BRIEF DESCRIPTION: This is a Subdivision to develop 28 single family lots and 2 open space
lots on 33.4 acres of moderately constrained land. The proposed
development is across the street and east of the recently constructed
subdivision CT 93-08, Ocean Bluff
ENGINEERING ISSUES AND DISCUSSION:

Comment: All frontage improvements and circulation infrastructure is conditioned to
be constructed concurrent with development.

Comment: The proposed import of 167,700 cubic yards of fill will be an issue for
this development. In 1991 a notice of violation was filed on this parcel. In February of
1998 a release of grading violation was recorded, the issue has been resolved,
although the soils report did identify some debris, old cars and trash to be removed
and disposed of offsite. Conditions of approval have been attached to this project
that address both of these issues. There are no other grading issues associated with
this project.

IMPROVEMENTS:
Off-site improvements: Poinsettia Lane is required to be constructed as identified in the
Poinsettia Lane Bridge & Thoroughfare District #2. The required improvements include
full width grading and dedication of offsite right of way. A reimbursement agreement has
been identified in the district and will be available to offset improvement costs.
Comment: No major improvement issues are associated with this proposed project.
VARIANCE:
The proposed panhandle design for lots 27 and 28 exceed length permitted per section
21.10.080 # 4. The proposed length is approximately 20' over the maximum length
identified in the City's code. The applicant has requested variance because of existing
alignment of Black Rail Road and because of the SDG&E power easement and tower.
The remaining portion of the design complies with the City's Municipal Code.

ENGINEERING CONDITIONS OF APPROVAL
42. NOTE: Unless specifically stated in the condition, all of the following
engineering conditions upon the approval of this proposed major
subdivision must be met prior to approval of a final map.
General
38. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when such a
program is formerly established by the City.
39. There shall be one final subdivision map recorded for this project.
44. All concrete terrace drains shall be maintained by the homeowner's association (if on
commonly owned property) or the individual property owner (if on an individually owned
lot). An appropriately worded statement clearly identifying the responsibility shall be
placed in the CC&Rs (if maintained by the Association) and on the Final Map.
45. The developer shall defend, indemnify and hold harmless the City and its agents,
officers, and employees from any claim, action or proceeding against the City or its
agents, officers, or employees to attack, set aside, void or null an approval of the City,
the Planning Commission or City Engineer which has been brought against the City
within the time period provided for by Section 66499.37 of the Subdivision Map Act.
46. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall comply with all conditions
and requirements the City Engineer may impose with regards to the hauling operation.
48. The developer shall install sight distance corridors at all street intersections in
accordance with Engineering Standards and shall record the following statement on the
Final Map (and in the CC&Rs if applicable).
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above
the street level may be placed or permitted to encroach within the area identified

as a sight distance corridor in accordance with City Standard Public Street-
Design Criteria, Section 8.B.3. The underlying property owner shall maintain this
condition."
Fees/Agreements
50. The developer shall pay all current fees and deposits required.
51. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
55. The owner shall execute a hold harmless agreement for geologic failure.
56. Prior to approval of any grading or building permits for this project, the owner shall give
written consent to the annexation of the area shown within the boundaries of the
subdivision plan into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1 on a form provided by the City.
57. This project is within the proposed boundary of the Aviara Parkway - Poinsettia Lane
Bridge and Thoroughfare Fee District #2. This project is required to pay a fair share
contribution towards the construction of Aviara Parkway - Poinsettia Lane in
accordance with the fee program (delete the rest of the condition)
Reimbursement Agreements
##. The developer may enter into a reimbursement agreement with the City for right
of way dedication and for required improvements to Poinsettia Lane as identified
in the Aviara Parkway - Poinsettia Lane Bridge And Thoroughfare District Number
2. If the agreement is entered into, it must be approved prior to dedication of right
of way and prior to the beginning of construction.
Grading
58. Based upon a review of the proposed grading and the grading quantities shown on the
tentative map, a grading permit for this project is required. The preliminary soils
report has identified debris, old cars and trash to be removed and disposed of
offsite. The grading plans for this project shall reflect the areas of removal and
shall conform to the recommendations contained in the Preliminary Geotecnical
Investigation dated January 12,1998.
59. Prior to the issuance of a grading permit or building permit, whichever occurs first, the
developer shall submit proof that a Notice of Intention has been submitted to the State
Water Resources Control Board.
60. Upon completion of grading, the developer shall ensure that an "as-graded" geologic
plan is submitted to the City Engineer. The plan shall clearly show all the geology as
exposed by the grading operation, all geologic corrective measures as actually
constructed and must be based on a contour map which represents both the pre and
post site grading. This plan shall be signed by both the soils engineer and the
engineering geologist. The plan shall be prepared on a 24" x 36" mylar or similar
drafting film and shall become a permanent record.
Dedications/Improvements
63. Additional drainage easements may be required. Drainage structures shall be provided

