CALIFORNIA Pursuant to our proposal and contractual agreement dated November 5, 1998, MV Environmental, Inc. (MVE) has completed a Phase I Environmental Site Assessment (ESA) at the above referenced property. The property consists of one 3.78 acre parcel located in Carlsbad, California. The site was formerly used for commercial agricultural purposes and is now planned to support nine single-family residences. MV Environmental, Inc. presents the following historical review of the past/present land use and identifies potential environmental concerns to future residents presented by findings of a limited baseline assessment of six near surface soil samples for chlorinated and organophosphorus pesticides. This report includes a recent site inspection for hazardous substances associated with past/present land uses, a review of current government database records of properties which have known environmental concerns within close proximity of the Property, and MVE's conclusions addressing the potential environmental liability to the Property from identified environmental concerns from on and off-site sources. References EXECUTIVE SUMMARY The Phase I Environmental Site Assessment (ESA) was performed for the MSK Development Group on a 3.78 acre parcel of land in Carlsbad, California under a contractual agreement with MV Environmental, Inc. (MVE). The Property has a street address of 3612 Seaview Way and currently owned by the Honda Trust. The Property is located approximately 1.7 miles east of the Pacific Ocean, north of the east/west trending Chestnut Avenue. Surface elevations presently range between 265' - 315' above mean sea level. The site slopes from east to west at approximately 9% grade. The site has been historically used for cultivation of "pom pom" mums and mini-carnations. Wood-frame greenhouse structures exist in the eastern 1/3 of the site behind the Honda residence. Aerial photographs of the Property identified the entire site has been used for agricultural purposes in the past. Adjacent properties are identified as single-family residential in all directions surrounding the Property. Government database records identified the Property under the name of Porter Farms as storing chemicals on-site. Records have been destroyed by the Department of Agriculture, Weights and Measures. No surrounding sites on the database files were identified which pose an environmental concern or endangerment to development of the Property. A baseline assessment of soil for organochlorine and organophosphorus pesticides identified residual concentrations of organochlorine pesticides in six near surface soil samples. One compound, Dieldrin, exceeds the Environmental Protection Agency (EPA) and California Preliminary Remediation Goal (PRG) value and pose a risk to human exposure in a residential setting. Our findings indicate the exposure concern exists within the upper 6 - 8" of soil. If the surface soils to a depth of 1-foot are removed and placed in deep fill areas and under roads, the exposure concern (inhalation, ingestion, and dermal contact) will be removed. It is our understanding that the Honda residence will be removed in the coarse of site development. The age of the structure (1947) warrants concern for asbestos containing building materials such as roofing materials, insulation, acoustic ceilings, floor tiles, and mastic material. We recommend reduction of airborne dust during demolition of the house by using copious amounts of water. If the above recommendations are followed, it is MVE's opinion, the environmental concerns identified within this report will not negatively impact development of the Property. MODIFIED PHASE I ENVIRONMENTAL SITE ASSESSMENT 3612SEAVIEWWAY CARLSBAD, CALIFORNIA 1.0 INTRODUCTION This report presents the findings of a modified Phase I Environmental Site Assessment (ESA) conducted by MV Environmental, Inc. (MVE) on the site identified as 3612 Seaview Way, Carlsbad, California (the Property). MV Environmental's work was conducted between November 5, 1998 and December 11, 1998. The purpose of the Phase I ESA is to identify, to the extent feasible, as defined herein, recognized environmental conditions in connection with the Property. The format of this appropriate inquiry follows Standard E1527-97 Environmental Site Assessments: Phase I Environmental Site Assessment Process published by the American Society for Testing and Materials (ASTM) 1997 revised edition. Accuracy and completeness of recorded information varies among information sources, including governmental sources. Recorded information is often inaccurate or incomplete. There may be additional site listings of hazardous waste/toxic sites, hazardous material spills, leaks, or accidents involving hazardous substances or petroleum products which have not been posted on the appropriate database. The environmental professional is not obligated to identify mistakes or insufficiencies in information provided. MV Environmental, Inc. evaluates the likelihood of risk associated with any observed, suspected or referenced hazardous substance sites resulting from on-site conditions and adjacent property activity. A description and example of a likelihood statement of risk to human receptors is provided in Appendix A. 1.1 Authorization to Proceed This work was conducted under a contractual agreement between the MSK Development Group (the client), and MV Environmental, Inc. (MVE) as stated in our proposal/contract dated November 4, 1998 and executed Novembers, 1998. 