
clearing showing the details (materials, copy, colors, height
and length dimensions) of all proposed signage consistent with
master plan provisions. Also indicate sign illumination
styles and techniques consistent with the master plan (Exhibit
30, etc).
7. On the project's floor plans, please indicate a minimum of 5'
foot sideyard setbacks.
8. Maximum encroachment of fireplaces into sideyard setback areas
is 2 feet. Please dimension this on the plans. Some of the
fireplaces appear to scale out to 2 1/2 feet of encroachment;
2 feet of encroachment is the maximum. Also, please label all
fireplaces on the project's floor plans and give a
corresponding symbol for the floor plans' legend.
9. On the sheet 3 of the tentative map, lot numbers are in
circles with the floor plan type underneath; please use the
same label on the map exhibits as the floor plan exhibits
(either plan types A, B, C or 1,2,3).
10. For plan type 1 on the floor plans, provide a second
floor/loft floor plan.
11. Label what plan type the second floor plans correspond to on
the floor plan exhibits.
12. On the project's architectural elevation exhibits, please note
the typical building materials and colors consistent with the
materials/colors board.
13. The project's noise study does not appear to require any noise
attenuation along Windrose Circle. Please provide a letter or
amendment to the noise study with the noise consultant
specifically not requiring noise attenuation there. In
addition, the landscape plan is not consistent with the
tentative map exhibits with regards to Windrose Circle and the
proposed walls. Distinguish between noise walls per the noise
study and other proposed walls. The master plan provides
guidelines for walls and standards for noise walls. Lastly,
the noise study on page 5 refers to a 5.5' high wall but a
6.5' high wall is referenced for the same location on page 1.
Please clarify/correct.
14. The master plan's design guidelines require landscaping along
walls to reduce visual impacts. There appears to be
inadequate or a lack of landscaping along wall segments
adjacent to streets. The maintenance statement on the
landscape plans appears to be in need of clarification. In
addition, please provide the percentage of landscaping for
this planning area on the landscape plans and as an item under
General Notes on the cover sheet of the tentative map
exhibits. Please also provide the percentage of landscaping
for Planning Area A-l on that project's exhibits; and on the
exhibits of all other planning areas being processed with the
City.
15. Both the tentative and landscape plan exhibits need to show
the trail required with this planing area by the master plan.
Please provide typical details/cross sections of the trail and
depict all trail amenities. At the ends of the trail,
indicate the trail's continue onto another planning area/trail
segment consistent with the master plan's trail system. The
tentative map and landscape plans must be consistent with each
other. For A-2, the master plan requires construction and
completion of the trail prior to the granting of occupancy.
Please indicate this as a note on the trail plans or on a
corresponding trail detail. In addition, also please indicate
the following: (1) that the Homeowners Association shall
assume all trail maintenance and liability responsibilities;
and (2) prior to final map approval, an open space easement
shall be dedicated to the property owner/Homeowners
Association for trail purposes.
16. On the cover sheet of the tentative map, under Grading
Analysis, please insert the following wording above the cut,
fill and import quantities given: This site was mass graded
under the approval of Master Tentative Map, CT 94-01. Final
grading for this Planning Area involves:

Summary, please place in parentheses (on-street parking)
underneath visitor parking. Parking spaces for guests are
allowed to be located on both sides of the 36 foot wide
private street per the PD ordinance. Please plot these

