Dear Bob:
This letter report yimnmTi«M the results of my paleontological resource assessment of the
above referenced project Assessment is based upon a review of existing published and
unpublished geological literature (Weber 1982; California Division of Mines and Geology Open-
File Report 82-12; Eisenberg, 1983), and a review of museum paleontological records (San Diego
Natural History Museum). No field walkover of die site was conducted to confirm these data.
The 10-aot project site is located at the southeast corner of El Camino Real and Carlsbad
Village Drive in the City of Carlsbad. The site occupies a portion of the eastern slope of a tributary
drainage to Buena Vista Creek, Elevations range from approximately 140 feet to over 210 feet
above sea level The geology of die site is characterized by Eocene-age sedimentary rocks of the
Santiago Formation.
Concerning paleontologicRl resources, although no previous collecting localities were noted
in museum records for the project site, there are a number of recorded lo^tieswjthm a two-mile
radius of the site. These localities occur in the Santiago Formation and have produced important
skeletal remains of land *i*"nmtfe including carnivore, rodent, rhinoceros, brontothere (large
extinct rhino like browser), and protoreodont (small extinct deer like browser). These fossil
mammal remains ere very significant and represent one of the richest sources of paleontological
information about Eocene life in California,
Based on the proven paleontological resource value of the Santiago Formation, it is
suggested that development of the project site has the potential to create significant impacts to
paleontologkal resources. These potential impacts will occur when mats excavation activities cut
into the Santiago Formation.
Implementing the following measures can ensure mitigation of the impacts discussed above:
(1] Prior to initiation of construction activities the project developer shall retain a qualified
paleontologist to cany out the mitigation program outlined here. (A qualified paleontologist is
defined as an individual with a MS or PhD. in paleontology or geology who is familiar with
paleontological procedures and techniques.)
[2] A qualified paleontologist shall be at the pre-constniction meeting to consult with the
grading and excavation contractors.

[3] A paleoniological monitor shall be onsite at all times during the original cutting of
previously undisturbed deposits of high sensitivity formations (Santiago Formation) to inspect
exposures for contained fossils, (A paleontological monitor is defined u an individual who has
experience in the collection and salvage of fossil materials. The paleontological monitor shall work
under the direction of a qualified paleontologist)
[4] When fossils ate discovered, the paleontologist (or paleontological monitor) shall
recover them. In nwst cases this fossil satage can be completed m ^
However, some fossil specimens (such as a complete large mammal skeleton) may require an
extended salvage period, la these instances the paleontologist (or paleontologjcal monitor) shall be
allowed to temporarily direct, divert, or halt grading to allow recovery of fossil remains in a timely
manner. Because of me potential for the recovering of small fossil remains, such as isolated teeth
of small mammals (e.g., rodents and primates), it may be necessary to collect bulk matrix samples
for off-site screen-washing.
[5] Fossil remains collected during the monitoring and salvage portion of the mitigation
program shall be cleaned, repaired, sorted, and cataloged.
[61 Prepared fossils, along with copies of all pertinent field notes, photos, and maps, shall be
deposited (as a donation) hi a scientific institution with permanent paleontological collections such
as the San Diego Natural History Museum. Donation of the fossils shall be accompanied by
financial support for initial specimen storage.
[7] A final summary report shall be completed that outlines the results of the mitigation
program. This report shall include discussions of the methods used, stretigraphic section^)
exposed, types of fossils collected, and significance of recovered fossils. An inventory of curated
specimens listing catalogue numbers shall also be included.
In summary, the project site possesses a potential for producing significant paleontological
resources. Development of the project site will result in impacts to these resources. The measures
proposed above will ensure proper mitigation of these impacts. Please feel free to contact me if

Van - Attached is the letter from Fish and Game that allows us to proceed with the Re-Veg on
the CalTrans/Highland parcel for Spyglass TICT 99-09. By copy of this letter, 1 am asking my
client, Michael Ugar of Concordia Homes to now put together a cost estimate for the re-veg
plan so that he can put together a cost for 0.2 acre for Mr. Jim Scott, who has asked to purchase
credit for his project in La Costa.

Dear Mr. Ladwig:
Regarding: Spyglass Grassland Re-vegetation Project at
Carlsbad Highlands Ecological Reserve, Carbbad
You and your representatives (specifically including Pacific Southwest Biological Services
and their employees or subcontractors) have authorization to enter upon the Carlsbad Highlands
Eco togical Reserve, includi^
Game (Department) from the California Department of Transportation, for the purposes of
enhancing and recreating the native grassland ecosystem at the rcvegetation she on the property.
The revegetation effort wiH fbltow the attached "Perennial Grassland Revegetation Plan for the
Spyglass Development Mitigation" prepared by Pacific Southwest Biological Services, dated
October 23, 2000. Access to the property wifl be gained off of El Camino Real, up the existing
dirt roads to the property's south western comer. The following conditions apply to your
authorization to access Carlsbad Highlands Ecological Reserve (including the adjacent newly
acquired parcels):
1. No take of any threatened or endangered species on the Carlsbad Highlands site will
occur as a result of this activity.
2. Access wfll be granted for one year, renewable each year until the mitigation is
compile. A copy of this Letter of Permission win be kept on your person while on
the property.
3. Mr. Ladwig orthe contractor wttl notify ti» Department's representative (Ms. Km
McKee) m writing or by telephone at least 48 hours prior to entering the site. A
schedule, updated monthly, will sujjjce a$ notification for the duration of the project.
Mr. Ladwig, the contractor and/or subcontractor shall utilize exiting dirt roads and
established trails to the nwcinmm extent possible.
4. The Department does not incur airy current or future obligation for the monitoring,
management or success of the revegetation effort.

5. The State shall not be liable and Bob Ladwig and his clients, contractor and/or
subcontractors shall indemnify, hold harmless and at the option of the State, defend
the State, its officers, agents, and employees against and for any and all liability,
claims, damages or injuries of any kind and from any cause, arising out of or
connected in airy way-with the exercise of this Letter of Permission.
6. The Department reserves the right to temuute this event at any time if it is
determined to be incompatible with the Department's management goals or
objectives.
7. Entry upon the Reserve by Bob Ladwig and/or bis clients, contractor and
subcontractors for purposes stated herein shall constitute acceptance by Bob Ladwig
and/or his clients, contractor and subcontractors of all terms and conditions of this
Letter of Permission.
