Dear Steve:
This letter is to clarify my July 11, 2000 fax to you regarding the outdoor plaza seating
area adjacent to the proposed Starbuck's. I understand that Starbuck's is going to provide
and maintain the outdoor tables and seating for a portion of the common plaza area. This
seating, as long as it is available to the general public, will not generate an additional
parking requirement and will be allowed.
My concern was that the seating location, being adjacent to Starbuck's, would deter
patron of the center from using the seating as they may feel that is solely for the patrons
of Starbuck's. Because there is no reasonable way to place or identify that these tables
and chairs are for common use, they may be placed at the discretion of Starbuck's. As
identified in my previous fax, Starbuck's may have up to four reserved outdoor seats.

Starbuck's Sign Drawings
Enclosed are Starbuck's proposed sign elevations for their demised premises
within Building D. Also enclosed is a copy of the pertinent sections of the City
approved sign program. Pursuant to the sign program, Starbuck's, as a "major"
tenant, is allowed 36" high lettering. Their logo is 36" high while their individual
lettered signs are 14" high. According to the guidelines, Starbuck's is allowed
76,45 lineal feet of signs. They are requesting 75 lineal feet. The storefront
channel letters exceed the specified length by 2 inches, but apparently the sign
company can tighten up the sign between the last "S" in Starbuck's and the "C" in
Coffee so that it will not exceed the specified length. Starbuck's is requesting
approval for one sign on the west and east elevations, as well as two signs on the
south elevation.
We believe that the proposed signs are within the guidelines and are acceptable to
us. However, before we give our approval to the tenant, we wanted to have you
review and approve the proposed sign elevations. If you have any questions or

MOUNTED EQUIPMENT
Dear Larry:
This letter is in response to your request for clarification on the requirement to screen the
roof-mounted equipment on the shop buildings of the La Costa Plaza shopping center.
Because of the distance from surrounding residential, the City will not be requiring the
screening of the roof mounted equipment, but will reserve the right to require screening
in that if after the project is completed, there is determined to be a significant aesthetic or
noise problem. In lieu of screening, the City will accept the painting of the equipment the
same color as the roofing material or of the backside of the parapet, whichever will
reduce the visual impact the best. Please have the building plans reflect the requirement
to paint the mechanical units.

Dear Gary*.
During the course of the plan check review of the plans for the shops buildings in La Costa
Plaza the Planning Department imposed a requirement that the roof mounted HVAC equipment
for the shops buildings be screened with the same type of pyramid screening element which was
proposed for the market/drug building. We do not believe that such a requirement is merited, nor
was it contemplated by the conditions of approval to CT97-09 or SDP97-07.
Code Reminder Condition 71 of CT97-09 ("Condition 71") is a standard condition that "all roof
appurtenances, including air conditioners, shall be architecturally integrated and concealed from
view and the sound buffered from adjacent properties and streets, in substance as provided in
Building Department Policy 80-6 to the satisfaction of Directors of Community Development
and Planning". This general requirement applies to the entirety of La Costa Plaza.
However in addition to Condition 71, a more specific and detailed condition applied only to the
market/drug building as revealed in Finding 3 of SDP97-07 ("Finding 3"). Therein it is stated
"the building perimeter of the market/drugstore would be screened by trees; the roof would be an
earth tone color to reduce light reflection; and the roof equipment would be screened to reduce
visual impacts on the homes located to the southeast of the property". Obviously, if Condition
71 were sufficient, then there would have been no need to have included Finding 3. In point ol
fact Finding 3 was inserted 10 cover a circumstance not covered by Condition 71, and that was
the specific need to screen roof equipment on a 60,000 square foot building. The special
attention given to the market/drug building was due to the fact that a number of very large
mechanical units would be needed in connection with the large scale operation of the market. In
order to address the concerns of a homeowner to the southeast of the project, Lucky (now
Albertson's) agreed to come up with a pyramid-shaped screening device to screen the 6 or 7
large mechanical system units which were to be placed on the Lucky roof. Ironically,
Albertson's has now elected to create a "mechanical mezzanine" for its building and therefore
the sole purpose of the special screening became moot (we thought), as there will be no
mechanical units on the Albertson's roof.

Accordingly, we do not believe that the shops buildings are required to have the expensive, one
of a kind pyramid-like screening device which was required for the supermarket building. If that
had been the case, it would have been quite easy to have included such a requirement in Finding
3. In our experience it would be unprecedented to have to go to such lengths to screen small
mechanical units from a distant view. Our shops will have approximately 15 separate
mechanical units spread amongst 4 separate buildings. We will have a parapet wall which will
provide reasonable screening from nearby streets and adjacent properties as required by
Condition 71. We do not believe that any more should be required of us under Condition 71, and
especially not the pyramid designed structure which was to be used exclusively to screen the
large systems which were to be placed on the roof of the supermarket building.

