CUP 01-12 - CASA MONTESSORI DE VISTA SCHOOL - Request for a private school located at 3016 Highland Drive on a 0.7acre lot. The site is located at the southeast corner of the intersection of Highland Drive and Carlsbad Village Drive in the R-1-1 0,000 zone and in Local Facilities Management Zone 1 . Mr. Wayne stated that a letter was received from the applicant requesting a continuance of the item to the meeting of August 7, 2002. He added that this item would not be renoticed. MOTION ACTION: Motion by Commissioner Baker and duly seconded, to continue Item #8 to the Planning Commission Meeting of August 7, 2002. VOTE: 6-0-0 AYES: Chairperson Trigas, Commissioners Baker, Dominguez, Heineman, White, and Whitton NOES: None ABSTAIN: None Chairperson Trigas stated that the applicant is proposing changes and told the audience if they were not available to attend the August 7th meeting to submit their concerns by letter. Fourteen people had submitted requests to speak on the item. 1 . CDP 01-11 - FRYE RESIDENCE - Request for approval of a Coastal Development Permit to allow for the construction of a single-family residence within the City's Coastal Zone located along the west side of Carlsbad Boulevard, between Cerezo Drive and Shore Drive within Local Facilities Management Zone 3. 2. CDP 02-02 - MCMILLIAN CONDOS - Request for approval of a Coastal Development Permit to convert an existing two-story, two-family residence to condominiums on property located at 5155- 5157 Carlsbad Boulevard in Local Facilities Management Zone 1 . 3. CT 98-05x2/HDP 98-03x2 - DEJONG PROPERTY - Request for a one year extension of time to allow for the final map to be approved on property located at the northeast corner of Black Rail Road and future Poinsettia Lane in the Coastal Zone and Local Facilities Management Zone 20. 5. CUP 02-02 - PUBLIC WORKS MATERIALS STORAGE - Request for a Conditional Use Permit to allow the temporary use of vacant property as a materials storage area for Public Works repair and maintenance activities throughout the City, on property generally located at the southwest corner of Palomar Oaks Way and the future Carrier Avenue, in Local Facilities Management Zone 5. 7. CT 01-17/CDP 01-48 - TAMARACK FIVE SUBDIVISION - Request for approval of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, Tentative Tract Map and Coastal Development Permit to subdivide a 1.42 acre infill parcel into 5 single-family residential lots located south of Tamarack Avenue in the R-1 zone and Local Facilities Management Zone 1 . Mr. Wayne stated that agenda items 1, 2, 3, 5, and 7 are normally heard in a public hearing context, however, these projects are minor and routine in nature with no outstanding issues and Staff recommends approval of all. He recommended they be acted upon and voted on as a group. If the Commission or someone from the public wishes to discuss or pull an item then Staff would be available to respond to questions. He stated the Commission's action is final on all items unless appealed to the City Council. Chairperson Trigas pulled Item #5 due to a request to speak that was submitted. (CDP 01-11, CDP 02-02, CT 98-05x2/HDP 98-03x2, and CT 01-17/CDP 01- 48). VOTE: 6-0-0 AYES: Chairperson Trigas, Commissioners Baker, Dominguez, Heineman, White, and Whitton NOES: None ABSTAIN: None Mr. Wayne stated that Michael Grim, Senior Planner, was available to answer any questions regarding for Item #5, Public Works Materials Storage. Chairperson Trigas opened the public hearing for Item #5. Michael Durkin, 5819 Dryden Place, Carlsbad, owner of the property directly below the proposed location for the public storage, stated he had an observation and request. Referring to the map in the package he pointed out that there is a cul-de-sac at the access to the property and the barrier at the end of the cul-de- sac is poorly maintained. He noticed that people party there on the weekend, drive motorcycles, etc. He requested that the barrier at the end of the cul-de-sac be improved to prohibit people from driving onto the City property for parties and driving their motorcycles there. Mr. Grim thanked Mr. Durkin for bringing this to their attention and said both Planning and the Public Works Department would be happy to work with him on getting a better barrier. Chairperson Trigas said she assumes they are not supposed to be partying there and suggested posting signs as well as a barrier. Mr. Grim said while it is public property he didn't think it was available for public use and signs could be posted. He added that native habitats are there also and they don't want them destroyed. Commissioner Dominguez asked if the area has any private or public enforcement patrols and added it might be a substantial liability for the City. Mr. Grim replied that, other than the Carlsbad Police Department, he wasn't aware of any. He added they could advise the Police Department that there is an ongoing issue out there and they could add it to a beat. Commissioner Baker asked if some of the problems would be solved once the storage facility is built because there won't be room for partying. Mr. Grim stated there is land behind it, but there would be more City presence with the facility out there, and protection of the materials they store there will add to the need for enforcement. Commissioner Heineman asked if the City golf course was going to be nearby. Mr. Grim stated that this is part of the property that is within the golf course proposal. MOTION ACTION: Motion by Commissioner Baker and duly seconded, that the Planning Commission adopt Planning Commission Resolution No. 5235 approving the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program issued by the Planning Director, and adopt Planning Commission Resolution No. 5236 approving Conditional Use Permit CUP 02-02, based upon the findings and subject to the conditions contained therein. The Commission voted 6-0 (Commissioner Segall Absent) to APPROVE your request. The decision of the Planning Commission became final on July 17, 2002. The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written request for the preparation of the record of the proceedings shall be filed with the Planning Director, Michael J.