1.2 Scope of Work The scope of this Phase I ESA is to: 1) conduct a site inspection for evidence of on-site environmental concerns; 2) verify adjacent property land uses and determine whether adjacent sites present environmental liabilities; 3) review government database records on the Property and adjacent sites to identify environmental concerns within ASTM reporting distances from the Property; and, 4) report laboratory pesticide concentrations MODIFIED PHASE I ENVIRONMENTAL SITE ASSESSMENT PAGE 2 3612 SEAVIEW WAY, CARLSBAD, CALIFORNIA DECEMBER 14,1998 in six soil samples at areas of former commercial agricultural use and discuss human health concerns, if applicable. 1.3 Site Identification The site is identified as: Lot J of Map 823, Rancho Agua Hedionda, L.S. 441, ROS 1877, 6426 Assessors Parcel Numbers (APN): 167-070-04 Parcel Size: 3.78 acres Zoning: Residential Business Name: None Address: 3612 Seaview Way, Carlsbad, California 92008-2767 Owner: Honda Family Trust 7-22-97 2.0 SITE CHARACTERISTICS 2.1 Site Location The Property is located in north coastal San Diego County, in the central portion of the incorporated City of Carlsbad, State of California. It is situated approximately 1.7 miles east of the Pacific Ocean just west of El Camino Real and north of Chestnut Street (Figures 1 and 2). 2.2 Physical Setting The Property is situated on a gentle to moderate sloping west facing hillside with an approximate elevation of 300 feet above sea level. The Property has extensive ocean views from all points. The site is surrounded by single-family residential properties constructed within the past 15 years. Surface runoff from the Property sheet flows in a west/northwest direction. Bedrock exposures in and surrounding the Property have been mapped as Quaternary Linda Vista non-marine terrace sandstone divided into two sub-units. A lower sub-unit of coarse sand and gravel and an upper sub-unit of pebbly to gravelly sand. The deposits are presumed to be mostly non-marine as no fossils have been observed. This formation is locally described as Brownish to red sand. The deposits are only moderately consolidated and thus easy to excavate. According to the San Diego Water Quality Control Boards Basin Plan, the County has been divided into watershed areas or Hydrologic Units, Areas, and Sub-Areas with flow of surface and groundwater in the region in an east to west direction to the Pacific Ocean. The Property is situated in the Salto Hydrologic Sub-Area (4.21) of the Buena Vista Creek Hydrologic Area (904.20) of the Carlsbad Hydrologic Unit (904.00). The Carlsbad Hydrologic Unit is a roughly triangular-shaped area of about 210 square miles extending from Lake Wohlford on the east, to the Pacific Ocean on the west, and from Vista on the north, to Cardiff-by-the-Sea on the south. Surface water flows northwest to Buena Vista Lagoon and the Pacific Ocean. This surface water excludes recreational water contact. The lagoon has existing beneficial uses for biological habitat, wildlife habitat, rare species habitat, marshland, and warm freshwater habitat, and RARE designation for the survival of plant or animal species established under state or federal law as rare, threatened or endangered [according to the California Water Code Section 13050(e)]. Surface water has a potential beneficial estuarine use. The surface water of the lagoon is exempt from use as a navigational water body, as well as exempt status as an industrial water source. Determination of the depth to groundwater was not within the scope of this investigation. Groundwater in this hydrologic sub-area has a beneficial use designation for municipal and agricultural applications. A potential beneficial use designation has been given to groundwater for industrial processes. According to information provided by Environmental Data Resources, (EDR) the Property is situated at a distance greater than 2.0 miles south of a public supply water well located in Oceanside, California. It is our understanding the above mentioned well has experienced violations of water quality. The Property and its past agricultural land use does not, in our judgement, represent a contributing environmental concern to degradation of water