clearly show the guest spaces provided; and to verify the
number of guest spaces present.
18. A check will be made for compliance with the Small Lot
Architectural Guidelines.
19. Please provide entry gate/call box details for all planning
areas proposing gated entries.
ENGINEERING
1. Driveways for all lots must be plotted on the tentative map.
2. The easement numbers listed on the tentative map must match
the item numbers in the new title report dated December 5,
1994.
3. Stopping sight distance of 300' is to be plotted, as opposed
to the 200' stopping sight distance presently shown on the
tentative map.
4. Please provide a signal warrant analysis for the intersection
of Windrose Circle and Avenida Encinas.
5. Please show the proposed locations for call boxes at the
gates. If no call boxes are shown, this project may have a
condition of approval disallowing call boxes in the future.
6. The street lot has been designated as 'Lot A'. Please note
that lots should have consecutive numbers. If the final map
for CT 94-01 has been recorded, and each map thereafter is to
be recorded separately, then the lot numbers for this and all
other tentative maps can begin with 'Lot 1'. However, a
scheme for lot numbering of this and other maps for other
master plan planning areas has never been satisfactorily
presented nor approved.
7. The typical lot drainage detail should show a sideyard
distance of 5' from the face of building to the toe of slope,
as opposed to the top of slope currently shown on the plans.
Additionally, several lots show the proposed sideyard drainage
swales located less than 5' from the buildings. The City
requires that finish grading provide a minimum positive
drainage of 2% to swale 5' away from a building. This issue
may be resolved by having the Soils Engineer prepare a letter
that indicates their approval of the proposed drainage design.
8. As this project is to "stand alone", this tentative map will
have conditions of approval requiring installation of
improvements including drainage, sewer, utilities and street
improvements.
9. A redlined checkprint of the project has already been received
by you; it must be returned with the next resubmittal to
assist staff with its continued review.

The area of concern to the Police Department with this plan is:
General building security.
General security for residents.
Keying- Upon occupancy by the owner or proprietor, each single
unit in a tract, or construction under the same general plan, shall have
locks using combinations which are interchange-free from locks, used in
all other separate dwellings, proprietorships or similar distinct
occupancies.
Lighting- Aisles, passageways, and recesses related to and within
the building complex shall be illuminated with an intensity of at least
twenty-five one hundredths (.25) footcandles at the ground level during
the hours of darkness. A lamp other than Incandescent is best used in this
application.
They shall be installed with a timer so as to go on when it starts to get
dark and go off when it starts to get light. Porch lights and balcony or
deck lights shall also be installed with timers or sensors.
Recreation and common areas shall be provided with a maintained
minimum of one (1) footcandle of light on the parking surface during the
hours of darkness. A good choices for lighting in parking areas are high and
low pressure sodium lights. There shall be surveillance from individual
units into common or recreation areas.
Lighting devices shall be protected by weather and vandalism covers.
Walkway and entrance way lighting shall be designed with landscaping in
mind. One should not deter from he other.
Landscaping- The exterior landscaping should be kept at a
minimal height and fullness giving police, security services and the
general public surveillance capabilities of the area. There shall be vision
through trees and scrubs to buildings, walkways, carports and parking
areas from the street. Trees shall be designed as to not provide access to
the roof or balcony areas.
Walkways and entrance ways shall be keep clear and free from clutter.
Fences shall be see through to provide surveillance. It is recommended
that the perimeter of the properties be enclosed with a see through fence.
Gates shall have locking devices.
Addressing- All residential dwellings shall display a street
number in a prominent location on the street side of the residence in such
a position that the number is easily visible to approaching emergency
vehicles. The numerals shall be no less than four (4) inches in height and
shall be of a contrasting color to the background to which they are
attached.
It is recommended that house numbers be displayed in illuminated fixtures
on the front of residences, clearly visible from the street.
Doors-Dead-bolt locks shall be installed on all access doors of any
residential building and attached garages, including the door leading from
the garage area into the dwelling.
Dead-bolts shall have a minimum protection of one inch and be
constructed so as to repel cutting tool attacks. The dead-bolt shall have
an embedment of at least three-fourths inch into the strike plate area.
Strike Plate and dead-bolt are to be installed with wood screws that are
three inches in length. It is not recommended to install double cylinder
dead-bolt locks on a residential dwelling. The Fire Department considers
them a hazard in an emergency situation.
All entry and exit doors to dwelling units should be arranged so that the
occupant has a view of the area immediately outside the door without
opening the door. Except for doors requiring a fire protection rating which
prohibits them, such view may be provided by a door viewer having a field
of view of not less than 190 degrees. Mounting height shall not exceed
fifty-four inches from the floor. It is not recommended to place glass
panels within forty inches of a locking device..
The inactive leaf of a double door shall be equipped with metal flush bolts
have a minimum embedment of five-eights inch into the head and
threshold or the door frame.
Horizontal sliding doors shall be equipped with a metal guide track at top
and bottom. The bottom track shall be so designed that the door cannot be
lifted from the track when the door is in the locked position. Security
hardware such as a pin shall be installed on a sliding glass door.
Hinges for out-swinging doors shall be equipped with non-removable hinge
pins or a mechanical interlock to preclude removal of the door from the
exterior by removing the hinge pins.
Garage Doors-Doors that exceed sixteen feet in width shall have
two lock receiving points; or, if the door does not exceed nineteen feet, a
single bolt may be used if placed in the center of the door with the locking
point located either at the floor or door frame header; or, torsion spring
counter balance type hardware may be used.
Windows-Security hardware shall be installed in all windows to
prevent them from being lifted from their frame or forced open.
Recreation and Common Areas- There shall be vision into all
recreation areas. Landscaping or fencing shall not deter from surveillance
capabilities. See lighting for proper illumination levels.