or installed prior to or concurrent with any grading or building permit as may be required
by the City Engineer.
64. The owner shall make an offer of dedication to the City for all public streets and
easements required by these conditions or shown on the tentative map. The offer shall
be made by a certificate on the final map for this project. All land so offered shall be
granted to the City free and clear of all liens and encumbrances and without cost to the
City. Streets that are already public are not required to be rededicated.
65. The full width of Poinsettia Lane shall be dedicated by the owner along the project
frontage based on a center line to right-of-way width of 51' feet and in conformance with
City of Carlsbad Standards.
65. Black Rail Road shall be dedicated by the owner along the project frontage based on a
center line to right-of-way width of 30' feet and in conformance with City of Carlsbad
Standards.
67. Direct access rights for all lots abutting Poinsettia Lane shall be waived on the final map.
The only exception to this condition is the access to SDG&E facilities and to any
public trail system.
67. Direct access rights for lots 1 and 20 to Black Rail Road shall be waived on the final
map.
70. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide best
management practices as referenced in the "California Storm Water Best Management
Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be approved by the
City Engineer. Said plans shall include but not be limited to notifying prospective
owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic
and hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other
such fluids shall not be discharged into any street, public or private, or
into storm drain or storm water conveyance systems. Use and disposal
of pesticides, fungicides, herbicides, insecticides, fertilizers and other
such chemical treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
71. Plans, specifications, and supporting documents for all public improvements shall be
prepared to the satisfaction of the City Engineer. In accordance with City Standards, the
developer shall install, or agree to install and secure with appropriate security as
provided by law, improvements shown on the tentative map and the following
improvements:
ON-SITE IMPROVEMENTS:
A. Poinsettia Lane full half width improvements (as a 102' major arterial) within the
boundary of this subdivision. Improvements to include but not be limited to full width
grading and drainage improvements, A.C. paving & base, curb, gutter & sidewalk,
public utilities, median hardscape, irrigation, and landscaping within this arterial
roadway.
B. Black Rail Road full half width improvements (as a 60' local street) along the frontage
of this project. Improvements include but are not limited to grading, curb, gutter &
sidewalk, A.C. paving & base, irrigation, landscaping and public utilities within this
roadway.
C. Sewer, Water and Storm Drains onsite and off site to serve this subdivision as
required and as shown on the tentative map.
D. Check Dams downstream of drainage outlets across open space lot 29 as shown on
the tentative map and as required downstream to control erosive velocity of
drainage. Location and design of these check dams to be determined in final design
of this project, subject to the approval of the City Engineer.
OFF-SITE IMPROVEMENTS:
A. The fully improved median portion of Poinsettia Lane, a 102' wide major arterial plus
an 18 foot wide lane. The off site improvement of Poinsettia Lane shall include but not
be limited to full width grading, transitions, AC berms, drainage facilities, and median
curbs as identified in the Aviara Parkway - Poinsettia Lane Bridge and Thoroughfare
District Number 2.
B. Offsite transitions and/or reconstruction may be required for Black Rail Road and for
Poinsettia Lane to provide a smooth transition to the satisfaction of the City
Engineer.
A list of the above improvements shall be placed on an additional map sheet on the final map
per the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements listed above
shall be constructed within 18 months of approval of the secured improvement agreement or
such other time as provided in said agreement.
77. Drainage outfall end treatments for any drainage outlets where a direct access road for
maintenance purposes is not provided, shall be designed and incorporated into the
grading/improvement plans for the project. These end treatments shall be designed so
as to prevent vegetation growth from obstructing the pipe outfall all to the satisfaction
of the City Engineer.
Final Map Notes
78. Note(s) to the following effect(s) shall be placed on the final map as non-mapping data:
78.C.2.The owner of this property on behalf of itself and all of its successors in
interest has agreed to hold harmless and indemnify the City of Carlsbad
from any action that may arise through any geological failure, ground
water seepage or land subsidence and subsequent damage that may
occur on, or adjacent to, this subdivision due to its construction, operation
or maintenance.
78.C.1.Slopes steeper than two parts horizontal to one part vertical exist within

Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:
34. The tentative map approval shall expire twenty-four (24) months from the date of
Planning Commission document approving this subdivision.
79. The developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
with the Carlsbad Municipal Code and the City Engineer.
80. Some improvements shown on the tentative map and/or required by these conditions
are located offsite on property which neither the City nor the owner has sufficient title or
interest to permit the improvements to be made without acquisition of title or interest.
The developer shall conform to Section 20.16.095 of the Carlsbad Municipal Code.

Structures on lots 27 and 28 shall be constructed in conformance with Section 504 of the
1997 edition of the Urban Wildland Interface Code.
For your information, the applicant will provide a modified landscape plan for approval
by this office and the Planning Department, which indicates conformance with the fire
suppression requirements of the City Landscape Manual. The fire suppression zones for
lots 1-26 will be defined by the view fence located in the rear yards of the structures.
Maintenance of all fire suppression zones will be the responsibility of the Homeowners'
Association.
Fire suppression landscaping for lots 27 and 28 will follow special instructions from this
office and the Planning Department, to further mitigate the reduction in defensible space.

The District is responding to your request for conditions on the subject project dated
November 2. 1998. In response to your inquiry of November 2. 1998. the District has
reviewed the subject project. Based on our review of the project, we have the following
conditions regarding potable water, recycled water and sewer systems:
1. The Developer shall be responsible for all fees, deposits and charges which will
be collected before and/or at the time of issuance of the building permit. The
San Diego County Water Authority capacity charge will be collected at issuance
of application for any meter installation.
2. The Developer shall provide detailed information to the District Engineer
regarding water demand, irrigation demand, fire flow demand in gallons per
minute, and projected sewer flow in million gallons per day.
3. The entire potable water system, recycled water system and sewer system shall
be evaluated in detail by Developer and District Engineer to insure that adequate
capacity, pressure and flow demands can be met.
4. All District pipelines, pump stations, pressure reducing stations and
appurtenances required for this project by the District shall be within public right-
of-way or within easements granted to the District or the City of Carlsbad

5. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection
requirements.
B. Prepare and submit a colored recycled water use area map and submit
this map to the Planning Department for processing and approval by the
District Engineer.
C. Prior to the preparation of sewer, water and recycled water improvement
plans, the Developer shall submit preliminary system layouts to the District
Engineer for review, comment and approval.
6. The following note shall be placed on the final map. "This project is approved
upon the expressed condition that building permits will not be issued for
development of the subject property unless the District serving the development
has adequate water and sewer capacity available at the time development is to
occur, and that such water and sewer capacity will continue to be available until
time of occupancy."
7. All potable water and recycled water meters shall be placed within public right of
way.
8. The following items shall apply if checked:
& No more than 19 homes shall be served on a single potable water distribution
pipeline. For those locations with more than 19 homes, a looped potable water
pipeline system shall be designed.
D A public fire flow system shall be required for this industrial or commercial
development, and it shall be constructed as a looped pipeline system.
9. The Developer will be responsible for construction of all sewer main as
necessary for the service of this project. Construction of the sewer main within
Poinsettia Lane and will include connection to the existing sewer in Poinsettia
Lane at the western boundary of Aviara Planning Area III.
10. The Developer will be responsible for the construction of approximately 1800
lineal feet of 18"PVC recycled water main, approximately 1800 lineal feet of 12"
PVC potable water main and approximately 1800 lineal feet of 30" welded steel
potable water main along Poinsettia Lane from Black Rail Road to the boundary
of Aviara Planning Area III. The Developer's Engineer will show the recycled
water main and the potable mains on the Poinsettia Lane Improvement Plans.
The Developer will be reimbursed for the cost of construction of the recycled
water main and the potable water mains as described above in accordance with
terms of a signed reimbursement agreement between the Carlsbad Municipal
Water District and the Developer.