quality in the identified water well, due primarily to proximity. Aerial photographic coverage of the Property and surrounding area were not available for review between the years 1930 -1960. Photographic review was otherwise conducted at approximate 10-year intervals. Structures (the Honda house, sheds, and greenhouses) were observed occupying approximately 85% of the Property from 1962 to 1985. Based on the identified past/present land use for commercial agricultural development, MVE feels there is a moderate to high likelihood, potentially dangerous agricultural chemicals which have been applied to soils in the past. The presence of residual agricultural chemicals in soil is discussed in Section 5.0. No indication of environmental concern (e.g., staining, waste disposal activities, oil/gas wells, dumping, or other activities) were observed in photographs reviewed. Use of the western half of the site for agricultural development declined some time in the later 1980's to early 1990's, as evidenced in the 1994 Satellite photograph attached as Figure 3. The greenhouses to the east of the house are still present but show no evidence of recent use. Only wood frame structures remain today. In 1928 the site was void of any structures, however, a portion of the Property was utilized as a citrus grove. The site has been used for agricultural purposes for approximately 70 years, as evidenced by aerial photography. 2.3.2 Sanborn Fire Insurance Maps EDR Sanborn, Inc. indicated that a search of Sanborn fire insurance maps has been reviewed based on supplied information, and fire insurance maps depicting the Property at the specified location were not identified. 3.0 RECORDS REVIEW MV Environmental, Inc. subcontracted Environmental Data Resources, Inc. (EDR) to perform a search of available Federal, State, County, and local database records which meets the ASTM Standard Practice E1527-97 for Environmental Site Assessments. The site and incident do not, in the opinion of MVE, present any environmental liability to the Property. 3.3 Local Listings 3.3.1 San Diego County Department of Environmental Health Leaking Underground Storage Tanks (LUST) The San Diego County Department of Environmental Health Hazardous Materials Management Division (HMMD) maintains a list of unauthorized releases of hazardous substance releases and petroleum releases from underground tanks, non-tank cases, groundwater contamination, and soil contamination cases. This database was updated October 13, 1998. Abatement of the MV ENVIRONMENTAL, INC.2450 VINEYARD AVENUE, #100 ESCONDIDO, CALIFORNIA 92029-1229 760/480-9789 HAZARDOUS WASTE INVESTIGATIONS SOIL & GROUNDWATER REMEDIATION ENVIRONMENTAL AUDITS MODIFIED PHASE I ENVIRONMENTAL SITE ASSESSMENT PAGE 10 3612 SEAVIEW WAY, CARLSBAD, CALIFORNIA DECEMBER 14,1998 environmental effects to the soil was accomplished by excavation and disposal of impacted soil at an appropriate facility. The case received closure status on July 28,1992. The high school also is identified on the HAZNET and HMMD database lists. The HAZNET list identifies the school disposed of polychlorinated biphenyl (PCB's) and materials containing PCB's in 1993. The HMMD listing identified the school uses oxygen and acetylene flammable gases (374 cubic feet) at the metal shop. The waste streams produced from the school are identified as: waste oil, waste oil filters, and hydrocarbon solvents. It is the judgement of MVE that the identified hazardous substances and previous waste oil release at the Carlsbad High School present a very low likelihood, if any at all, of impacting environmental conditions at the Property. This determination is based on the relative proximity away from the Property as well as its down-gradient location. The HMMD file reference for the Property under the name of Porter Farms pertains to agricultural chemical storage and/or use on the site while it was leased to Porter Farms. A list of chemicals stored on-site was maintained and periodically inspected by the San Diego County Department of Agriculture, Weights, and Measures. The HMMD siting references the Property in 1990, however, the Agriculture Department was contacted by MVE on November 18, 1998, and told that their records only extend back to 1994. No archive records from 1990 exist at the Department of Agriculture, Weights and Measures while the site was farmed by Porter Farms. MV Environmental, Inc. requested file review of any 1994 records their office may have on the Property to identify records of chemicals used. No records have been forwarded to MVE for review as of this writing. We will forward any information from this department upon receipt. 3.3.2 Carlsbad Building Department On November 23, 1998, MVE contacted the Carlsbad Building Department by telephone to determine whether their office had construction records for structures on the Property. MV Environmental, Inc. was informed that the Building Department has no record of construction/demolition permits for the Property. 