Gentlemen:
In accordance with the request of Mr. David Blalock of Hunsaker and Associates, this letter has been
prepared to express our opinion regarding eliminating the terrace drains on the proposed slopes
throughout the project site.
In our opinion, the use of terrace drains on cut or fill slopes exceeding 30 feet in height is not
necessary to maintain gross stability of the slopes. However, the proper installation and maintenance
of terrace drains should measurably reduce the potential for surficial slope erosion, particularly on fill
slopes. If used, we recommend that terrace drains be constructed at a drainage gradient of at least 5
percent. In addition, the need to properly maintain the drains is important. Drains that are not
periodically cleaned of vegetation and debris could result in significant slope distress and erosion.

Thanks for following up regarding the posting of security with the signal at Estrella del Mar and Alga Road.
I tried to catch you today, but it looks like I missed you. I would have preferred to talk in person (faster),
but instead I'll detail this in the email here. It is not my intention for you to do any additional work on this
issue, as I know you are busy. With that said, I do not expect you to pursue this with Ray Patchett
anymore. This seems like a departmental clarification versus a Council clarification.
Originally I had GVP contact Bob Johnson just to check his understanding on this issue of signal release,
but we had no idea it would make it's way to you and then to Ray Patchett for an answer. We did not mean
to involve all these parties.
Anyway, sorry for the delay in responding to your email, but I had to research the issue further to make
sure the traffic signal agreement and bond were still valid. After talking with Inspection and the Clerks, the
bond for the signal is still valid (SEC03031).
However, it is my understanding the agreement and security expire October 30, 2004. The agreement is
not valid till 2010, as the condition of approval for CT 99-03 may suggest (see pdf below).
I can tell you both Inspection and Development Services are confused on why we need to hold onto this
bond till 2010 especially since City Council acted to close the median at this intersection.
Although the condition states the signal bond is to be held till 2010, it also states this condition is to cover
either the installation of the signal or median closure (does not say both). I do not_think it was the
intention of the condition to hold onto the signal agreement/bond till 2010, that is, if the median closure
was installed in lieu of the signal (which it has). This places the developer in a difficult position to post
security to rebuild the intersection with a signal when and if the City decides the median closure was not
such a hot idea (we typically do not do this unless the conditions specifies this). I think, since Council
made the decision to construct the median closure, the security to install a signal is no longer needed. I
hope you and Bob Johnson concur.
Even if it is decided the signal agreement should be valid till 2010, the current agreement expires next
week and cannot be extended unless the City Engineer can make the finding that traffic signal warrants
are met (these are the terms of the agreement). The way the agreement was set up does not keep it valid
till 2010 date (our fault).
I apologize for any confusion here, but I hope this information helps. Thanks again.

Bob and I were discussing the Alga/Estrella de Mar signal/median issue and I asked Ray Patchett for
some guidance. I've attached my email and his response. Ray didn't address the issue re: the release of
the bond for the traffic signal. What is the timing of the need for a decision to either release or require that
the bond premiums be paid for the remainder of the specified duration? I'll push back on Ray but I don't
want to ask for an expedited response if there's no hurry.

C. Alicante Road shall be improved full width to collector standards (right-of-
way of 60 feet) from Alga Road to the north boundary of Lot 4. Additional
widening will be required for medians and at intersections to provide
adequate turn lanes and transitions.
D. Improvements to Alicante Road shall also include the 84" storm drain along
the proposed park site. The Developer may request that a reimbursement
agreement be established for storm drain improvements that serve other
projects or upstream development. If a reimbursement agreement is
requested it shall be approved prior to commencement of construction.
E. Modification to the drainage channel along the south side of Poinsettia Lane
is approved by a Special Use Permit. Specific outlet structures, slope
protection, walls, guard rails, and flood control features will be required in
final design. CLOMR and LOMR applications will be filed when design and
construction phases are completed. Prior to the City of Carlsbad accepting
work or improvements adjacent to this channel, the design and construction
revisions to FEMA (administration) shall be approved in writing. AH grading
and pads developed adjacent to this channel reconstruction shall be certified
as part of the pad or development as-built process.
F. The public water system (reclaimed and potable) shall be constructed onsite
to CMWD standards. Pressure Reducing Stations and associated
appurtenances shall be provided concurrent with construction.
G. Public storm drain system shall be constructed onsite to City of Carlsbad
standards.
Public sewer system shall be constructed onsite to City of Carlsbad
standards. The developer shall work with the City and shall provide
easements and sewer stub for the removal of the La Golindrina Sewer Lift
Station.
The channel redesign, storm drain improvements, earthen swales and
desiltation basins shown on the tentative map shall be constructed and
maintained until accepted by the appropriate authority. Annual maintenance
and reporting may be required and shall be the responsibility of the
developer and property owners until relieved in writing by authority or
public agency.
Provide for the construction and installation of a fully actuated traffic signal
at the intersection of Alga Road and Estretla De Mar. The Developer shall
post a bond for the design and construction of the signal prior to approval of
the first final map. The signal shall be installed if traffic warrants are met
and approved by the City Engineer. The bond shall remain in effect until
2010. The intent of this condition is to either close the median or provide a
traffic signal at Estrella De Mar. If warrants are not met the bond will be
released.