collected before and/or at the time of issuance of the building permit. The San Diego
County Water Authority capacity charge will be collected at issuance of application for
meter installation.

3. Sequentially, the Developers Engineer shall do the following:
A. Meet with the City Fire Marshall and establish the fire protection requirements.

Department for processing and approval.
C. Prior to the preparation of sewer, water and reclaimed water improvement plans,
a meeting must be scheduled with the District Engineer for review, comment and
approval of the preliminary system layouts and usages (ie - GPM - EDU).
4. This project is approved upon the expressed condition that building permits will not be
issued for development of the subject property unless the water district serving the
development determines that adequate water service and sewer facilities are available at
the time of application for such water service and sewer permits will continue to be

Dear Mr. Munoz:
In our letter dated December 15, 1994, NCTD requested that the residential development of
Poinsettia Shores be designed in a manner which emphasizes pedestrian and transit access to local
amenities, such as the beaches, bicycle facilities, retail shopping and the Poinsettia commuter rail
station. In the same letter, NCTD also requested that the recreational center at Lot 6 act as a focal
point for fixed-route coastal service and rail station shuttle service along Avenida Encinas. We
recommended that the street designs of the Poinsettia housing developments be in grid or radial
patterns which create direct access to Avenida Encinas and help to develop a pedestrian and transit-
oriented community. NCTD requests that these same concepts be applied to the development of
Ix>ts 1 and 2.
NCTD asks that the Carlsbad Planning department review the proposed street design for Lots 1 and
2 with regard to transit access improvments. At a minimum, NCTD recommends that pedestrian
pathways be integrated into the lot design to increase access Avenida Encinas, transit facilities, bike
lanes and the recreational center. In Lot 1, the circular street pattern is designed with two private
drives to Avenida Encinas so that those lots located on Street "H" and Street "F" do have sufficient
access. However, those lots located along Street "G" do not. By integrating a narrow pathway
along the south side of Lot 185, and between Lots 191 and Lot 189 and out to Street "H", the
walking distance to Avenida Encinas from Street "G" would be significantly reduced.
In the plans for Lot 2, it appears that the residents of Lots 141-146 and Lots 167-169 are within
access of Avenida Encinas via Street "0", the entryway to the development. However, residents
located along Street "R" in Lots 150-158 and Lots 121-133 would walk up to 1,000 feet through

the development to Street "O" and out to Avenida Encinas to reach transit facilities, bike lanes and
the recreational center. NCTD recommends, at a minimum, that this distance be significantly
shortened by creating pedestrian walkways at either end of the housing development.
According to the landscaping plans for Lot 2, there appears to be a narrow strip of open space on
the far west side of the devlopment that extends from the entry at Street "O", back along the west
side noise barrier wall to the southwest portion of Lot 2. NCTD asks that this strip be used as a
pedestrian pathway which would reduce the walking distance for residents on the backside of the
development to approximately 600 feet. Similarly, in the northeast portion of Lot 2, between lots
141 and 140, a pedestrian pathway should be implemented from the end of Street "R", through a
gate in the noise barrier wall and out to Avenida Encinas.
NCTD planning staff would be happy to answer any questions regarding our requests for improved
transit access. Staff would gladly meet with city staff to discuss any of the transit-oriented design
concepts discussed in this letter and in our letter of December 15.