3.3.3 Carlsbad Fire Department On November 23,1998, MVE contacted the Carlsbad Fire Department by telephone to determine whether their office had records of any hazardous substances or petroleum products stored at the Property. MV Environmental, Inc., was informed that the Fire Department office does not maintain a list of sites with underground fuel storage tanks. Permission to enter and inspect the Property was granted by Ms. Honda (owner). While conducting the site inspection, MVE performed an off-site visual inspection of surrounding properties for indications of environmental conditions which potentially may pose environmental concern to the proposed residential development. 4.1 Current Property Use The western half of the site is currently vacant of any structures and planted in grass. Remnant poles formerly used to supply electricity to greenhouses on this portion of the property were observed. Irrigation piping was also observed stacked near the center of the site, as was remnant wood-framing materials from former greenhouse structures. Skeleton framing was observed east of the 3612 Seaview Way, Honda residence. The structures are in disrepair and obviously have not been in active use for some time. Photographs of the Property are presented in Appendix C of this report. In addition to the greenhouses there were two storage sheds located on the south side of the residence. The eastern most storage shed contained a tractor, field farming implements, compressed gas (oxygen and acetylene), five gallon liquid propane, and pressurized gas container storing chloropicrin and three bags of perlite. Chemicals and gases were all stored in the northeast corner of this shed. A mat below the tractor was placed to absorb petroleum product from a leaking transmission or transfer case. Minor evidence of surficial soil staining was observed. The shed located southwest of the house was formerly a flower packing shed and used for dry chemical storage by Porter Farms. A refrigeration storage room also occupied the shed. In addition to the obvious chemical soil amendments which were stored on-site and added to soils during the Properties use as a commercial agricultural site, there were two pole mounted electrical transformers along the north side of the Property. A 50 and a 10 Kilovolt-Amp transformer were inspected and found to be in good repair with no observed leaks, nor soil staining evidenced during the site inspection. The probability of polychlorinated biphenyl (PCB) presence in the transformers is considered remote and in MVE's opinion, represents a very low likelihood, if any at all, of presenting an environmental concern to the proposed development. The petroleum hydrocarbon stain below the tractor is an isolated occupance and at this time does not pose a significant environmental concern to the proposed development of the property. It has been MVE's experience that this type of release affects the near surface soils only (upper 0.5 to 1.0 foot) and poses a very low likelihood, if any at all, of impacting groundwater or future inhabitants of the Property. This limited release will be removed during site grading. Presently agricultural development is dormant at the Property. The site is exclusively being used as a residence by the Honda family. 4.2 Past Property Use Past use of the Property is based on historical aerial photography review, interviews with the present owner, and conversations with a former lessee of the Property. The Property has been extensively used as commercial agricultural property for approximately 70 years. The past land use of the Property for commercial agricultural purposes presents concern for the presence of residual chemical concentrations in soil. It is MVE's opinion there exists a moderate to high likelihood that legally applied chemicals were used on-site. 4.3 Adjoining Properties The north adjacent property has been developed single-family residential since approximately 1967. Prior land use was observed as vacant property with no perceived use. The south adjacent properties are single-family residential and have been rural residential in the past with small citrus groves between 1928 -1963. The east adjacent properties are all single-family residential with a large municipal water tank occupying the hilltop property. The west adjacent properties are all single-family residential and was the first adjacent property to be residentially developed. Surrounding properties and their past/present land uses do not present an environmental concern to the proposed development of the Property. She was not aware of any wells, tanks, or hazardous materials storage, disposal, or use on-site. Her husband work the crops (mini- carnations and pom pom mums). Indicated they used pesticides and weed killer on-site. Indicated department only keeps records for four years. Latest date used by Porter Farms was 1990. MV Enironmental, Inc. requested file records from 1994 (oldest records). Will contact MVE when information is compiled. 