Dear Larry:
This letter is in response to your request to confirm that an incidental outdoor dining permit
for the common plaza area of the La Costa Plaza shopping center would not be required.
The common plaza area does not require an outdoor dining permit as it is not "a small
extension of an indoor restaurant, bona fide eating establishment, or deli which extends
outdoors beyond the walls of the restaurant and which is used exclusively for eating,
drinking, and pedestrian circulation therein" (to quote from the code). Incidental outdoor
dining areas are for direct extensions of restaurants providing indoor seating. The plaza area
being open, available to anybody, and not a direct extension of a restaurant would not require
an outdoor incidental dining permit.
Because the outdoor dining area of the restaurant space adjacent to building E of 800 square
feet is over the maximum incidental outdoor dining area of 400 square feet, the area is
determined not to be incidental per the definition in the code. Since the area is a significant
component of the restaurant, the incidental outdoor dining permit is not required. However
the area must provide parking at the appropriate ratio of 1 parking space per 200 square feet
of dining area, which would be eight spaces. Only areas less than 400 square feet which
process an incidental outdoor dining permit are exempted from providing additional parking.
It is my understanding that the outdoor dining areas were previously considered and
adequate parking has been provided. Could you verify that this is the case and that adequate
parking is available? The common area does not need to provide parking.

Re: Outdoor Seating Areas
Dear Van:
As we have discussed, Grant Tucker Properties is in the process of negotiating a lease with a
restaurant user for the western most 3,000 square feet of Building E (Parcel 5) of La Costa Plaza.
The restaurant will also include an outdoor seating area of approximately 800 square feet in the
location shown on the enclosed site plan. This will be an exclusive eating area which will be
cordoned off from the remainder of the plaza area, since alcoholic beverages will likely be
served in this area.
We also contemplate additional tables, chairs and umbrellas being placed in the plaza area for the
use of all the patrons of La Costa Plaza, and not exclusively for any particular user.
I have received the incidental outdoor dining area permit application form and I have a few
questions. With respect to the tables and chairs which we desire to place into the plaza area, we
do not view this as requiring an incidental outdoor dining area permit since it is not for the use of
a specific tenant, and is not attached to the use of a restaurant. The purpose of the original
design of the plaza area was to create a pleasing design element on the corner, other than a
building, and to provide a sealing area - gathering place for La Costa locals. Could you please
confirm to us in writing that this use of the plaza area does not require any outdoor dining area
permit. However, it is our understanding that the outdoor seating area appurtenant to the
restaurant use on Parcel 5 will need to go through the incidental outdoor dining area permit
process.
Since our plans are presently before the Planning Department, is there any need for us to provide
the information required in the application submittal requirements paragraphs 5 and 8, since all
the information is already in your possession?
With respect to the incidental outdoor dining area permit, we probably would wait until the
parcel map is recorded before providing the radius map and address labels since it would reduce
our notice requirement to 300 feet from the actual parcel on which the restaurant will be located.

Further, the barriers or railings and the outdoor furniture to be used by the restaurant user have
not been decided upon at this point. Do we need to wait for that information before making our
submittal?

information which you believe we should know about.

As you know, last week I inquired of you as to how to measure the 24-month time period for
pulling our building permits under our approvals for La Costa Plaza (e.g. conditional use permit,
special use permits and Site Development Plan). You advised me that we have the right to pull
building permits under our existing approvals for a period of two years after the recordation of
the Subdivision Map for La Costa Plaza (CT97-09). Assuming the Subdivision Map is recorded
in May, 2000, we would then have until May, 2002 in which to pull the permits.

Dear Larry:
The architectural revisions to the north elevation of Building D, which consists of
removing the canopy and replacing it with an architectural projection of arches and
columns is acceptable as proposed. The tower element at the northeast corner of the
building is to remain as originally approved. It is understood that the revisions to
Building D are to eliminate the encroachment into the Leucadia County Water District
easement.
The revisions will be considered as part of the previously approved substantial
conformance exhibits. Please submit two (2) blueline copies (24" X 36") of all
applicable exhibits for the project file and a reproducible 24" X 36" mylar copy of the
amended site plan which should include the previous revisions as well. The mylar must
be submitted, stamped "Substantial Conformance", and signed by the Planning Director
prior to issuance of any building permits for the project.
The City of Carlsbad Community Development Building is moving to a new location as
of January 19, 2000. Please submit all future correspondence and plans to 1635 Faraday