installation and completion of the public improvements subject to approval by the City Engineer.
The term "public improvements" in this Agreement shall include all labor, materials, and
incidental costs associated with the installation of public improvements described in Section
1(d) below and as approved by the City Engineer (the "Improvements"). All references to the
improvement plans shall include the plans and specifications for the installation of said
Improvements, subject to approval by the City Engineer; and,
E. An estimate of the cost of designing and constructing the Improvements in
connection with the Development has been approved by the City Engineer in an amount stated
on Page 1.
NOW, THEREFORE, in consideration of the approval and issuance of the Development
by the City, and other valuable consideration Developer and City agree as follows:
1. Developer's obligations to construct the Improvements shall be to:
a. Commence the design and construction of the Improvements within the
Deadline Date described below and pursuant to Section 1(b) and Section 20 of this Agreement.
b. Commence and complete construction of the Improvements once the City
Engineer has determined the need for the Improvements based on Intersection Signal
Warrants ("Warrants") pursuant to City Standards. The intersection described in this
Agreement shall be the intersection of Alga / Estrella De Mar (the "Intersection"). If, between
the date of this Agreement and the Deadline Date described below, the City Engineer
determines that the Warrants for the Intersection are met, the obligation of the Developer to
design and construct the Improvements must be satisfied pursuant to the terms of this
Agreement. Once the City determines Warrants for the Intersection are met, the City Engineer
shall prepare written correspondence directing the Developer to cause said Improvements to be
designed and constructed. Upon receiving said notice from City, Developer shall satisfy the
requirements of this Agreement to design and install said Improvements pursuant to the terms
of this Agreement.
c. Comply with all the requirements of Development, and any amendments
thereto, and with the provisions of the Code and all other applicable laws.
d. Complete at its own expense, in accordance with the plans and
specifications, and to the satisfaction and approval of the City Engineer, all of the
Improvements required in and adjoining the Development as follows:

Ray,
You probably recall the Alga Road/Estrella de Mar signal/median issue that Council wrestled w/ a while
ago. The ultimate decision was to direct the developer to construct a raised median along Alga that would
prevent all turning movements at the intersection of EDM w/ the exception of u-turns for westbound Alga
to allow the residents along the south side of Alga, east of EDM, to access their driveways w/out having to
go all the way to ECR to make u-turns. The developer's contractor has constructed the median. Some
local residents have expressed that they would like Council to reconsider their decision and have a signal
installed at the intersection. We required the developer to post bonds for both the median and a traffic
signal to allow the final map to go forward. The signal bond was required until 2010, but needs to be
renewed annually. Obviously, the developer will not want to pay to renew the bond, feeling that his
obligation has been satisfied with the construction of the median. On the other hand, we don't want to
release the bond if Council may want to reconsider this issue (and I hope they won't). Do you have any
suggestions on how to resolve this issue? The actual condition does state that the bond shall be for a
specified period of time. We could schedule an item for a Council meeting to request approval to release
the bond once the median work is completed. Alternatively, we could go to Council briefings or a
workshop to discuss. We do need to address the bond expiration issue before the end of the month,
however.

You're welcome.
It looks like the best solution is to not connect the Poinsettia Lane
culvert to the main line. This line was recently added, and should,
instead be routed in its own system across Poinsettia to the detention
basin. With the losses eliminated from the downstream junction
structure, the HGL will decrease at the sump, to about 1-foot below the
road surface. That point seems to be the critical point.
Basically, the high HGL is showing up now because we use a downstream
control in our hydraulics based on the backwater from the detention
basin calculated in the Chang study. O'Day Consultants apparently
assumed a free outlet control. In fact, our analysis might be
conservative, since we aren't incorporating any lag effects based on the
time of concentration. Most likely, at the point in the storm when our
peak hits the basin, it won't be completely full, and the actual HGL
would then be lower at the critical point. If necessary, we could pull
out the basin water surface elevation from the Chang study and use that
as a starting point, but that seems like we would be cutting this to
fine. I'd rather leave the factor of safety in this redesign.
Since we aren't proposing to change any culvert sizes downstream of this
point, I don't think I can improve on the results. Our proposal to
downsize pipe only impacted pipe upstream of this sump. Therefore, we
aren't adversely impacting the HGL at this point, only rendering our
professional opinion for what it would be, rather than relying on the
data provided in the original report.
Of course, this is all based on our calculations of peak flow, which
will be provided to you for review in the near future.

Thanks for the response. We will be pulling the hydro report together
to provide the detail you requested.
The higher HGL is triggered by new losses introduced downstream in the
Poinsettia Lane intersection. This occurred when Morrow decided to add
a new drainage system to convey drainage around the golf course,
eliminating their concerns of being flooded by the original design that
pointed some large culvert under-crossing at their tee box. I'll take a
hard look at how to solve the HGL issue, before submittal and come in
with some solutions.
The report will also cover how we determined the peak flow using the
approved upstream reports. Hopefully, our providing this detailed data
will enable us to reach a solution that solves the drainage issues in
the area.

