Dear Mr. Gallagher,
Just a note of thanks and a confirmation of the Seaview Subdivision items resolved before the
Planning Commission meeting of October 20,1999.
It is our understanding the following items were resolved and added to the tentative map, Up-
grading plan being balanced and the height restrictions of 26.5 or 26.7 ft.; french drains in the
west end of property and up the north side, CC&R"s to cover the slope maintenance and the
height restrictions on the trees in Seaview Subdivision to no higher than the eves of the lesser
therein.
We supported your project in the Planning Commission meeting with the changes that were
made. We asked for an additional reduction of the pad height of lot#6 to 302 ft. As a result the
City of Carlsbad planning staff concluded a reduction of 2 feet would only effect the entire site
by 2 inches, therefore railing under the discretionary call of the Engineering Department.
Barbara Kennedy indicated there would be no problem with the City to lower lot #6 by 2ft.
We believe this is an acceptable way to accomplish all parties goals we all agreed upon. This
would result in no more delays for you. We all know, Carlsbad has not view ordinance, but the
views are important to all of us, creating value in our respective properties.
We believe you are a man of your word, and will follow through as you agreed. Thank you for
your willingness to work with us.