The Engineering Department has completed it's review of the project and recommends
approval under the attached conditions. An engineering report was prepared to assist
you in the preparation of the Staff Report to the Planning Commission as follows:

Traffic and circulation were reviewed and all their issues were resolved with the Master
Plan.

V. DRAINAGE AND EROSION CONTROL

The preliminary hydrology study was prepared by George O'Day of O'Day consultants,
dated April 30,1993. There are no drainage issues within this Planning Area A-1. There
were major issues within the Master Plan area but these were resolved with CT 94-01.
Construction of the needed facilities were guaranteed with that final map.
The project is conditioned to meet NPDES to reduce pollutants in the runoff with best
management practices.
VI. LAND TITLE
The parcel boundaries for this project were established by the recording of the final
map for CT 94-01. There are no major land title issues with this project. Coordinating of
utilities with the construction of the extension Avenida Encinas may necessitate certain
utility easements being removed by the final map for this project or separate quitclaim
action may be required.
VII. IMPROVEMENTS
The project does not require any public improvemensts except the offsite completion
of Avenida Encinas in order to meet cul-de-sac standards. These improvements will
consist of the extension of Avenida Encinas to connect with Carlsbad Boulevard. The
construction of Avenida Encinas has been guaranteed with the final map for CT 94-01.
No occupancy will be granted in this project until the improvements are constructed. To
insure that the extension of Avenida Encinas will be availible prior to occupancy, the
project a has condition that these improvements be constructed to the city Engineer's
satisfaction prior to issuing a building permit.

ENGINEERING CONDITIONS
FOR CT 94-05
33. This project is located within the West Batiquitos Lagoon Local Coastal Plan. All
development design shall comply with the requirements of that plan.
34. Unless a standards variance has been issued, no variance from City Standards is authorized by
virtue of approval of this tentative map.
35. The applicant shall comply with all the rules, regulations and design requirements of the
respective sewer and water agencies regarding services to the project.
36. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell Telephone,
and Cable TV authorities.
37. This project is approved specifically as 1 (single) unit for recordation.
38. If the applicant chooses to construct out of phase, the new phasing must be reviewed and
approved by the City Engineer and Planning Director.
39. The applicant shall provide an acceptable means for maintaining the private easements within
the subdivision and all the private: streets, sidewalks, street lights, storm drain facilities and
sewer facilities located therein and to distribute the costs of such maintenance in an equitable
manner among the owners of the properties within the subdivision. Adequate provision for
such maintenance shall be included with the CC&R's subject to the approval of the City
Engineer prior to approval of the final map.
40. A note to the effect of the following shall be placed on a non-mapping data sheet of the final
map.x Improvements designated on the improvement plans for this subdivision are private and
are to be privately maintained?"
A note shall be placed on the improvement plans stating which utilities are public and which
are private.
41. All concrete terrace drains shall be maintained by the homeowner's association (if on
commonly owned property) or the individual property owner (if on an individually owned
lot). An appropriately worded statement clearly identifying the responsibility shall be placed
in the CC&R's.
43. Approval of this tentative tract map shall expire twenty-four (24) months from the date of
Planning Commission approval unless a final map is recorded. An extension may be
requested by the applicant. Said extension shall be approved or denied at the discretion of the
Planning Commission. In approving an extension, the Planning Commission may impose new
conditions and may revise existing conditions pursuant to Section 20.12.110(a)(2) Carlsbad
Municipal Code.
44. The applicant shall defend, indemnify and hold harmless the City and its agents, officers, and
employees from any claim, action or proceeding against the City or its agents, officers, or
employees to attack, set aside, void or null an approval of the City, the Planning Commission

or City Engineer which has been brought against the City within the time period provided for
by Section 66499.37 of the Subdivision Map Act.