ISSUES REVIEW
Engineering Department staff has completed another review of the above-referenced project for
issues. The last issues review on June 8,1998 letter are repeated in plain type and clarification
to these issues are bold & italicized. These issues must be resolved prior to approval. The
issues we have still outstanding at this time are:
• Improvements to Poinsettia Lane not clear. We expect this project to clearly show
full width grading within a complete right of way and the typical frontage (1/2)
street improvements. The Bridge & Thoroughfare District also has
requirements to construct median & 2 (18' wide) lanes that are reimburseable,
per the agreement. These improvements must be shown clearly. The plans
submitted have a lot of "improvements by others" and the actual proposed
improvements by developer are unclear.
• Median improvements to Poinsettia Lane not shown. Median curb, gutter, stamped
concrete surface, irrigation, landscaping, and drainage must be shown.
• Panhandle length for lots 28 & 27 too long 200' max. @ 30' width. Perhaps a 32'
wide hillside street per GS 1-A will work without the need for a variance.
Check with planning. It is difficult to produce a variance for a design hardship
when there is no surrounding homes developed like this, when the creation of
these two lots will also require 10' crib walls and 20' slopes. If the pads could
be stepped down slope to fit hillside conditions and if the hillside street
condition could be used the lots could be supported.
• Open space ownership and C.C.&R. maintenance condition. The proposed
drainage easements are too long, and the end structures should be
maintenance free, (see red-line comments on plans)
• The landscape buffer along Poinsettia Lane was reduced to 20' from the last
review. I Believe the Design Engineer confused guard rail requirements (3
meter min.) to over ride specific plan landscape buffer (50') requirements.
What is shown is an issue, is not a meandering condition as shown on sheet 1
and cannot be approved. Check with Planning Dept. for additional information.
Attached is a red-lined check print of the proposed project for the applicants use in
making the requested revisions. This check print must be returned with the
project revisions to facilitate continued staff review.

GENERAL COMMENTS
STORM DRAINAGE
Access must be provided for downstream portions of storm drain easements. Access
should consist of an all weather access road from a paved public right -of-way with a
maximum grade of 14% a gated entry, a minimum paving width of 12', 38' minimum
radius. The paving shall be a minimum of 4" AC over 4" Class II AB and a turnaround if
distance is over 300'. Access roads should be shown on the tentative project approval
to ensure adequate environmental approval.
Flexible Check Dams are shown within the proposed drainage easement. Who will
maintain/replace if necessary?
PUBLIC RIGHT-OF-WAY EASEMENTS
Poinsettia Lane is shown with a 20' trail easement which is shown to maintain both a 8'
pedestrian trail and a streetscape planting easement. The City currently has no
maintenance program for these areas. Who will maintain after construction?

