Dear Van;
After reading the HMP document of April 19991 have some conclusions. The first being
that the HMP would not be adopted until sometime in the year 2000. Our tentative tract
map, with entitlements, would be approved long before that and therefore should be
exempt from the conditions proposed by the HMP.
The HMP does not address our property and does not show on any of the HMP hard line
or links maps. Therefore the HMP does not address our property and should be exempt
form the HMP. No mitigation or fee should be required.
Since the HMP does not address our property it does not show up on any table and
therefore would not affect the calculations in regards to loss of habitat. The net
calculation for the city of Carlsbad would remain the same.
The intent of the HMP is clear. It is intended to save valuable habitat and the links
between them. Our property is not a valuable habitat or link. It is an isolated mix of
native / non-native and mustard plant and is of low quality. No endangered plant or
animal life exists and is not on any chart in the HMP. It is of no value to the system
created by the HMP.
It is also not a narrow endemic, since no endangered plant or animals, per the HMP
charts, exist on the property.
The property is surrounded on all sides by development, and on two sides by major
roadways. This alone isolates it environmentally from the rest of the biological
community.
The noise, fumes, and encroachment of the community will never be conducive to any
endangered species of plant or animal life that would live in native grassland. Not to
mention the mustard plant that takes over the grassland and gives it a very low quality
habitat for any of the species.
There are five acres of new landscape planned for the site. This includes trees, plants and
ground cover, with irrigation. It seems to me that this would provide a better
environment for any small animal endangered or not.
Since we have five acres of proposed landscape area, this could be planted with native
grassland. Blue agave and cactus could be added for ascetics.
The HMP also promises a no hold up policy in section E-3.
In support of our conclusions we are submitting a supplemental biological report
prepared by Pacific Southwest Biological Services, on April 19,1999.
The take permit should be issued by the city of Carlsbad on the Spyglass project without
any further delay and should not be imposed as a condition of the tentative tract map.