5.0 SOIL ASSESSMENT Based on the historical use of the Property for agricultural purposes, MVE was authorized to conduct a baseline assessment for pesticide residue in soil. A total of six samples were collected for laboratory analysis on November 17, 1998 using standard sampling protocol as outlined in the latest edition of the Site Assessment & Mitigation Manual (1998) published by San Diego County Department of Environmental Health. The six sample (S-1 through S-6) locations were randomly chosen based on field reconnaissance and interviews. Soils were discovered to be dense and firm below the 10 inch level indicating the limits of tilled soil at the Property. Sample locations are posted on Figure 4 attached. Each discrete sample was placed in laboratory provided four ounce glass jars with Teflon lined lids, sealed, labeled, and stored in a cooler on ice during transport to a State certified analytical laboratory for analysis of organochlorine and organophosphorus pesticides. Samples were analyzed using Environmental Protection Agency (EPA) methods 8080 and 8140, respectively. It should be noted that sample tools were washed in a soapy water solution and double rinsed between each sampling interval to eliminate any potential for cross-contamination. No organophosphorus pesticide concentrations were detected at or above the laboratory detection limits. Both carcinogen and non-carcinogen compounds were identified in all six samples in the organochlorine pesticide group of compounds. Within the carcinogen category of compounds, ODD, DDE, DDT and Dieldrin were detected above the laboratory detection limit. The identified non-carcinogen compounds include Endosulfan sulfate, Endrin aldehyde, and Methoxychlor. Highest concentrations occur in the upper 6-8 inches of soil and decrease in the samples collected at a depth of 10 inches. All compounds are identified as insecticides and are virtually insoluble in water. Therefore, these compounds are expected to be limited to the horizon of tilled soil (approximately the upper one foot of topsoil). The following table presents the laboratory results for all detected compounds. Results are reported in milligrams contaminant per kilogram soil or mg/kg also equivalent to parts per million (ppm). For details please refer to Del Mar Analytical report attached as Appendix D. All reported concentrations of organochlorine pesticides in soil are below the EPA Region 9 PRG concentrations except for Dieldrin. Any concentrations above the posted PRG values for residential soils pose an unacceptable risk for exposure to humans. The Dieldrin concentrations in five of the six samples (0.03 ppm to 0.064 ppm) exceed the PRG values (0.028 ppm) and represent an elevated risk of additional cancer occurrence (1.07 x 10'6 to 2.29 x ID'6) above the established 1 per 1,000,000 or 1 x 10'6. 6.0 FINDINGS AND CONCLUSIONS The findings and opinions of MVE presented in this report result from review of previously issued reports, current regulatory databases, review of historical photographs, interviews with knowledgeable persons, a site reconnaissance, and a baseline assessment of soils for agricultural chemical residue. CALIFORNIA DECEMBER 14,1998 The 3612 Seaview Way property has been owned by the Honda Family Trust since the late 1940's. In that period the Property has been utilized for commercial agricultural growing of "pom pom" mums and mini-carnations. For the period between 1974 - 1990 the Property was leased to Robert Nandenofs who operated Porter Farms. Porter Farms allegedly grew "pom pom" mums during that period. Historical aerial photographs of the Property confirm this land use. A search of government database records identified no sites within close proximity with environmental liens or violations which would pose a potential endangerment to the proposed residential development of the Property. We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527 of 3612 Seaview Way, in Carlsbad, California, the Property. This assessment has revealed no evidence of recognized environmental conditions in connection with the Property except for the following: Residual Organochlorine Pesticides in soil. Pesticide contaminated soil is an area of environmental concern generally due to land-use changes involving proposed housing developments on former agricultural lands. Legally applied pesticides, and the resulting residues in soil, are not regulated as hazardous waste if the property is to remain agricultural but can pose exposure concerns to sensitive receptors (i.e., children and the elderly). A