I do not know what happens at the end of the 10-day period, but assuming that there are no appeals, I assume you are the only one who can release our remaining two building permits. Paul has been extremely helpful and told me he was going on vacation, but I figured he might need your approval to release the building permits. As you can see from the Notice, the 10 days will actually be up on the 12 and not tomorrow as Paul was told. Therefore, without meaning to offend, would I be asking for too much to have the permits released on Friday the 13th? I am not trying to get you involved in anything in which you shouldn't, but felt that since Paul might still be on vacation and your hold is on the plans, then you might be the only party who can release the permits. Rather than having you go through all of the changes, I am now sending you the front, side, and rear yard setback Matrix again. Please throw away the other sets so that there won't be any coniusion. Meg Purviance at O'Day will have two engineered plot plans delivered to you and since she has verified the exactness of this Matrix, I know the plans and the Matrix will match. I apologize for any confusion, but I thought it would be more appropriate for the engineer to calculate the setbacks as opposed to my architect. Thanks again for all the assistance. It is refreshing to know that you can take the time to call on these items as opposed to simply rejecting them. Attached is the changes we have made to our Front Yard Setback Matrix, Please note none of the decreases are over 10%. By separate delivery, I am sending you the revised site plan, but wanted to permit you to see the changes we had discussed. Incidentally, to make it easy on the City, I am having a Resolution drawn up that will clearly indicate only one signature is needed for signing everything. Since you are so familiar with this area, is there any chance you could be the staff person on processing the additional 6 lots I spoke about? I realize you have moved on to bigger issues, but felt the processing time would be reduced while working with a staff person who already knows the area. Thanks again for your consideration. While the defunct greenhouses had been an eyesore for years, things had gotten worse rather than better in the year since this lot was sold to Kalicki-more trash was dumped on the site, etc. Clean up on the site was discussed at the meeting. Kalicki stated that the lot would be cleared by July, or Sept. Council said, "So then it will be completed by the end of the year." Six months later, we're at the end of the year and still nothing has been done. The trash remains, and now in addition, neighbors have to put up with the constant droning of motocross motorcycles and their accompanying clouds of dirt. Nearly every day after school and most of the weekend, a group of kids ranging in age from 8-14 use the trash strewn lot as a motocross course. The kids insist they have written permission from the owner of the property to ride there. The motorcycles are not street legal and are very loud. Sometimes, not content to ride on the vacant lot, they dart out onto the street, ride up and down the street and on the sidewalks. People here are pretty fed up with the trash strewn lot, demolition permits that seem to be indefinite, and now with the motocross noise. Police have been called about the motocross course, but once informed that the kids have permission they chat with the boys awhile and then leave. It's hard to believe that in a city that regulates skateboarding, motocross is allowed in a residential neighborhood. This property's rundown condition including stacks of trash, buildings in various states of deterioration, makes it a fire hazard, vermin breeding grounds and a blight on the neighborhood. Certainly the demolition and clean up should have been accomplished by now. Why has nothing happening? Aren't there consequences to not completing a demoli- tion in the time allowed? More than a couple neighbors I've spoken to question whether this property would have been allowed to deteriorate to this point if this lot were next door to a city council member's home. The residents of Jefferson and Chinquapin have been patient long enough. We want this lot cleaned up and off limits to motocross racing. Please let me know what is going to be done about this site, as the proposed clean up date has come and gone. This was the second meeting with owner of vacant property at Jefferson and Chinquapin (Jan Kalicki), purpose of which, to coordinate on timing and discuss reimbursement that will be required if City sidewalk project proceeds before his proposed development. 1. Project Limits-City project would include improvements to Jefferson Street only and not Chinquapin. 2. Improvements-City contract would include water services, sewer laterals and driveway locations for units that take access to Jefferson in addition to frontage improvements. 3. Utility Undergrounding-Overhead poles need to be undergrounded along frontage of vacant property to be developed. Property owner needs to initiate activity with SDG&E and fund undergrounding for poles on west side and services to existing homes on east side of street. 4. Timing—Owner indicates that he would like to receive grading permit prior to Oct 15th Coastal Commission imposed date. Expected time for site grading construction is 4 days. Grading and improvement plans, however, not yet submitted to City. If grading permit not received by this date, it appears that City contract will proceed first. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. (71) Plans, specifications, and supporting documents for all public improvements shall be prepared to the satisfaction of the City Engineer. In accordance with City Standards, the developer shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the tentative map, and the following improvements: A. Half (Va) street improvements to Jefferson Street and to Chinquapin Ave. along the project boundary, with any required transitions to existing grading / improvements. B. Extension and full width improvements to Linmar Lane, including removal and reconstruction of the turnaround and existing roadway. C. Current drainage problems exist along the southerly and westerly portions of the area where drainage from the southerly end of existing Linmar is conveyed northerly to Tamarack behind the existing houses. This is resulting in frequent calls to the City Street Section to clear standing water caused by various debris that has been carelessly dumped. In addition, trees within the area are causing the asphalt trench to rise. Will drainage be redesigned to continue southerly down the extension of Linmar to Chinquapin? 2. Will the street areas adjacent to the new development be undergrounded? (To include Jefferson and Chinquapin; existing Linmar is already undergrounded) If yes, this would be the appropriate time to upgrade the existing street lighting system within the area. Additional undergrounded street lights could be added to Linmar at Chinquapin, mid-block at Linmar, and at the corner of Jefferson and Chinquapin. All existing street lights, as shown on plans, currently consists of street lights mounted on power poles and fed by overhead electric lines. 