ENGINEERING CONDITIONS
General
^42. NOTE: Unless specifically stated in the condition, all of the following
engineering conditions upon the approval of this proposed major
subdivision must be met prior to approval of a final map.
^38. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when such a
program is formerly established by the City.
V40. This project is approved for up to 2 final subdivision maps for the purposes of
recordation.
v 41. If the developer chooses to record a final subdivision map out of the phase shown on
the tentative map, the new phasing must be reviewed and approved or conditionally
approved by the City Engineer and Planning Director.
43. The developer shall provide an acceptable means for maintaining the private easements
within the subdivision and all the private: streets, sidewalks, street lights, storm drain
facilities and sewer facilities located therein and to distribute the costs of such
maintenance in an equitable manner among the owners of the properties within the
subdivision. Adequate provision for such maintenance shall be included with the
CC&Rs subject to the approval of the City Engineer. Note: Whenever CC&R's are
referred to, an alternative covenant or deed restriction may be used, subject to

approval of the City Engineer.
Rain gutters must be provided to convey roof drainage to an approved drainage course
or street to the satisfaction of the City Engineer.
All concrete terrace drains shall be maintained by the homeowner's association (if on
commonly owned property) or the individual property owner (if on an individually owned
lot). An appropriately worded statement clearly identifying the responsibility shall be
placed in the CC&Rs (if maintained by the Association) and on the Final Map.
The developer shall defend, indemnify and hold harmless the City and its agents,
officers, and employees from any claim, action or proceeding against the City or its
agents, officers, or employees to attack, set aside, void or null an approval of the City,
the Planning Commission or City Engineer which has been brought against the City
within the time period provided for by Section 66499.37 of the Subdivision Map Act.
Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall comply with all conditions
and requirements the City Engineer may impose with regards to the hauling operation.
The developer shall provide for sight distance corridors at all panhandle or common
driveway locations / street intersections in accordance with Engineering Standards
and shall record the following statement on the Final Map (and in the CC&R's).
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above
the street level may be placed or permitted to encroach within the area identified
as a sight distance corridor in accordance with City Standard Public Street-
Design Criteria, Section 8.B.3. The underlying property owner shall maintain this
condition."

Drainage, maintenance and hold harmless: The owner of this property on
behalf of itself and all of its successors in interest has agreed to hold harmless
and indemnify the City of Carlsbad from any action that may arise through any
drainage, m£t»vte^iajtt5e\o>ttabiKty^nd subsequent damage that may occur on,
or adjacent to, this subdivision due to its design, construction, operation or
maintenance.

The owner shall record a deed restriction on the property which relates to the proposed
cross lot drainage shown on the tentative map. The deed restriction document shall be
in a form acceptable to the City Engineer and shall:
A. clearly delineate the limits of the drainage course;
B. state that the drainage course is to be maintained in perpetuity by the
underlying property owner; and
C. that all future use of the property along the drainage course will not
restrict, impede, divert or otherwise alter drainage flows in a manner that
will result in damage to the underlying and adjacent properties or the
creation of a public nuisance.

