The only comment is the deletion of the reference to a recorded document in Section 2.22. Staff feels that there is adequate disclosure of the easement and restrictions for Lot 38 without the additional restriction recorded against the property. Please consider the maintenance of walls and fences, which are not party walls, which face outside the project and are not adjacent to common area. Both projects have masonry walls which front onto Black Rail Road and these would be better maintained by the association rather than individual owners. Also attached is a copy of the Notice Concerning Aircraft Environmental Impacts, also known as Noise form #2, for incorporation into the CC&Rs. The Planning and Engineering Departments approves the CC&Rs with the above comments. Please provide the City with a recorded copy of the official CC&Rs that have been approved by the Department of Real Estate and the Planning Director.
