Re: De Minimus Exemption for CT 99-08 - Spyglass II Project
The Spyglass II project is located on the southeast corner of El Camino Real and Carlsbad
Village Drive (see enclosed map and biological report). The project was approved in December
of 1999. The site is largely disturbed, as shown in the attached biological report. The project
will impact 0.16 acres of low quality coastal sage scrub (CSS) and 5.15 acres of perennial
grassland. The grassland has been mitigated through a restoration program on property owned
by the State of California and administered by the Department of Transportation and Fish and
Game.
The City believes CSS on this project qualifies for a De Minimus exemption from the 4(d) rule
based on the following findings:

The habitat to be impacted is low in quality, less than 1 acre in area, and not occupied by
the California gnatcatcher.
The habitat to be impacted is outside of identified preserve planning areas.
The project will not otherwise preclude design of the preserve system because the
project site has existing development on all sides and no feasible connectivity in any
direction.
The impact to 0.16 acres will be mitigated by the purchase of land within the Holly
Springs property, adjacent to the mitigation area (5 acres) previously purchased for the
Sunny Creek project.