56. Prior to approval of any grading or building permits for this project, the owner shall give
written consent to the annexation of the area shown within the boundaries of the
subdivision plan into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1 on a form provided by the City.
Grading
22. Prior to the issuance of a grading permit or building permit, whichever occurs first, the
developer shall submit proof that a Notice of Intention has been submitted to the State
Water Resources Control Board.
58. Based upon a review of the proposed grading and the grading quantities shown on the
tentative map, a grading permit for this project is required. J$Ke developer must submit
and receive approval for grading plans in accordance with city codes and standards
prior to issuance of a building permit for the project^"
>/61. No grading for private improvements shall occur outside the limits of the subdivision
unless a grading or slope easement or agreement is obtained from the owners of the
affected properties and recorded. If the developer is unable to obtain the grading or
slope easement, or agreement, no grading permit will be issued. In that case the
developer must either amend the tentative map or modify the plans so grading will not
occur outside the project site in a manner which substantially conforms to the approved
tentative map as determined by the City Engineer and Planning Director.
Dedications/Improvements
•^63. Additional drainage easements may be required. Drainage structures shall be provided
or installed prior to or concurrent with any grading or building permit as may be required
by the City Engineer.
"^64. The owner shall make an offer of dedication to the City for all public streets and
easements required by these conditions or shown on the tentative map. The offer shall
be made by a certificate on the final map for this project. All land so offered shall be
granted to the City free and clear of all liens and encumbrances and without cost to the
City. Streets that are already public are not required to be rededicated.
-/ 70. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide best
management practices as referenced in the "California Storm Water Best Management
Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be approved by the
City Engineer. Said plans shall include but not be limited to notifying prospective
owners and tenants of the following:
\f A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic
and hazardous waste products.
^B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other
such fluids shall not be discharged into any street, public or private, or
into storm drain or storm water conveyance systems. Use and disposal
of pesticides, fungicides, herbicides, insecticides, fertilizers and other

such chemical treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
v C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
s/(71) Plans, specifications, and supporting documents for all public improvements shall be
prepared to the satisfaction of the City Engineer. In accordance with City Standards, the
developer shall install, or agree to install and secure with appropriate security as
provided by law, improvements shown on the tentative map, and the following
improvements:
v A. Half (1/2) street improvements to Adams Street along the project
boundary, including transitions to existing improvements.
x/B. Reconstruction of improvements to Magnolia Ave. including but not
limited to removal and reconstruction of the curb, gutter and /or
sidewalk and the addition of driveways, drainage outlets and
underground utility connections.

A list of the above improvements shall be placed on an additional map sheet on the final map
per the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements shall be
constructed within 18 months of approval of the secured improvement agreement or such other
time as provided in said agreement.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:
79. The developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
with the Carlsbad Municipal Code and the City Engineer.

The District is responding to your request for conditions on the subject project dated
. In response to your inquiry of TT^i^.. oat VJilffi . the
District has reviewed the subject project. Based on our review of the project, we have
the following conditions regarding potable water, recycled water and sewer systems:
1. The Developer shall be responsible for all fees, deposits and charges which will
be collected before and/or at the time of issuance of the building permit. The
San Diego County Water Authority capacity charge will be collected at issuance
of application for any meter installation.
2. The Developer shall provide detailed information to the District Engineer
regarding water demand, irrigation demand, fire flow demand in gallons per
minute, and projected sewer flow in million gallons per day.
3. The entire potable water system, recycled water system and sewer system shall
be evaluated in detail by Developer and District Engineer to insure that adequate
capacity, pressure and flow demands can be met.
4. All District pipelines, pump stations, pressure reducing stations and
appurtenances required for this project by the District shall be within public right-
of-way or within easements granted to the District or the City of Carlsbad

5. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection
requirements.
B. Prepare and submit a colored recycled water use area map and submit
this map to the Planning Department for processing and approval by the
District Engineer.
C. Prior to the preparation of sewer, water and recycled water improvement
plans, the Developer shall submit preliminary system layouts to the District
Engineer for review, comment and approval.
6. The following note shall be placed on the final map. "This project is approved
upon the expressed condition that building permits will not be issued for
development of the subject property unless the District serving the development
has adequate water and sewer capacity available at the time development is to
occur, and that such water and sewer capacity will continue to be available until
time of occupancy."
7. All potable water and recycled water meters shall be placed within public right of
way.
8. The following items shall apply if checked:
D No more than 19 homes shall be served on a single potable water distribution
pipeline. For those locations with more than 19 homes, a looped potable water
pipeline system shall be designed.
D A public fire flow system shall be required for this industrial or commercial
development, and it shall be constructed as a looped pipeline system.