project that address both of these issues. There are no other grading issues

DEJONG SUBDIVISION
ENGINEERING CONDITIONS OF APPROVAL
42. NOTE: Unless specifically stated in the condition, all of the following
engineering conditions upon the approval of this proposed major
subdivision must be met prior to approval of a final map.
General
38. Prior to issuance of any building permit, the developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formerly
established by the City.
39. There shall be one final subdivision map recorded for this project.
45. The developer shall defend, indemnify and hold harmless the City and its agents, officers, and
employees from any claim, action or proceeding against the City or its agents, officers, or
employees to attack, set aside, void or null an approval of the City, the Planning Commission or
City Engineer which has been brought against the City within the time period provided for by
Section 66499.37 of the Subdivision Map Act.
46. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project, the developer shall submit to and receive approval from the City Engineer for the
proposed haul route. The developer shall comply with all conditions and requirements the City
Engineer may impose with regards to the hauling operation.
48. The developer shall install sight distance corridors at all street intersections in accordance with
Engineering Standards.
Fees/Agreements
50. The developer shall pay all current fees and deposits required.
51. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
55. The owner shall execute a hold harmless agreement for geologic failure.
56. Prior to approval of any grading or building permits for this project, the owner shall give written
consent to the annexation of the area shown within the boundaries of the subdivision plan into
the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided
by the City.
57. This project is within the boundary of the Bridge and Thoroughfare Fee District No.2. This
project is required to pay a fair share contribution towards the construction of Poinsettia Lane
and Aviara Parkway in accordance with the proposed fee program. The developer is also eligible
for reimbursements as stipulated in the Fee Study Report dated April 3,1998.
Grading
58. Based upon a review of the proposed grading and the grading quantities shown on the tentative
map, a grading permit for this project is required.
59. Prior to the issuance of a grading permit or building permit, whichever occurs first, the developer
shall submit proof that a Notice of Intention has been submitted to the State Water Resources
Control Board.
60. Upon completion of grading, the developer shall ensure that an "as-graded" geologic plan is
submitted to the City Engineer. The plan shall clearly show all the geology as exposed by the
grading operation, all geologic corrective measures as actually constructed and must be based on
a contour map which represents both the pre and post site grading. This plan shall be signed by
both the soils engineer and the engineering geologist. The plan shall be prepared on a 24" x 36"
mylar or similar drafting film and shall become a permanent record.
Dedications/Improvem ents
63. Additional drainage easements may be required. Drainage structures shall be provided or
installed prior to or concurrent with any grading or building permit as may be required by the
City Engineer.
64. The owner shall make an offer of dedication to the City for all public streets and easements
required by these conditions or shown on the tentative map. The offer shall be made by a
certificate on the final map for this project. All land so offered shall be granted to the City free
and clear of all liens and encumbrances and without cost to the City. Streets that are already
public are not required to be rededicated.
65. Poinsettia Lane shall be dedicated by the owner along the project frontage based on a center line
to right-of-way width of 102' feet and in conformance with City of Carlsbad Standards.
65. Black Rail Road shall be dedicated by the owner along the project frontage based on a center line
to right-of-way width of 60' feet and in conformance with City of Carlsbad Standards.
67. Direct access rights for all lots abutting Poinsettia Lane shall be waived on the final map.
67. Direct access rights for lots 1 and 20 to Black Rail Road shall be waived on the final map.
70. The developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. The developer shall provide best management practices as
referenced in the "California Storm Water Best Management Practices Handbook" to reduce
surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such
improvements shall be approved by the City Engineer. Said plans shall include but not be
limited to notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm
drain or storm water conveyance systems. Use and disposal of pesticides,
fungicides, herbicides, insecticides, fertilizers and other such chemical
treatments shall meet Federal, State, County and City requirements as prescribed
in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
71. Plans, specifications, and supporting documents for all public improvements shall be prepared to
the satisfaction of the City Engineer. In accordance with City Standards, the developer shall
install, or agree to install and secure with appropriate security as provided by law, improvements
shown on the tentative map and the following improvements:
1. Full width improvements to Poinsettia Lane as a 102' wide major arterial within a full
width graded road way. This improvement shall include but not be limited to: curb,
gutter & sidewalk, fully irrigated and landscaped parkway/median and all necessary
utilities associated with this roadway. Offsite drainage structures, slope/construction
easements and transitions shall also be provided. A reimbursement may be provided if
the developer requests and completes the proper documentation, as required and as
noted in the Aviara Parkway - Poinsettia Lane Bridge & Thoroughfare District No. 2.
2. Completion of Black Rail Road as a 60' wide collector street including but not limited
to: curb, gutter & sidewalk, landscaping, utilities and drainage. Slope / construction
easements and offsite transitions shall be provided as required.
3. A complete storm drain system including offsite check dams and maintenance access as
required.
A list of the above improvements shall be placed on an additional map sheet on the final map per
the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements listed above shall
be constructed within 18 months of approval of the secured improvement agreement or such
other time as provided in said agreement.
77. Drainage outfall end treatments for any drainage outlets where a direct access road for
maintenance purposes is not provided, shall be designed and incorporated into the
grading/improvement plans for the project. These end treatments shall be designed so as to
prevent vegetation growth from obstructing the pipe outfall. Designs could consist of a modified
outlet headwall consisting of an extended concrete spillway section with longitudinal curbing
and/or radially designed rip-rap, or other means deemed appropriate, as a method of preventing
vegetation growth directly in front of the pipe outlet, to the satisfaction of the Community
Services Director and the City Engineer.
Final Map Notes

