Subject: Request waiver of Active/Passive Common Area Requirement
CT-99-01 Map No. 14047 ;
Dear Elaine:
We are requesting the Planning Department, and City Council, to waive the common
recreational area commonly known as the "Volley Ball Area". The reasons for this request are as
follows:
1) All the houses have useable backyards that range from 400 to 1,500
square feet. This exceeds the required 200 square feet minimum. Each
house has it's own passive and/or active private yards.
2) The density is below the controlled growth limits for the site. It was our
understanding that projects below the minimum density of their general
plan designation would not be required to provide "common active
recreation area".
3) This is a small subdivision of Nine (9), new, marketable houses and one
(1) existing house. Because there is less than ten (10) new units, the
common area is a discretionary requirement. (I think?)
4) The location of the active recreation area (Volley Ball) is in close
proximity to the existing houses to the West and the Llewellyn Shores
Condominium. These neighbors could be subject to noise.
In conclusion, it is our opinion the common active area is more of a negative than a positive
factor. We hope you can direct us in how we can get this request approved through the City
Council.