Plan Review Recommendations
The following recommendations are optimal security suggestions provided by Carlsbad
Police Department's Crime Prevention Unit. The purpose of this document is to
safeguard property and public welfare by reviewing and regulating the design,
construction, quality of materials, use and occupancy, location, and maintenance of all
buildings and structures. The Crime Prevention Unit presents recommendations in two
sections, site considerations and building recommendations.
Site Considerations
D Lighting
The police department suggests that individual homes be equipped on all sides
with lighting fixtures to illuminate the sides of the building. Light gives someone the
perception of being seen. The lights do not have to be of considerable wattage, low
levels of light are sufficient to provide a blanket of light.
Further, equip the fixtures with dawn to dusk sensors or timers. The department
recommends that the fixtures be adapted to use something other than an incandescent
bulb for energy efficiency. Place lights in the eves of the house to illuminate the sides
of the structure. Additionally, the department recommends the fixtures be protected by
vandal resistant covers.
D Light Sources
• Incandescent or Halogen lamps are short lived and fairly expensive to operate.
They put out a nice bright light and are easy to control. They are compact.
• Fluorescent lamps are less expensive to operate than Incandescent or Halogen and
have a longer life. They put out a good light but are a little more difficult to direct. They
are larger than the previous two.
• Mercury Vapor lamps are less expensive to operate than Incandescent or Halogen
and have a long life. Their color is not as good as fluorescent but they are easier to
direct and control. They are compact.

• Metal Halide lamps require fewer fixtures to illuminate an area but have a shorter life
than Mercury Vapor. They provide an excellent light and are easy to direct and control.
They are compact.
• High Pressure Sodium Vapor lamps require few fixtures and have a low operating
cost. The fixtures are expensive to purchase. They put out an excellent light and are
easy to direct and control. They are compact.
• Low Pressure Sodium Lamps have the lowest operating cost of all the lamps. The
fixtures are expensive but few are required. They put out a yellow light and the clarity is
not good. They are easy to direct and control. They are longer in size.
D Landscaping
The police department recommends that exterior landscaping be kept at a
minimal height and fullness giving police, security services and the public surveillance
capabilities into the area. Plant low profile shrubs, below three feet. Design
landscaping to keep a space between the tops of shrubs and the bottoms of trees.
Ensure the canopy of a tree is not lower than five feet. Do not allow trees to provide
access to the roof or balconies. Let landscaping augment, not deter from lighting.
Apply security plants where necessary to prevent loitering and tampering.
Security plants have prickly leaves or thorns. They limit access over fences and
through windows. They also reduce concealing and loitering. Plant low level security
plants on or around problem areas. Security landscaping, used with appropriate fences
provides excellent security, deterring intruders. For a list of security plants, please
contact the Crime Prevention Office at 931-2105.
If you design hills, burms and landscaping to conceal a house, you also provide
a place for an intruder to hide. For optimal security, allow surveillance of a house from
the street and from neighboring yards.
Install walls and fences that are see through for surveillance. Tall solid walls
around a home provide cover. Walls and fences at entrance ways should allow
surveillance. Prune trees away from fences to not provided access over the fence.
Thick foliage at the fence line impairs yard visibility and conceals a breach in the fence.
Lock gates and install gates that allow surveillance.
D Addressing
On the street side of the residence, display a street number in a prominent
location. Make the number easily visible to approaching emergency vehicles. The
numerals should be no less than four (4) inches in height and should be of a contrasting
color to the background to which they are attached. Display house numbers be
displayed in illuminated fixtures.
D Entrances
Keep entrance ways clear of clutter. Make sure you allow vision from the front
access street to front door entrance. Homes that have been designed without this
consideration have been more susceptible to front entrance penetration. Surveillance
is important.
Building Considerations
D Doors
Install wooden doors into the residence of solid core construction with a
minimum thickness of one and three-fourths (1-3/4) inches. This includes the garage
pedestrian door, and the door from the garage into the residence.
Further, equip all doors with a single cylinder dead-bolt lock using a 5-pin
tumbler. Connect the dead-bolt to the inner portion of the lock by connecting screws.
Ensure the lock has a one inch throw that can withstand a cutting tool attack. Choose a
dead-bolt that embeds at least three-fourths of an inch into the strike plate. Finally, re-
enforce the strike plate with a minimum of two, 3 inch screws.
Arrange all entry and exit doors to dwelling units so that the occupant has a view
of the area immediately outside the door without opening the door. Except doors
requiring a fire protection rating that prohibits them, such view may be provided by a
door viewer having a field of view of not less than 190 degrees. Mounting height should
not exceed fifty-four inches from the floor. Further, install no glass panels within