78.C.2.The owner of this property on behalf of itself and all of its successors in interest
has agreed to hold harmless and indemnify the City of Carlsbad from any action

COMPLETENESS & ISSUES REVIEW
Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this proposed project are
currently incomplete and unsuitable for further review due to the following incomplete
items:
1. The Tentative Tract Map must be prepared at a reasonable scale to enable a
complete review. Ideally a 1" = 40' scale works best. The plan, when approved is
also the same scale as grading or improvement plan and works well for checking
compliance issues.
2. Please submit the horizontal and vertical alignment information for all streets,
existing and proposed. Provide a separate profile plan for all streets with grades in
excess of 7%.
3. Please indicate aN easements and encumbrances, with the recordation number and
date, in accordance with the preliminary title report. Indicate the future disposition of
these easements either in plan view adjacent to the easement information, or as a
note or easement disposition chart. Note that typically, SDG&E easements require a
joint use agreement.
4. The grading violation from 1991 should have some kind of resolution. If there is a
note in the easement & title notes would be appropriate.
Additionally, staff has conducted a review of the project for engineering issues of concern.
Engineering issues which need to be resolved or adequately addressed prior to staff making a
determination on the proposed project are as follows:
Traffic and Circulation:
1. Please indicate Corner Sight Distance (sight lines), in accordance with CalTrans
criteria, for both directions at the proposed entrance to this project.
After review of the preliminary comments (97-74) it appears that issues with the
project access will need to be shown. If all preceding projects did not proceed how
would this subdivision gain access and utilities. Ideally we try to achieve a stand
alone design or address specific Offsite requirements to allow development to
proceed at an independent pace.
Sewer;
Please indicate sewer laterals from the proposed lots to public sewer facilities.
Show or note that sewer clean outs and laterals are not located in driveways. Show
water laterals and meter locations similar to sewer services with the same
restrictions. This can be done with a typical lot grading, drainage and utility plan.
Please show sewer and water mains and the proposed depth in accordance with
current standards. It appears that an offsite sewer system is proposed, please show
the entire concept or project design.
Water:
Please show the complete water system including Offsite looped or connecting
systems. Contact CMWD for design details and specifics.
Drainage:
The proposed outlet at Poinsettia will need downstream study for erosion and
sedimentation protection. Downstream erosion and sensitive habitat could be an
issue. Consider the present and developed increase in run off, try to mitigate any
impacts. From previous correspondence this area is sensitive if not prohibited by
endangered habitat.
Attached is a red-lined check print of the proposed project for the applicants use in
making the requested revisions. This check print must be returned with the
project revisions to facilitate continued staff review.

BRIEF DESCRIPTION: This is a Subdivision to develop 28 single family lots and 2 open space
lots on 33.4 acres of moderately constrained land. The proposed
development is across the street and east of the recently constructed
subdivision CT 93-08, Ocean Bluff
ENGINEERING ISSUES AND DISCUSSION:

Comment: All frontage improvements and circulation infrastructure is conditioned to
be constructed concurrent with development.

