PROJECT NAME: Rancho Carrillo Village B Phase II
APPLICANT NAME: Continental Ranch. Inc.
This application is a request for a Condominium Permit and Site Development Plan for Phase II
of Village B of the Rancho Carrillo Master Plan. The proposed project consists of 124
condominium units on the 7.3 acre site. 82 of these units are proposed to be sold as inclusionary
affordable units consistent with the Rancho Carrillo Affordable Housing Agreement. The project
consists of 4-plex and 5-plex buildings of two and three bedroom units. The units range in size
from 901 SF to 1139 SF, and all units are provided with a two car enclosed garage.
STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MAP
CITY OF CARLSBAD
The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time restriction
on Planning Commission processing of Tentative Maps and a thirty (30) day time limit for City
Council action. These time limits can only be extended by the mutual concurrence of the
applicant and the City. By accepting applications for Tentative Maps concurrently with
applications for other approvals which are prerequisites to the map; i.e., Environmental
Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc.,
the fifty (50) day time limits and the thirty (30) day time limits are often exceeded. If you wish
to have your application processed concurrently, this agreement must be signed by the applicant
or his agent. If you choose not to sign the statement, the City will not accept your application
for the Tentative Map until all prior necessary entitlements have been processed and approved.
The undersigned understands that the processing time required by the City may exceed the time
limits, therefore the undersigned agrees to extend the time limits for Planning Commission and
City Council action and fully concurs with any extensions of time up to one year from the date
the application was accepted as complete to properly review all of the applications.

As we have discussed on the phone, a PFF is not being submitted since there is already a PFF
agreement on the site, and a letter from the School District is not being submitted since you are

has already been submitted to the City.

It is intended this instrument constitute a separate condominium plan, as defined in Civil Code
Section 1351 (e), as to each Building Envelope shown on the Attached Plans.
2. Attached to these Condominium Plans and made a part hereof are plans
("Attached Plans"). These notes and definitions are a part of the Attached Plans.
3. The Attached Plans describe nineteen (19) Building Envelopes, with each
Building Envelope being a three dimensional portion of the land described in Paragraph 1 above
and established pursuant to GOVERNMENT CODE § 66427. The dimensions of the Building
Envelopes shall be as follows: The lower elevation of each Building Envelope shall be ten (10)
feet below the finished floor elevation of the lowest Living Unit within the Building Envelope.
The upper elevation of each Building Envelope shall be fifty (50) feet above the finished floor
elevation of the highest Living Unit within the Building Envelope. The horizontal boundaries
of each Building Envelope shall be as shown on the Attached Plans and shall include within its
boundaries all portions of the respective building, including, but not limited to, the roof, any
chimneys, vents, balconies, foundations, overhangs, columns and other appurtenances,
regardless of whether any such items lie outside of the boundary lines for the Building
Envelope shown on the Attached Plans.

4. A total of eighty-seven (87) Condominiums are shown on the Attached Plans.
Each Condominium includes (i) a Living Unit, (ii) an appurtenant undivided interest in the
Common Area of the Building Envelope in which the Living Unit is located equal to the
reciprocal of the number of Living Units within that Building Envelope and (iii) any Exclusive
Use Area which the Attached Plans show as being appurtenant to the Living Unit (Exclusive
Use Areas which have the same numbering as a Living Unit are appurtenant to that Living Unit,
unless the Attached Plans show otherwise).
5. Each Living Unit is a separate interest in space as defined inCivitCODE §1351(f)
and shall have the dimensions shown and described on the Attached Plans. The following are
not part of any Living Unit: Bearing walls, columns, floors, roofs, foundations, central heating,
central refrigeration and central air conditioning equipment, reservoir tanks, pumps and other
central services, pipes, ducts, flues, chutes, conduits, wires and other utility installations,
wherever located, except the outlets thereof when located in the Living Unit and such items
as are used exclusively by an Owner and not in common. Each Living Unit shall include any
door or window within a perimeter wall, the interior undecorated surfaces of bearing walls and
perimeter walls, floors and ceilings, the outlets of all utility installations in the Living Unit,
including the fire box of any fireplace located in the Living Unit. Each Living Unit includes any
garage portion thereof.
6. The Common Area portion of a Building Envelope is all portions of the Building
Envelope excepting the Living Units within the Building Envelope.
7. Each Exclusive Use Area is an exclusive right to use a portion of the Common
Area or the Association Property. Each Exclusive Use Area is appurtenant to the Living Unit
it adjoins and the boundaries of the same are shown on the Attached Plans. The following
Exclusive Use Areas are shown on the Attached Plans: Balconies, Decks and Entryways.
8. The Association Property refers to all real property and easements owned by the
SERRANO AT RANCHO CARRILLO ASSOCIATION, a California Nonprofit Mutual Benefit
Corporation (the "Association") from time to time for the common use and enjoyment of the
owners of Condominiums. The portion of the Association Property which lies within the land
described in Paragraph 1 above, and which shall be conveyed to the Association at the time
the first Condominium covered by these plans is conveyed to an owner, is all the land
described in Paragraph 1 above excepting the Building Envelopes shown on the Attached
Plans. (Additional Association Property may also be owned by the Association). Any pipes,
wires or other utility installations which serve more than one Living Unit but which are not
owned and maintained by the City or a public utility and are not part of the Common Area will
also be Association Property (e.g., it is currently intended that there will be a private sub-meter
water system and private storm drain system within the Project). Television cable and related
CATV equipment and other communication equipment may be owned by the cable supplier or
another third party.
9. In interpreting deeds and plans, the then existing physical boundaries of "a
building, Living Unit or Exclusive Use Area, whether in its original state or reconstructed in
substantial accordance with the original plans thereof, shall be conclusively presumed to be
its boundaries rather than the boundaries expressed in the deed or Attached Plans, regardless
of settling or lateral movement of a building, fence, wall or other improvement and regardless

of minor variance between boundaries shown on the Attached Plans or deed and those of the
building, fence, wall or other improvement.

1. THE TERM "ASSOCIATION" SHALL MEAN AND REFER TO SERRANO AT RANCH CARRILLO ASSOCIATION A