54. Based upon a review of the proposed grading and the grading quantities shown on the
tentative map, a grading permit for this project is required. Prior to approval of the final map,
the applicant must submit and recieve approval for grading plans in accordance with City
codes and standards.
56. No grading shall occur outside the limits of the subdivision unless a grading or slope
easement is obtained from the owners of the affected properties. If the applicant is unable to
obtain the grading or slope easement, no grading permit will be issued. In that case the
applicant must either amend the tentative map or modify the plans so grading will not occur
outside the project site in a manner which substantially conforms to the approved tentative
map as determined by the City Engineer and Planning Director.
57. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project, the applicant shall submit to and receive approval from the City Engineer for the
proposed haul route. The applicant shall comply with all conditions and requirements the
City Engineer may impose with regards to the hauling operation.
58. The developer shall exercise special care during the construction phase of this project to
prevent off site siltation. Planting and erosion control shall be provided in accordance with the
Carlsbad Municipal Code and the City Engineer. Reference Chapter 11.06.
60. Rain gutters must be provided to convey roof drainage to an approved drainage course or
street to the satisfaction of the City Engineer.
61. Additional drainage easements may be required. Drainage structures shall be provided or
installed prior to or concurrent with any grading or building permit as may be required by the
City Engineer.
63. The owner shall make an offer of dedication to the City for all public streets and easements
required by these conditions or shown on the tentative map. The offer shall be made by a
certificate on the final map. All land so offered shall be granted to the City free and clear of
all liens and encumbrances and without cost to the City. Streets that are already public are
not required to be rededicated.
65. Prior to issuance of building permits, the applicant shall underground all existing overhead
utilities within the subdivision boundary.
66. Direct access rights for all lots abutting Avenida Encinas and Windrose Circle shall be

71. The applicant shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. The applicant shall provide best management practices
to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans
for such improvements shall be approved by the City Engineer prior to approval of the final
map, issuance of grading or building permit, whichever occurs first.
77. Prior to approval of the final map, the design of all private streets and drainage systems shall
be approved by the City Engineer. The structural section of all private streets shall conform to
City of Carlsbad Standards based on R-value tests. All private streets and drainage systems
shall be inspected by the City. The standard improvement plan check and inspection fees shall
be paid prior to approval of the final map for this project.

Poinsettia Village, CT 85-29, built the basin, D-232-3, sht.lOA. No basin maintenance
agreement is in the files. The plans were substantially changed on as-built.
sammis, BLEP, CT 85-14, was required to construct an all weather access road per D 265-
2B. The road is not there and appears that it was never built. No maintenance
agreement is in the files although Clyde believes there was one.
Sammis's obligation probably should be passed on to Kaiza-Poinsettia. But since Sammis
apparently got away with not doing the road I will omit any condition concerning the
the basin maintenance or road. A condition is added conecerning modifying the basin
to me NPDES/retention/desiltation requirements.

SUBJECT: Poinsettia Shores Master Plan - Planning Area A-2 Fencing Additions
Dear Anne:
Thank you for meeting with Matt Howe and me on April 3, 2000 to discuss the possibility of
constructing additional fencing within Planning Area A-2 adjacent to the private trail between Planning
Areas A-2 and A-3 of the Poinsettia Shores Master Plan. As requested, I have prepared this letter is
to document our discussions and the additional fencing proposal.
Since Planning Area A-2 was approved as a gated community, Greystone Homes is obligated to the
homeowners now living within this planning area to complete the fencing as proposed in order to
establish a true gated neighborhood. Attached to this letter are two exhibits. One exhibit provides the
locations of the additional fencing while the second exhibit provides an elevation view of the tubular
fencing to be provided. There are three separate areas where the proposed fencing will be
constructed. All fencing will be no taller than six feet in height per City standards and will consist of
tubular metal posts. The fencing will be fastened to the existing community block walls or gates and will
be compatible in design and appearance to the existing development. All fencing will be setback five
feet from existing sidewalks.
With regards to the fencing location at the end of Sundial Place, Matt Howe contacted the homeowner
at 7454 Sundial Place (Lot 39) to seek permission to place a portion of this fence along the top of this
homeowner's existing low block wall. The homeowner did not agree with adding a fence on top of his
block wall nor did he agree with locating a five to six-foot fence adjacent to his low block wall. It is this
homeowner's preference that the fence be located along the planning area boundary between Planning
Areas A-2 and A-3. Pursuant to my discussion with you, it is the city's current position that the best
location for the fencing would be consistent with that shown on the exhibit provided. This location
would create a more open and usable area along the private trail.