Comment: The proposed import of 197,00 cubic yards of fill will be an issue for this
development. In 1991 a notice of violation was filed on this parcel. In February of this
year a release of notice of grading violation was recorded, the issue has been
resolved, although the soils report did identify some debris, old cars and trash to be
removed and disposed of offsite. Conditions of approval have been attached to this
project that address both of these issues. There are no other grading issues
associated with this project.

DEJONG SUBDIVISION
(ENGINEERING CONDITIONS OF APPROVAL
42. NOTE: Unless specifically stated in the condition, all of the following
engineering conditions upon the approval of this proposed major
subdivision must be met prior to approval of a final map.
General
38. Prior to issuance of any building permit, the developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formerly
established by the City.
39. There shall be one final subdivision map recorded for this project.
43. The developer shall provide an acceptable means for maintaining the private easements within
the subdivision and all the private: streets, sidewalks, street lights, storm drain facilities and
sewer facilities located therein and to distribute the costs of such maintenance in an equitable
manner among the owners of the properties within the subdivision. Adequate provision for such
maintenance shall be included with the CC&Rs subject to the approval of the City Engineer.
45. The developer shall defend, indemnify and hold harmless the City and its agents, officers, and
employees from any claim, action or proceeding against the City or its agents, officers, or
employees to attack, set aside, void or null an approval of the City, the Planning Commission or
City Engineer which has been brought against the City within the time period provided for by
Section 66499.37 of the Subdivision Map Act.
46. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project, the developer shall submit to and receive approval from the City Engineer for the
proposed haul route. The developer shall comply with all conditions and requirements the City
Engineer may impose with regards to the hauling operation.
48. The developer shall provide for sight distance corridors at all street intersections in accordance
with Engineering Standards and shall record the following statement on the Final Map (and in
the CC&R's).
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above the
street level may be placed or permitted to encroach within the area identified as a sight
distance corridor in accordance with City Standard Public Street-Design Criteria, Section
8.B.3. The underlying property owner shall maintain this condition."
Fees/Agreements
50. The developer shall pay all current fees and deposits required.
51, The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
55. The owner shall execute a hold harmless agreement for geologic failure.
56. Prior to approval of any grading or building permits for this project, the owner shall give written
consent to the annexation of the area shown within the boundaries of the subdivision plan into
the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided ^ A
by the City.

Grading v
58. Based upon a review of the proposed grading and the grading quantities shown on the tentative
map, a grading permit for this project is required.
59. Prior to the issuance of a grading permit or building permit, whichever occurs first, the developer
shall submit proof that a Notice of Intention has been submitted to the State Water Resources
Control Board.
60. Upon completion of grading, the developer shall ensure that an "as-graded" geologic plan is
submitted to the City Engineer. The plan shall clearly show all the geology as exposed by the
grading operation, all geologic corrective measures as actually constructed and must be based on
a contour map which represents both the pre and post site grading. This plan shall be signed by
both the soils engineer and the engineering geologist. The plan shall be prepared on a 24" x 36"
mylar or similar drafting film and shall become a permanent record.
Dedications/Improvements
Desiltation / detention basins ????
62. The developer shall install or agree to install and secure with appropriate security as provided by
law desiltation/detention/urban pollutant basin(s) of a type and a size and at location(s) as
approved by the City Engineer. The developer shall enter into a basin maintenance agreement
and submit a maintenance bond satisfactory to the City Engineer prior to the approval of grading,
building permit or final map whichever occurs first for this project. Each basin shall be serviced
by an all-weather access/maintenance road.

