The numbering of the conditions corresponds with the numbering of the draft Planning Commission staff report: 11. Prior to approval of any grading or building permits for this project, with the exception of grading permits for stockpiling purposes as allowed by the Poinsettia Properties Specific Plan, the owner shall give written consent to the annexation of the area shown within the boundaries of the subdivision plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided by the City. 15. A note to the following effect shall be placed on the final map per the provisions of Sections 66434.2 of the Subdivision Map Act: "With the exception of grading permits for stockpiling purposes as allowed by the Poinsettia Properties Specific Plan, no grading or building permits are to be issued on Lots 1 through 5 unless subsequent discretionary approvals are granted." If the fees are not paid, this application will not be consistent with the General Plan and approval for this project will be void. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 22 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits, including, but not limited to the following: 6. Approval of CT 97-10 is granted subject to the approval of CDP 97-16. CT 97-10 is subject to all conditions contained in Planning Commission Resolution No. 4487 for CDP 97-16. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this residential housing project are challenged this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 7. The developer shall pay the Agricultural Conversion Mitigation Fee established by the Carlsbad Local Coastal Program. The fee shall be deposited with the City prior to approval of the final map or issuance of a grading permit, whichever occurs first. Engineering: 8. There shall be one final subdivision map recorded for this project. 9. The developer shall defend, indemnify and hold harmless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, the Planning Commission or City Engineer which has been brought against the City within the time period provided for by Section 66499.37 of the Subdivision Map Act. Fees/Agreements 10. Dedications/Improvements 12. Additional drainage easements may be required. Direct access rights for all lots abutting Poinsettia Lane shall be waived on the final map. A note to the following effect shall be placed on the final map per the provisions of Sections 66434.2 of the Subdivision Map Act: "No grading or building permits are to be issued on Lots 1 through 5 unless subsequent discretionary approvals are granted." If any of the foregoing conditions fail to occur; or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke or further condition all certificates of occupancy issued under the authority of approvals herein granted; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Master Tentative Map. NOTICE Please take NOTICE that approval of your project includes the "imposition" of fees, dedications, reservations, or other exactions hereafter collectively referred to for convenience as "fees/exactions." You have 90 days from March 3, 1999 to protest imposition of these fees/exactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020(a), and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. Brad Wiblin (Bridge Housing) Tim Carroll (O'Day Engineering) Brad Burke Doug Avis Dee, the purpose of this memo is to summarize our discussion on the Planning Area 5 site development plan and the master tentative map. 1. The City will schedule the master tentative map for the 3/3/99 Planning Commission hearing. The tentative map does not need to be approved by the City Council because it is less than 50 units, 2. Bridge Housing is expecting to receive its bond allocation on or around 2/23/99, The bonds must be sold within 90 days following allocation. In order for Bridge to sell bonds, it must have control and ownership of the Planning Area 5 parcel. This means that Planning Area 5 must be a legal parcel by May of 1999, It is our understanding that the City Council (most likely as a consent item) must approve to final map before it can be recorded. In order to make sure that we are able to record by May, I have asked O'Day to prepare the final map now and submit it to the City for review. 3. We are making changing to the site development plan based on the last comments receive by the City on 1/4/99. The only two issues appear to be the sewer and sound wall. Tim will propose to the water district that Planning Area 5 sewer into an existing line in Avenida Encinas rather that into the 27" sewer line in the rail road right of way. This will eliminate the need for another "P" trap. When the sewer lift station is built with the development of the other Planning Areas, Planning Area 5 will then tie into the lift station. You will send a conceptual sound wall plan to Brad Burke. Brad will take another pass at a conceptual wall design that includes landscaped insets and other material. The wall plan for the site development plan will be a conceptual plan and will include a statement that the use of landscaped insets (approximately 18 to 24 inches by 30 feet) and material shown on the conceptual plan will be incorporated (where possible) into the final wall design with improvement plans. Brad will send to you the conceptual wall plan for your review and approval before we incorporate the plan into the resubmittal of the site development plan 4. Bridge Housing will start Brad Burke and O"Day on the preparation of improvement plans. These plans will include all site improvement plans, building plans and landscape plans and will be submitted to the City as soon as possible. It does not seem likely that a building permit can be issued in May (the date bonds are sold), but we are hopeful that these plans, can be processed quickly so that construction can begin soon after bond funding. The Planning and Engineering Departments have completed their review of the resubmitted project application for completeness and/or engineering issues. The project application is now or was previously found complete for the purpose of continued review. The project application does contain some engineering issues or concerns which remain to be resolved by the applicant. All engineering issues should be fully resolved or addressed prior to resubmitting the project for our review. The outstanding engineering issues or concerns are as follows: 1. As proposed, Lots 2 and 8 are still not fronting on a public street. The "general utility and access easement to be added with future tentative map" is not acceptable. We suggest either providing public frontage to each of the two lots; or eliminating these two lots from this map and place them on a future map when the planning areas are further subdivided. The project application is now or was previously found complete for the purpose of continued engineering review. The project application does contain some engineering issues or concerns which remain to be resolved by the applicant. All engineering issues should be fully resolved or addressed prior to resubmitting the project for our review. The outstanding engineering issues or concerns are as follows: 1. As proposed, Lots 2 and 8 are not fronting on a public street. We suggest either providing public frontage to each of the two lots; or eliminating these two lots from this map and place them on a future map when the planning areas are further subdivided. 2. There are two concerns regarding Lots 6 and 7 of this map. First, the Carlsbad Municipal Water District requires the map is to indicate a 12' wide access road for maintenance to the 27" sewer line which parallels the railroad tracks, along the west side of the project site. Second, the map should identify the area within these Lots that to be irrevocably offered to the City as a public trail easement. 3. Please identify on both the typical street cross sections and on Sheet 3 those areas along Avenida Encinas that will be dedicated as public right-of-way as a condition of this map. Attached is a redlined check print set of the project. Please forward this plan set to the applicant for corrections and changes as noted.