baseline soil assessment conducted by MVE at the Property on November 17, 1998 identified levels of the organochlorine pesticide dieldrin which exceed EPA Preliminary Remediation Goals (PRG's) a risk based value above which there is an increased risk of one additional cancer in a population of one million people. The study identified concentrations of dieldrin within the upper 10 inches of tilled soil over the entire site posting concentrations ranging between 0.0078 mg/kg and 0.064 mg/kg. The higher concentrations surpass the dieldrin PRG value of 0.028 mg/kg and thus pose a health risk, per the EPA and California standard. Other detected concentrations were identified for organochlorine compounds ODD, DDE, DDT, Endosulfan sulfate, Endrin aldehyde, and Methoxychlor at six randomly selected sample sites. All concentrations of the above compounds were below the risk based PRG values for residential soils and will not pose exposure concerns to occupants of the proposed development. Additional sampling of soils is not warranted in our opinion as it appears from this baseline data that the entire site has elevated levels of dieldrin within the upper 1.0 feet of soil which must be managed to reduce potential exposure concerns. It is estimated that approximately 6,000 cubic yards of soil are impacted. CARLSBAD, CALIFORNIA DECEMBER 14, 1998 Concentrations have been established at which specific compounds in soil are considered a hazardous waste if the generator desires to treat or dispose of the pesticide contaminated soil at an off-site facility. Off-site disposal requires additional testing to determine the soluble threshold leaching potential of the compounds in question. This option of treatment to remove the threat of exposure to carcinogenic compounds is not considered viable due to the large volume of affected soil and high disposal/transportation costs. It is MVE's recommendation that the surface soils to a depth of one foot be stripped and stockpiled for later placement under roads, driveways, or deepest fills where contact by young children (infants - 6 years) will not occur. Upon review of the proposed tentative map prepared by Buccola Engineering it appears these soils may be placed in the keyways and lowest elevations of the fill slopes on the western most lots 1, 2, 3, and 4 where between 9.5 to 14.5 feet of fill are planned. It is further recommended that the soil of concern should be placed under a minimum of 5 feet of good soil to reduce exposure concern. Additionally there appears to be room for fill soil under the proposed extension of Seaview Way. It is MVE's recommendation that worker exposure to dust containing organochlorine pesticide residue can be minimized by using generous amounts of water for dust control during the stockpiling and placement of affected soil during pad construction. It is our understanding that the house (Honda residence) is to be demolished in the course of property development. Although no sampling of building materials was authorized, MVE feels there is a moderate to high likelihood that asbestos may be present based on the year of construction (1947). Therefore, it is recommended that dust control be managed during demolition. This can also be accomplished on-site by applying abundant amounts of water on the building to settle any airborne dust. If the above recommendations are followed, it is our belief that the proposed development will not be impaired by environmental concerns associated with the Properties former land use. The implementation of the above referenced engineering controls will eliminate human exposure to residual organochlorine pesticides formerly applied at the Property. 7.0 LIMITATIONS This report was prepared for the exclusive use by our client, MSK Development Group, and their designated representative(s). Sensitive Receptors: There are individuals deemed sensitive receptors due to their fragile immune systems and special sensitivity to environmental discharges. These sensitive receptors typically include the elderly, the sick, and children. While the location of all sensitive receptors cannot be determined, EDR indicates those buildings and facilities - schools, daycares, hospitals, medical centers, and nursing homes - where individuals who are sensitive receptors are likely to be located. USGS Water Wells: In November 1971 the United States Geological Survey (USGS) implemented a national water resource information tracking system. This database contains descriptive information on sites where the USGS collects or has collected data on surface water and/or groundwater. The groundwater data includes information on more than 900,000 wells, springs, and other sources of groundwater. Flood Zone Data: This data, available in select counties across the country, was obtained by EDR in 1996 from the Federal Emergency Management Agency (FEMA).