63. Additional drainage easements may be required. Drainage structures shall be provided or
installed prior to or concurrent with any grading or building permit as may be required by the
City Engineer.
64. The owner shall make an offer of dedication to the City for all public streets and easements
required by these conditions or shown on the tentative map. The offer shall be made by a
certificate on the final map for this project. All land so offered shall be granted to the City free
and clear of all liens and encumbrances and without cost to the City. Streets that are already
public are not required to be rededicated.
65. Poinsettia Lane shall be dedicated by the owner along the project frontage based on a center line
to right-of-way width of 102' feet and in conformance with City of Carlsbad Standards.
65. Black Rail Road shall be dedicated by the owner along the project frontage based on a center
line to right-of-way width of 60' feet and in conformance with City of Carlsbad Standards.
67. Direct access rights for all lots abutting Poinsettia Lane shall be waived on the final map.
67. Direct access rights for lots 1 and 20 to Black Rail Road shall be waived on the final map.
70. The developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. The developer shall provide best management practices as
referenced in the "California Storm Water Best Management Practices Handbook" to reduce
surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such
improvements shall be approved by the City Engineer. Said plans shall include but not be
limited to notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm
drain or storm water conveyance systems. Use and disposal of pesticides,
fungicides, herbicides, insecticides, fertilizers and other such chemical
treatments shall meet Federal, State, County and City requirements as prescribed
in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
71. Plans, specifications, and supporting documents for all public improvements shall be prepared to
the satisfaction of the City Engineer. In accordance with City Standards, the developer shall
install, or agree to install and secure with appropriate security as provided by law, improvements
shown on the tentative map and the following improvements:

1. Full width improvements to Poinsettia Lane as a 102' wide major arterial within a full width
graded road way. This improvement shall include but not be limited to: curb, gutter &

sidewalk, fully irrigated and landscaped parkway / median and all necessary utilities
associated with this roadway. Offsite drainage structures, slope / construction easements and
transitions shall also be provided. A reimbursement of 50 % may be provided if the
developer requests and completes the proper documentation, as required.
2. Completion of Black Rail Road as a 60' wide collector street including but not limited to:
curb, gutter & sidewalk, landscaping, utilities and drainage. Slope / construction easements
and offsite transitions shall be provided as required.
3. A complete storm drain system including offsite check dams and maintenance access as
required.
A list of the above improvements shall be placed on an additional map sheet on the final map per
the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements listed above shall
be constructed within 1 8 months of approval of the secured improvement agreement or such
other time as provided in said agreement.
77. Drainage outfall end treatments for any drainage outlets where a direct access road for
maintenance purposes is not provided, shall be designed and incorporated into the
grading/improvement plans for the project. These end treatments shall be designed so as to
prevent vegetation growth from obstructing the pipe outfall. Designs could consist of a modified
outlet headwall consisting of an extended concrete spillway section with longitudinal curbing
and/or radially designed rip-rap, or other means deemed appropriate, as a method of preventing
vegetation growth directly in front of the pipe outlet, to the satisfaction of the Community
Services Director and the City Engineer.
Final Map Notes

78.C.2.The owner of this property on behalf of itself and all of its successors in
interest has agreed to hold harmless and indemnify the City of Carlsbad
from any action that may arise through any geological failure, ground
water seepage or land subsidence and subsequent damage that may
occur on, or adjacent to, this subdivision due to its construction,
operation or maintenance.
78.C.1. Slopes steeper than two parts horizontal to one part vertical exist within
the boundaries of this subdivision.
78.C.2. The owner of this property on behalf of itself and all of its successors in
interest has agreed to hold harmless and indemnify the City of Carlsbad
from any action that may arise through any Joint Access, Utility, &
Liabillity and any subsequent damage that may occur on, or adjacent to,
the panhandle / flag lot design for lots 27 & 28 of this subdivision due
to its construction, operation or maintenance.
78.D. No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above
the street level may be placed or permited to encroach within the area identified
as a sight distance corridor in accordance with City Standard Public Street-
Design Criteria, Section 8.B.3. The underlying property owner shall maintain

Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to the
following:
79. The developer shall exercise special care during the construction phase of this project to prevent
offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad
Municipal Code and the City Engineer.
80. Some improvements shown on the tentative map and/or required by these conditions are located
offsite on property which neither the City nor the owner has sufficient title or interest to permit
the improvements to be made without acquisition of title or interest. The developer shall
conform to Section 20.16.095 of the Carlsbad Municipal Code.