3. Engineering improvement plans, when submitted, should show all existing utilities and structures within the area of the street improvements; power poles, street signs, existing trees, etc., with removal or relocation instructions for contractor or other party/parties. 4. The proposed project providing 15 single-family residences exceeds the General Plan density allowed for the property. The City's General Plan designates this property as RLM (Residential - Low/Medium Density) which has a range of 0-4 dwelling units per net developable acre and a Growth Control Point of 3.2 units per net developable acre. Assuming that the entire site is considered developable, you would be allowed a total of 10.88 units (to be at the Growth Control Point) or a total of 13.6 units (to be at the top of the density range). In addition to this, inclusionary housing regulations would require that 15% of those units (1.63 or 2.04 units) would have to be "affordable" units. The proposed project appears to be at a density of 4.41 du/ac (without counting the proposed second dwelling units), thus exceeding both the Growth Control Point and the density range. The General Plan allows projects to exceed the Growth Management Control Point subject to special findings which ensure provision of adequate public facilities and that the number of units does not exceed the unit cap for the quadrant. However, there is no provision for exceeding the density range. Also, the units proposed beyond the Growth Control Point would have to be taken from the excess dwelling units bank for the quadrant. City Council Policy No. 43 establishes guidelines and findings for such requests. These guidelines give first preference to units being taken to provide affordable housing and second preference to housing for the elderly. There is no certainty that the proposed project (containing second dwelling units) would satisfy the criteria of Policy 43 necessary to be approved. 5. Should the project be approved, it would be conditioned to require you to process an affordable agreement prior to Final Map approval. 6. The Environmental Impact Assessment (ElA Part I) provided does not address the potential environmental impacts from the greenhouses on the site. You will need to provide a detailed soils testing and analysis report prepared by a registered soils engineer. This report must evaluate the potential for soil contamination on the site due to historic use, handling, or storage of restricted agricultural chemicals and should identify a range of possible mitigation measures to remediate any potentially significant public health impacts if hazardous chemicals are detected at high concentrations in the soil. 7. The Preliminary Title Report shows the property belonging to the Joseph Perachino Trust with Joseph Perachino as the Trustee. Please correct the appropriate documents as necessary to ensure that the information is correct and consistent between documents and to clearly identify the legal relationships between the various parties. 2. As indicated in over previous letter, you must show how you plan to provide the required affordable housing units, this must include a Site Development Plan application and supporting materials which show the location and design of the units. 3. Staff received and reviewed the Coastal Permit application you provided. As indicated in our last letter, the Coastal Permit application requires mapping of some information (e.g., slopes, etc.). It appears that the project site is not part of the Coastal Agricultural Overlay Zone, the Coastal Shoreline development Overlay Zone, or the Coastal Resource Overlay Zone Mello I LCP Segment. Therefore, there would be no mapping for those categories. The Coastal mapping requirements for mapping of other information (e.g., topography, vegetation, drainage, etc.) would still be required for the subject property. Since the Tentative Map shows existing contours with no slopes of 25% or greater, staff suggests you address the slope analysis by simply adding a note to the TM plan stating that the site contains no slopes in excess of %. 4. The Tentative Map plan sheet still does not show the proposed density of the project. The information must be shown on the plan. ISSUES OF CONCERN Planning: 1. The plan submitted providing 15 single-family residences exceeds the General Plan density allowed for the property. The City's General Plan designates this property as RLM (Residential - Low/Medium Density) which has a range of 0-4 dwelling units per net developable acre and a Growth Control Point of 3.2 units per net developable acre. Assuming that the entire site is considered developable, you would be allowed a total of 10.88 units (to be at the Growth Control Point) or a total of 13.6 units (to be at the top of the density range). In addition to this, inclusionary housing regulations would require that 15% of those units (1.63 or 2.04 of those units would have to be "affordable" units.) The proposed project appears to be at a density of 4.41 du/ac (without counting the proposed second dwelling units), thus exceeding both the Growth Control Point and the density range. The General Plan allows projects to exceed the Growth Management Control Point subject to special findings which ensure provision of adequate public facilities and that the number of units does not exceed the unit cap for the quadrant. However, there is no provision for exceeding the density range. Also, the units proposed beyond the Growth Control Point would have to be taken from the excess dwelling units bank for the Quadrant. City Council Policy No. 43 establishes guidelines and findings for such requests. These guidelines give first preference to units being taken to provide affordable housing and second preference to housing for the elderly. There is no certainty that the proposed project (containing second dwelling units) would satisfy the criteria of Policy 43 necessary to be approved. 2. As you know, the acceptability of second dwelling units to meet affordable housing requirements is currently being considered by the City's decision makers. You have indicated that you plan to pursue this approach to meet your requirements. As we have discussed, you are aware that there is some risk that a decision might be reached on second dwelling units which would negatively impact your project proposal and could result in new major issues which would have to be resolved. It is possible, therefore, that the students generated from this project may not attend the closest neighborhood school due to overcrowded conditions and, in fact, may attend school across town. You should also be aware that there are no school buses for regular student transportation from home to school.