I wish to talk specifically about proposed revision No. 3 to dwg 397-2F.
I have reviewed the proposed redlines to augment pipe sizes and
hydraulic grade lines in the storm drain. They also proposed to extend
the recycled water line.
I want to focus on the 84-in RCP in Alicante Road (near Station
71+15)The original storm drain for this reach is an 84-in RCP carrying
698 cfs with an HGL about 7-feet below the street grade.
The revised design shows an 84-inch RCP carrying 406 cfs and the HGL is
now .09-feet below the manhole rim cover in the street. This is a red
flag. Please explain why this is changing so drastically.
First of all I am unsure where the 292 cfs went that was supposed to be
in the 84-inch RCP. Is there another construction change that is
showing this effort? Is there a hydrology report that demonstrates the
routing of this Q to another storm drain or natural watercourse?
Per your email, sub areas that were not considered for some reason are
being added or modified from the original storm drain design. Provide
the City two copies of the revised hydrolgy/hydrologic report that
includes the all modifications/routing you are accounting for.
Also, having the HGL .09-feet below finished grade in Alicante is also
not acceptable. We need alternatives here. The HGL should not be so
close that it bubbles out of the inlets here.
We will be returning the redlines for the revision to dwg 397-2F, but
will not be releasing mylars until Engineering is comfortable with the

changes. Please resubmit all these changes back to Clyde for further
processing.

Ray.. I believe you have been made aware of our recent issues with the
multitude of construction changes processed by your office. We are
preparing a rather large package to formally reject your construction
change submittal and direct the proposed changes to formal plan review
that would apply. The construction review process has been abused and
frankly is taking a lot of plancheck, inspectors, planners, and
engineers time away from review of submitted and legitimate projects.
I will contact you later today or possibly tomorrow to arrange a time to
discuss these specifically.

Here is the weekly list. The hottest item is the proposed storm drain
change on Alicante Road. B&H had recommended release of the mylars, but
Clyde left a message stating he wasn't comfortable with the change to
the peak Q. I left Clyde a short response message last Friday, but
haven't heard back, so I thought I'd summarize the issue for you here.
It seems that the original plans did not consider development of either
Bressi Ranch or Alicante Road extension, and had a much higher Q. Our
analysis is based on routing the Q from PDC's approved hydrology report
for Bressi Ranch through the open space, and changes the routing of
drainage east of Alicante road based on our approved report for Alicante
Road. You may recall that we extended a pipe on Alicante to route this
water to the storm drain within the right of way, rather than through
the open space to the inlet location. The reduction of peak flow at the
inlet location shows that this pipe size can be reduced, based on our
inlet control calculations. If we need to submit any back up data, I'll
be glad to do so, but please let us know how to move this forward. I'd
like to get this finalized before any heavy rains hit.

Ray,
As you probably recall, at the CC mtg for the affordable housing site for the VLC Greens project, there
was extensive discussion re: the signal/raised median issue at the subject intersection. As a brief history:
At the first PC mtg for the Greens Tentative Map, staff recommended a raised median. The residents in
attendance spoke against the median. At the continued PC meeting, the PC changed the condition to
require a bond for the design and construction of a traffic signal prior to final map approval. Additionally,
there was some language re: the intent of the condition and indicating that the signal would be installed if
traffic warrants are met and approved by the City Engineer. At the CC meeting approving the TM, Council
modified the condition to eliminate the "conditional" part of the signal.... they want it in. At the CC meeting
for the approval of the SDP for the affordable housing site there was considerable opposition to the traffic
signal due to concerns about "cut-through" traffic. We were directed to address the CC at a future date to
resolve this issue.
To satisfy the condition(s), we've required the developer to design and post a bond for both the median
and the signal. At tomorrow's meeting, we're going forward w/ the final map for the Greens project. We
don't plan on presenting anything re: the median vs. the signal. It is still our recommendation that the
median is the appropriate sol'n. Since this goes against the CC determination for the TM approval we'll
have to find the appropriate venue to discuss this w/ them. I don't recommend that we do this at
tomorrow's meeting. This could overcomplicate things and potentially hold up their final map approval.
Since we have required the design and bonding for the signal we have fulfilled the approved TM
conditions.
I recommend that we move forward with the Final Map on consent. Afterwards, we can either resolve the
issue when we go back to CC for the next village, or "B", map for the next neighborhood in the Greens
project or we can work thru the Traffic Safety Commission w/ a recommendation to CC so that this issue
can be "unwound" in the same public forum that it was "wound up" in.
I think the potential adverse impacts of addressing the issue in the final map approval is too severe. For
example, if they don't get approval, it's possible that they won't get their grading permit and they'll miss the
environmental clearing window (ends 2/15) to remove the habitat on site. This could potentially delay the
construction of Poinsettia Lane w/in their development.