Doors that are partially glass also require a single cylinder dead-bolt lock. Also,
equip these doors with a burglar resistant glaze to prevent someone from breaking the
glass to enter the home.
D Sliding Doors
Install metal guide track at the top and bottom of horizontal sliding. The bottom
track should be so designed that the door cannot be lifted from the track when the door
is in the locked position. Also, equip the door with security hardware such as a pin.
D Double Doors
The inactive leaf of a double door requires the same solid core construction as a
single door and should be equipped with metal flush bolts, having a minimum
embedment of five-eighths (5/8) inch into the head and threshold of the door frame.
D Hinges
Use hinges for out-swinging doors with non-removable hinge pins or mechanical
interlock to preclude removal of the door from the exterior by removing the hinge pins.
D Garage Doors
Install two receiving points on doors that exceed sixteen feet in width; or, if the
door does not exceed nineteen feet, use a single bolt if placed in the center of the door,
with the locking point located either at the floor or door frame header. Or, use a torsion
spring counter balance type hardware.
D Windows
Equip all movable windows with security hardware to prevent them from being
lifted from the frame.

Engineering Department staff has completed the review of the above-referenced project
for completeness and to identify issues. From an Engineering perspective, the
application is considered complete. The proposed design has some issues that I have
identified below. These issues should be addressed, corrected or.resolved prior to our
support of this discretionary permit.
Issues:
• The proposed improvements to Adams Street should be continued to Magnolia
Ave. to provide a smooth and safe transition.
• The proposed transition to Adams Street should be extended north to provide a
smooth and safe transition.
• The proposed retaining wall along Adams Street will need a guard rail or a hand
rail added. Perhaps the wall could be reduced in height.
• The proposed brow ditch drainage system is not the preferred solution for this
subdivision design. The proposed cross lot drainage and the poor maintenance
of brow ditches has been an increasing problem in the City. A slightly higher wall
or slope to allow (pad) sheet flow to the panhandle lots, (lots 1 & 3), seems to be
a maintenance free and long lasting solution.
• It appears that the grading necessary for phase 1 will include parts of phase 2 to
improve drainage.
• The tentative map should use the correct symbol for the retaining wall along the
south west of this site and the end treatment at lot 8 is unclear. Again the
proposed drainage system is not ideal.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Tentative Tract Map/Site Development Plan, Application No.
CT 97-23/SDP 97-26, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals. No
processing of your application can occur until the application is determined to be complete.
The second list is issues of concern to staff. When all required materials are submitted the
City has 30 days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially
filed, December 19, 1997, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the
application. If an application is withdrawn or deemed withdrawn, a new application must

ISSUES OF CONCERN
Planning:
1. The density proposed for the project exceeds the density allowed by the General
Plan designation. The density range for the RLM designation is 0-4 dwelling units
per net acre. The project is proposed at 4.2 dwelling units per acre. City Council
Policy No. 43 establishes the priority guidelines for the review/consideration of
applications requesting the taking of excess dwelling units from the dwelling unit
bank. The proposed project appears to be an in-fill project which might satisfy the
criteria for inclusion in the "First Priority" group of project types. However, staff
cannot offer any certainty that the necessary excess units would be made available
for this project. In addition, although there are some means (e.g., Council Policy No.
43) available which make it possible to exceed the Growth Control Point (3.2
du/ac), the project would not be allowed to exceed the density range (a maximum of
4 du/ac). Therefore, the project would need to be revised to, at a minimum, fall
within the density range (0-4 du/ac) based upon the net developable acreage of the
site.
